In regards to the below, I live in San Jose, and strongly object to non-citizens being allowed to vote. It is wrong. People nee to go through the proper channels to live in the U.S. We cannot allow non-citizens to vote here You are giving our country away. You voted for a vaccine card in San Jose, so you have now lost all of my business in your city and trampled on my rights as a U.S. citizen.
Do the right thing as an American.

Honorable Members of the San Jose City Council and those concerned, As the daughter of an immigrant who went through the lawful process to become a citizen, and as a tax payer of Santa Clara County whose vote and whose voice is greatly diminished by allowing unlawful residents to assume unearned sovereignty in the State of California, I strongly oppose extending voting rights to all residents in the City of San Jose.

AGENDA 1/11/22, ITEM 3.4

To: City Clerk < [email protected]>

To Whom It May Concern:
This agenda item has recently been brought to my attention. It is entirely unconstitutional and anti- American to let non-citizens vote and participate in elections.
In NO WAY does this recommendation "improve accountability, representation and inclusion", as the subject line of the recommendation claims. In fact, it does the exact OPPOSITE: it infringes on the rights of real, true citizens and undermines and overshadows our voices and votes.
These individuals choose to come to America ILLEGALLY (which is a whole separate issue). In any case, as ILLEGAL immigrants, they should NOT be given the same political choices and freedoms as TRUE, LEGAL, AMERICAN CITIZENS who have been here since birth and/or who have done the work and taken the necessary steps to become an American citizen.
If these non-citizens are to be held accountable, properly represented, and included, then they need to do their part and put forth the effort to actually become a citizen, to PROVE they want what's best for everyone and for this city/state/country; at which point, their rights (including the right to vote in any/all elections) will be awarded to them. We cannot just give and give to those who have proven their blatant disregard for this country's rules by coming in illegally. To allow individuals to benefit from a city/county/state/country's government in which they entered illegally is, once again, anti- American and should NOT be tolerated or allowed.
ITEM 3.4 IS AN ITEM OF GREAT CONCERN THAT WILL HAVE TERRIBLE CONSEQUENCES, IF ACCEPTED. I URGE YOU TO NOT ACCEPT THE RECOMMENDATION SET FORTH IN ITEM 3.4.
It is a very sad world to live in when our government officials — the people who are supposed to do what is best for their constituents — begin to falter in their judgement and consider making changes to the structure that has for so long been the backbone of not only our city and state, but of our COUNTRY. To even consider providing, let alone actually provide, citizenship-level rights to those who are NOT citizens is shameful, inexcusable and entirely unacceptable. I will not be giving my support or my vote to any of you in any future election or function. https://outlook.office365.com/mail/[email protected]/AAMkADUxOWI4ZjE3LTRkNDEtNGUzMS04MjAwLTlzNzdiYTdkMjc5NAAuAAAAAAC.. 1/2 1/11/22, 11:56 AM Mail - Agendadesk - Outlook

My name is Alexander Orozco, I am an immigrant rights fellow for SIREN (Services, Immigrant Rights, and Education Network) and I am in support of Agenda Item 3.4, more specifically, for eligible noncitizens to be given the ability to vote. In maintaining the status quo, about 150,000 noncitizens in San Jose are deprived of the ability to vote. Despite noncitizens paying taxes, they do not have the ability to elect legislators that are spending their tax dollars. Historically, the United States allowed noncitizens to vote in elections, however in the early 20* century, waves of xenophobia and racism led to public policy moving to deprive them of being able to vote. San Jose should join one of the 15 municipalities in the country that are pushing back against this policy. A policy that is rooted in discrimination, not only because of its content (depriving noncitizens, primarily PoC, of the right to vote for their own representatives), but historically as well, as the reason this policy is in place is because of the racism and xenophobia that pushed for it. In conclusion, San Jose, as a city that prides itself in its treatment of immigrants and the diversity that it has, should pass this agenda item as it would allow for tens of thousands of people to have a larger voice in their community, one that they deserve to have.

Hello,
My name is Kathryn Steakley and I am a member of Sacred Heart in San Jose. I am in favor of expanding voting power to all San Jose residents, regardless of citizenship status. Immigrants in San Jose, including those that are undocumented, pay taxes and therefore deserve representation and voting rights in our local elections. Expanding the vote will benefit all communities in San Jose.
Thank you for your time,

Expanding the voting power to all residents is a racial and social justice issue. The history of excluding immigrants and marginalized people from voting comes from the legacy of white supremacy. San Jose must do its part to end voting exclusion and expand the voting power to all residents.

Dear Mayor, and Councilmembers,
The purpose of the Charter Review Commission was to review the existing charter on the cycle of mayoral elections, the current mayoral system of authority, and consideration of additional measures and charter amendments as needed that will improve accountability, representation, and inclusion in San Jose City Hall.
We view the Carrasco Arenas memo, as a last minute, outrageous idea to extend the franchise to non-citizens. We strongly oppose including any charter review changes to include voting rights or policy directives. In fact, consideration of extending voting to non-citizens is off process and poorly conceived.
We urge you to adhere to the intent and purpose of the commission, in considering recommendations to revise the San Jose City Charter.
Sincerely,

Dear Honorable Mayor Liccardo and San Jose Council Members, I am writing to you today to voice my hesitation regarding item 3.4. In the United States, you must be 18 and a US Citizen to vote. This is true in the State of California as well. Putting in place a policy that goes against the very laws of our country and state, will face challenges, as we are now seeing in the City of New York.
Expanding the right to vote to undocumented residents in the city of San Jose, although well intended, would erode the sanctity of US citizenship, and disincentivize the obtainment of legal status and citizenship, a hallmark of our democracy. Once enacted, such policy will undoubtedly be expanded beyond municipal elections.
The idea that we should just change the law, rather than fix the actual problem, has in recent years resulted in negative unintended consequences.
Understandably, it is easier to change the law than to address the root problem. The real problem is the difficult pathway to citizenship. We should instead be focused on making applications for citizenship free, and waving or subsidizing the onerous processing and legal fees. (For example, We can incentivize newly minted lawyers to satisfy their student debt by doing monthly pro bono work to help applicants.) The solutions are out there, we need to collectively come together to find them. I believe the City of San Jose can be a beacon in this regard.
Lather than jumping on the bandwagon, I suggest waiting to see what happens in New York, learn from their mistakes before enacting policy that canno e unwound. This will only lead to smarter, and better polic Respectfully,
Liz Lawler

[External Email]
Good morning,
It has come to my attention that you will be voting to amend City Charter Section 1602 Election Procedure to: i. Extend municipal voting rights to all residents of the City of San José.
I am writing to urge you to vote NO on allowing all residents of San Jose Jose to vote regardless of citizenship status. It is important that people who come into this country from abroad understand the basis of our laws guaranteeing our freedoms and liberties. Oftentimes, people coming from other countries, ie the Middle East, Communist China, even Latin American countries, etc, have a completely different mindset based on the law system in their country of origin. Until they have gone through classes which teach them about our system of law which includes the Declaration of Independence, the Bill of Rights, and the Constitution and have become citizens, they should not be eligible to vote. https://outlook.office365.com/mail/[email protected]/AAMkADUxOWI4ZjE3LTRkNDEtNGUzMS04MjAwLTlzNzdiYTdkMjc5NAAuAAAAAAC. 1/11/22, 11:47 AM Mail - Agendadesk - Outlook
And, it is very important that they have a command of the English language, otherwise they can be manipulated by others to vote a certain way, without understanding what they are voting for.
My husband understands this very well as his first language was not English. He came here from Nicaragua and struggled in school as he immersed into the English language. The comprehension of everyday language is different.
Please take my comments into consideration when you cast your vote today.
Thank You.

Subject: Supporting Carrasco & Arenas Memo: Expanding Voting Rights in San Jose for ALL [External Email]
Hello, my name is Veronica Amador and I am a San Jose community leader, parent and voter. I lived and worked in San Jose for over 20 years.
I am in full support of council member Magdalaena Carrasco and Silvia Arenas memo in expanding the voting rights to everyone living in San Jose. The road to a more inclusive, democratic, and racially just San Jose starts with ensuring that everyone has a voice and vote in local elections. https://outlook.office365.com/mail/[email protected]/AAMKADUxOW14ZjE3LTRKNDEtNGUzMS04MjAwLTIzNzdiYTdkMjc5NAAuAAAAAAC.. 1/2 1/11/22, 11:47 AM Mail - Agendadesk - Outlook
It is unfair to tax residents and yet they have very limited representation and power in our society.
According to New American Economy, it is estimated that in 2018, immigrants in the San José Metro Area - a portion of which are undocumented - brought in $5.3 billion in state and local taxes alone.
Federally, the immigrant contribution is $12.9 billion. While immigrants help build our city's wealth, it is unfair that they do not have the power to make decisions over local ballot measures and elections. We need to end taxation without representation in our city and expand the voting power to all.
Expanding the vote will have a positive impact on all communities. San José Immigrants (green card holders and undocumented) are a diverse ethnic group that includes Vietnamese, Latino, Chinese, Hindi, African, Filipino/Tagalog, Europeans, and various other diverse communities. As part of our San José community, they contribute to building this city's wealth as business owners, teachers, tech workers, constructions, hospitals, hospitality, nurses, artists, nonprofit workers, promotoras and provide the pool of labor for all industries. Expanding the voting power to all residents will benefit all communities in San Jose and create a more inclusive city.
Expanding the vote to all residents will align San Jose with a growing movement to expand the power to voter to all residents across the nation. Municipalities across the U.S. that permit non-citizens to vote in local elections. 11 of these municipalities are in Maryland, two in Vermont and one in California. New York has recently passed a measure to give voting rights to approximately 900,000 legal noncitizens. In 2016, voters in San Francisco approved Proposition N, which permits non-citizen parents of children in public schools to vote in school board elections. It is time for San Jose to join the movement for a deeper democracy and expand the voting power to all residents, including non-citizens.
Expanding the voting power to all residents is a racial and social justice issue. The history of excluding immigrants and marginalized people from voting comes from the legacy of white supremacy. During the first 150 years of our nation's history, over 40 states provided the right for non-citizens to vote. During colonial times, voting was tied to being white and property ownership and therefore excluded women, Black Americans, Mexicanos/Latinos, Natives Americans, and poor whites. As the population of communities of color grew in this country (1880's and 1920's), White elites enacted various barriers to prevent the poor, people of color and women from voting. Literacy laws, poll taxes, felony disenfranchisement laws, voter registration requirements and restrictive residency were instituted to disenfranchise millions of poor people, people of color and immigrants. Exclusion from voting was also tried to nativist views of belonging and residency. The women's suffrage, civil rights movement and Black, Asian, and Chicano movements played a critical role to end these unjust restrictions at state, local and federal levels. San Jose must now do its part to end voting exclusion tied to racial and social injustice and expand the voting power to all residents.
Please expand the right to vote to all San Jose residents. Thank you for your time and consideration Veronica Amador

Subject: Supporting Carrasco & Arenas Memo: Expanding Voting Rights in San Jose for ALL [External Email]
Hello, my name is Hazel Roxas Atayan.
I am in full support of council member Magdalaena Carrasco and Silvia Arenas memo in expanding the voting rights to everyone living in San Jose. The road to a more inclusive, democratic, and racially just San Jose starts with ensuring that everyone has a voice and vote in local elections.
It is unfair to tax residents and yet they have very limited representation and power in our society. https://outlook.office365.com/mail/[email protected]/AAMKADUxOW14ZjE3LTRKNDEtNGUzMS04MjAwLTIzNzdiYTdkMjc5NAAuAAAAAAC.. 1/2 1/11/22, 11:46 AM Mail - Agendadesk - Outlook
Thank you for your time and consideration This message is from outside the City email system. Do not open links or attachments from untrusted sources.

City Leaders,
It has come to my attention that there is a vote, City Charter 1602, coming up and a study session regarding allowing non-citizens to vote or hold positions in local government.
As a third generation from this valley, I am shocked that this topic has even surfaced. It was not that long ago, that many of our ancestors struggled to get here and create a life for themselves.
While I am for legal immigration, that's how many of us got here, there are laws and reasons why we have legal immigration.

For you to strip away the founding of our nation with a stroke of a pen and not open to a public vote is wrong.
Your committee is drunk on power, and it has gone to your heads.
Please do not approve this City Charter as you will destroy everything that this country has fought for. If you approve this, your names will be known to the public and personally will never vote for you or support you in any way. I will pass this information along to friends and family, too.
I strongly urge you to not allow non-citizens to vote or hold local offices. The consequences of your actions will be with you for years to come. Please choose wisely.

Please vote against this. Immigrants need to understand the American ways, laws and constitution prior to being given the privilege of voting. This is a very slippery slope. Please read below from a friend:
I am an immigrant who came here escaping Sharia Law, and it took me 12 years to be able to vote after I got to the US. I'm glad I had to wait. Because when I came here, I had no idea what America was all about. I was forced to study the Constitution to get my Citizenship and boy did I have to relearn everything. Imagine now if even more people who have no idea of what America was founded on, folks who don't have any idea what an inalienable right is, are voting en-masse.
Yes, it's true that there was no test of citizenship years ago. But that was when it took 6 months to go across the country. Times have changed. Whenever we make a law we have to consider: What are the consequences if evil people take advantage of this law (evil people in public and/or evil people in government)?
Here's the real danger, if there is no test of citizenship, then why can't the Chinese Communist Party have 1M temporary "workers" show up in San Jose for the next election, register to a corporate address and vote? And if you don't need citizenship to vote, why do you need to be a citizen to be elected? So, at what point do we end up with CCP members as Mayor and Councilmembers and in control of our city? (I know you think we already have that).
It's the beginning of a real slippery slope to losing our nation.

Good Morning,
My name is Stacy Muccino and I am a member of Showing Up for Racial Justice at Sacred Heart and a local voter. I support the memo from Council Members Magdalena Carrasco and Sylvia Arenas on expanding voting rights to everyone living in San Jose.
Expanding the voting power to all residents is a racial and social justice issue. The history of excluding immigrants and marginalized people from voting comes from the legacy of white supremacy. San Jose must do its part to end voting exclusion and expand the voting power to all residents.

I am frustrated that the current elected city council would even consider giving undocumented residents of San Jose the privilege of voting. This opens up a whole host of issues regarding protecting the citizens of our republic. You have prerequisites and standards which bind the city council together as one body.
Why would you consider not the same standards and prerequisite for the the voters of San Jose. That is called being a citizen of the United States of America.
Please resend any consideration of allowing non-citizens the right to vote.
Thank you.

There must be a path to citizenship for immigrants who come to the United States of America and part of that path must include learning the history of our Country, including study of the Constitution, Bill of Rights, and the ideas of our Founders that make this country unlike any other in the world. Imagine now if even more people who have no idea of what America was founded on, folks who don't have any idea what an inalienable right is, are voting en-masse. Where will this take us? am a long time resident of San Jose, and I oppose allowing non-citizens to vote in San Jose. When my husbar nd | lived overseas, we lived and worked in another country, paid taxes there, but were not allowed to vote becaus our citizenship and allegiance were still with the United States. Voting should be for citizens only.

To Whom It May Concern—which is all of the legal, taxpaying citizens of San Jose, the city council, mayor and associated staff:
BE ON NOTICE.
We will not tolerate draconian measures to allow non-citizens, non-legal residents, non-taxpaying persons or any other entity without bonafide legal status to vote in matters that concern the majority of citizens who have paid for, participated in and built up this (formerly) great city. https://outlook.office365.com/mail/[email protected]/AAMKADUxOW14ZjE3LTRKNDEtNGUzMS04MjAwLTIzNzdiYTdkMjc5NAAuAAAAAAC.. 1/2 1/11/22, 11:40 AM Mail - Agendadesk - Outlook
Further, it is unconscionable that the city would consider allowing non-citizens to sit on boards and committees that have such vast and sweeping powers over the development and operation of this area.
Being a legal citizen, paying taxes, paying one's dues in time, treasure and talent, and standing tall as a legal participant in a city one loves is the measure for civic participation.
While it's true that there was no test of citizenship years ago, as Neil Mammen of the Values Advocacy Council so cogently states: "That was when it took 6 months to go across the country. Times have changed.
Whenever we make a law we have to consider: What are the consequences if evil people take advantage of this law (evil people in public and/or evil people in government)?" I would add, evil or not, such people will NOT have the best interests at heart for a place that they couldn't even take the time to become legally part of. (And spare me your lame, bleeding heart excuses.)
Further, Mammen states: "Here's the real danger, if there is no test of citizenship, then why can't the Chinese Communist Party have 1M temporary "workers" show up in San Jose for the next election, register to a corporate address and vote? And if you don't need citizenship to vote, why do you need to be a citizen to be elected? So, at what point do we end up with CCP members as Mayor and Council members and in control of our city?"
Frankly, I think we're already there. This city council is already CCP dressed up like Silicon Valley Hipsters.
Thank you, BTW, for destroying Sharks Hockey for many of us by demanding boosters on top of "vaccinations." I hope there is a lawsuit in all of your futures.
Not one of you will receive any future consideration, funding, or voting support from me or anyone else 1 am able to influence. Further, should you land a lucrative post-government job in some firm or consultancy, you will not receive my business or support there, either.

This is a very bad idea for our city and all of the legal American Citizens residents that call this San Jose home. We have built this city via the American Dream educated by our parents, neighbors, pastors, teachers and rule of law. If you have not been raised in American us it takes time and education to understand what our Republic is all about and how our government and social fabric is designed to work. That is why only American Citizenship is a requirement before an individual is granted voting rights. Do not disregard this sacred contact it is unfair for us United Sates Citizens that have fought for, work hard for, and built this City and it's neighborhoods and businesses!!! I very strongly urge the Mayor and all City Councils members to protect this law of United States Citizenship Right to Vote only!!! Bob

This is a violation of all US citizen's rights since anyone from outside the country, even enemies can vote and take controls over our country now. If this is allowed, enemies can vote and buy their way into our government and take over our country. This idea is treason! This has to be stopped and made known to all citizens. Whoever supports this idea will not be trusted anymore once all citizens know.
Thank you for hearing my voice!

Subject: Supporting Carrasco & Arenas Memo: Expanding Voting Rights in San José for ALL [External Email]
Hello, my name is Matt Gustafson and I am a San José community member living in District 3. I have lived in San Jose for over 14 years.
1/2 1/11/22, 11:38 AM Mail - Agendadesk - Outlook
It is time for San Jose to join the movement for a deeper democracy and expand the voting power to all residents, including non- citizens.
Please expand the right to vote to all San José residents. Thank you for your time and consideration This message is from outside the City email system.
