Dear Mayor, and Councilmembers,
The Charter Review Commission was to review the existing charter regarding mayoral elections cycles, the authorization of the current mayoral structure, and consideration of additional measures and charter amendments as needed that will improve accountability, representation, and inclusion in San Jose City Hall.
The back door, underhanded and deceitful 11th hour submission of the Carrasco Arenas memo to extend voting rights to non-citizens is poor public governance.
We strongly oppose the inclusion any charter review changes to include voting rights or policy directives. The consideration of extending voting to non-citizens lacks transparency, lacks logical and intellectual basis, and is poorly conceived.
We strongly encourage the City Council to keep focused on the purpose of the commission in considering recommendations to revise the San Jose City Charter.
Sincerely,
Bernie Vogel, Treasurer

Extend municipal voting rights to all residents [External Email]
Hello All,
We've learned that you will be voting to amend City Charter Section 1602 Election Procedure to: i.
Extend municipal voting rights to all residents of the City of San José.
We've read your proposal. We ourselves became citizens in March 2021, after going through the process of naturalization - background check, interview, citizenship test. So, you're suggesting that none of it matters to you. You allerge that many Green Card holders don't become citizens when eligible because they have to pay a $725 fee. We ourselves waited for 9.5 years before applying for citizenship because we weren't ready. You absolutely have no position to speak for the motivations of immigrants, this is so patronizing! And did you know that there is a waiver for this fee? You shouldn't be misinforming your constituents on how immigration works.
We would've normally supported local voting by all residents. But for the past year (and, more broadly, for the past 3-4 years) we learned that the attitude of the City Council towards their constituents is "shut up, we know better what's best for you". So, we rather expect that poorly educated voters, some with poor language skills, might be used as pawns, to be misinformed and make decisions against their own interests.
We're asking to vote NO and pray somebody actually reads it, without much trust and hope. https://outlook.office365.com/mail/[email protected]/AAMkADUxOWI4ZjE3LTRkNDEtNGUzMS04MjAwLTlzNzdiYTdkMjc5NAAuAAAAAAC.. 1/2 1/11/22,3:26 PM Mail - Agendadesk - Outlook

Subject: Supporting Carrasco & Arenas Memo: Expanding Voting Rights in San Jose for ALL [External Email]
Hello,
I am in full support of council member Magdalena Carrasco and Silvia Arenas memo in expanding the voting rights to everyone living in San Jose. The road to a more inclusive, democratic, and racially just San Jose starts with ensuring that everyone has a voice and vote in local elections.
It is unfair to tax residents and yet they have very limited representation and power in our society. According to New American Economy, it is estimated that in 2018, immigrants in the San José Metro Area - a portion of which are undocumented - brought in $5.3 billion in state and local taxes alone. Federally, the immigrant contribution is $12.9 billion. While immigrants help build our city's wealth, it is unfair that they do not have the power to make decisions over local ballot measures and elections. We need to end taxation without representation in our city and expand the voting power to all.
Expanding the vote will have a positive impact on all communities. San José Imigrants (green card holders and undocumented) are a diverse ethnic group that includes Vietnamese, Latino, Chinese, Hindi, African, Filipino/Tagalog, Europeans, and various other diverse communities. As part of our San José community, they contribute to building this city's wealth as business owners, teachers, tech workers, constructions, hospitals, hospitality, nurses, artists, nonprofit workers, promotoras and provide the pool of labor for all industries. Expanding the voting power to all residents will benefit all communities in San Jose and create a more inclusive city.
Expanding the vote to all residents will align San Jose with a growing movement to expand the power to voter to all residents across the nation. Municipalities across the U.S. that permit non-citizens to vote in local elections. 11 of these municipalities are in Maryland, two in Vermont and one in California. New York has recently passed a measure to give voting rights to approximately 900,000 legal noncitizens. In 2016, voters in San Francisco approved Proposition N, which permits non-citizen parents of children in public schools to vote in school board elections. It is time for San Jose to join the movement for a deeper democracy and expand the voting power to all residents, including non-citizens. https://outlook.office365.com/mail/[email protected]/AAMkADUxOWI4ZjE3LTRkNDEtNGUzMS04MjAwLTlzNzdiYTdkMjc5NAAuAAAAAAC.. 1/2 1/11/22,3:25 PM Mail - Agendadesk - Outlook
Expanding the voting power to all residents is a racial and social justice issue. The history of excluding imigrants and marginalized people from voting comes from the legacy of white supremacy. During the first 150 years of our nation's history, over 40 states provided the right for non-citizens to vote. During colonial times, voting was tied to being white and property ownership and therefore excluded women, Black Americans, Mexicanos/Latinos, Natives Americans, and poor whites. As the population of communities of color grew in this country (1880's and 1920's), White elites enacted various barriers to prevent the poor, people of color and women from voting. Literacy laws, poll taxes, felony disenfranchisement laws, voter registration requirements and restrictive residency were instituted to disenfranchise millions of poor people, people of color and immigrants. Exclusion from voting was also tried to nativist views of belonging and residency. The women's suffrage, civil rights movement and Black, Asian, and Chicano movements played a critical role to end these unjust restrictions at state, local and federal levels. San Jose must now do its part to end voting exclusion tied to racial and social injustice and expand the voting power to all residents.

Dear council members and officials,
I am writing to adamantly request that you vote NO on the Carrasco/Arenas memo on item 3.4.
The right to vote is a sacred right and duty of all legal residents in San Jose. This right should not be granted to anyone whose legal status to reside in America is not vetted. I am against giving voting rights to residents without first verifying their background.
Thank you.

Hello,
My name is Dr. Jill Anderson and 1 am the Deputy Director of Community Impact with SOMOS Mayfair. I enthusiastically support the expanding the voting power to everyone living in San Jose. The road to a more inclusive, democratic, and racially just San Jose starts with ensuring that everyone has the power to vote in local elections.
San Jose can take a big step towards becoming the 15th municipality to recognize the right to vote of all RESIDENTS regardless of immigration status.
After years of organizing for more just and safe and liveable communities for ALL, this is just plain common sense. The city belongs to those who live here (and all those who pay taxes too). Our human and civil rights are embodied, the right to vote is too sacred and too important to be relegated to a piece of paper. The right to vote belongs to every RESIDENT willing to show up. Subject: Vote on extending voting right to non-citizens - City Charter Section 1602 [External Email]
Dear Councilmembers,
I am very alarmed that you would consider amending the San Jose municipal election procedure to include all of the non-citizens, who are here illegally. This is a an extreme threat to the governance of San Jose, Santa Clara County, the state of California and the United States of America. Have you considered the possibility of thousands of Communist Party members illegally entering San Jose for the sole purpose of voting in next election and tipping the vote in their desired direction to gain control? The communist party is not the only organization seeking to gain control of laws in our nation. I know you are not so naive to believe that would not be a strategy used by powers whose goal it is to destroy the freedom we offer and enjoy in the United States of America. As you know, gaining residency in our nation is the most sought after in the world; that is not because we are an oppressive nation, but it is because we are not an oppressive nation.
The right to vote in every election and every level in our county and thereby express the will of United States citizens is a sacred right; it should not be extended to individuals who have not entered San Jose through the legal process or experienced preparation in understanding the history of our country and the cost patriots have paid for the right to vote, which is included in the required course for citizenship. If our legal path to citizenship needs reform, please work to make the improvements you see as needed rather than take this easy and very dangerous route to accomplishing your opinions on the issue.
PLEASE re-think the long-lasting and damaging effects this amendment will cause. It will be an open door to corruption and control by forces unfriendly to the freedom that has been purchased by so many veterans' lives and so many who have served San Jose, Santa Clara County, the state of California, and the United States with pure motives to best serve those who elected them. This amendment should be on the ballot rather than a decision made by a few individuals. It is much too important to rest on the judgment of a few individuals. Do you have the courage to make this a ballot choice rather than taking control of such a big decision yourselves?
I will very much appreciate an answer to my question. The citizens of San Jose deserve a say in this matter.

I heard on the news that the SJ city council may vote today on allowing non-documented individuals to vote in local elections. This is absolutely absurd and likely unconstitutional, I strongly oppose such measures. We live in a democratic republic not a democracy, the difference is is that a republic operates using rules and constitutional limits under a rule of law, in a democracy you could vote to hang someone just because you don't like the way they look.
Any member who votes for such a proposal will be voted out of office.

Hello,
It has come to my attention that you will be voting to amend City Charter Section 1602 Election Procedure to: i. Extend municipal voting rights to all residents of the City of San José. 1 am writing to urge you to vote NO on allowing all residents of San Jose to vote regardless of citizenship status. It is important that people who come into this country from abroad understand the basis of our laws guaranteeing our freedoms and liberties. Oftentimes, people coming from other countries, ie the Middle East, Communist China, even Latin American countries, etc, have a completely different mindset based on the law system in their country of origin. Until they have gone through classes which teach them about our system of law which includes the Declaration of Independence, the Bill of Rights, and the Constitution and have become citizens, they should not be eligible to vote. And, it is very important that they have a command of the English language, otherwise they can be manipulated by others to vote a certain way, without understanding what they are voting for.
Please take my comments into consideration when you cast your vote today. Thank You.
Kind Regards,
Melissa Smith

I oppose allowing "all residents" to vote in our city of San Jose.
This is fundamentally wrong.
Many have no idea what living in this country and city is really like.
Many illegal immigrants can "show up" in San Jose for the next election, register to a corporate address and vote without knowing the issue at hand.
If you don't need citizenship to vote, then why do you need to be a citizen in the first place? Such a flawed idea- you will turn San Jose into demise.
One must study our constitution and learn the ways of the land, just as our ancestors did and become a citizen, not just a resident! Vote No to change our City Charter Section 1602.
Thank you,
Joanie Murphy

We are writing to express our disagreement with the proposed amendment that would extend voting rights to non-citizens. We understand the difficulties that have been laid out in achieving legal status as noted in the memo from Councilmembers Carrasco and Arenas. But we do not believe that allowing illegal imigrants the right to vote in our local elections is a solution to this problem. What incentive will there be for this issue to get fixed if there is no longer a delineation between legal and illegal? The line has gotten blurred enough as it is. Most worthwhile endeavors are difficult. Obtaining citizenship is no different. And the majority of people we know who have obeyed the laws in order to reap the benefits of being a US Citizen have a sense of belonging and devotion to this country. Their loyalties are undivided and they are proud of their accomplishments. Legal citizenship will lose its value if the rights that go along with it are given away rather than earned. We are incredibly grateful for the work that some of these immigrants do. And for that, hopefully they are compensated monetarily as the rest of us are when we go to work. But the right to vote should not be considered part of the benefit package.
We strongly oppose this amendment and ask our representatives to take the thoughts of their constituents who disagree with them into consideration. We will be watching this vote and remember it in future elections.
Thank you for your time and service,
Nicholas and Heather Cook

LUNA is also an avid advocate for immigrants rights with the campaign papeles para todos (citizenship for all), which would ensure a permanent solution and a pathway to citizenship at the federal level, but it is clear that this is not a priority for this administration.
Over these past 7 years we have seen the injustices the Latine community and other communities of color face.
Covid-19 was a big eye opener as we saw devastating cases of individuals who lost their homes, their jobs and their loved ones. The undocumented community was the most impacted, they were the essential workers who kept the economy running, they work on grocery stores, pharmacies, and all other essential businesses that remained opened during the peak of the pandemic to ensure the city had all of our essential needs met. Our undocumented, essential workers did not receive any federal aid even when they were sick at home, feeling the lasting effects of covid-19. They did not even get a chance to vote in an election that would have a significant impact on their livelihoods.
You have in your hands the power to set things right, to stand up by the basic premises that formed this country; no taxation without representation. Every single one of you has a number of non-citizens in your ditrict and they too have the right to vote and elect officials who will represent them and their values. San Jose prides itself for being an innovative city, a city that welcomes immigrants, you have the power today to show that you are not only welcoming of imigrants, you acknowledge and respect their power of vote, the inherited right to have a voice in our democracy.
LUNA is in full support of the memo released by council member Carrasco and Arenas and we ask you to support the expansion of voting rights to all San Joseans.
Sincerely,
Mayra Pelagio-Muñoz
