Hello,
Your attempt at gun registration seems to be a way to begin a gun registry. That is not a good idea, since it endangers the legal gun owners, unless you have a way to guarantee that their addresses or other information is completely hidden from someone without a need to know.

You may receive a limited amount of tax revenue, but at the expense of upsetting quite a few legal gun owners.

Penalizing them for being stewards of our state is not right.I have family in San Jose and I go there frequently and will continue to do so with my firearm in my vehicle and on my person and I will encourage them to vote against this bill and be supportive of their city and neighborhood.

Dear fellow San Jose residents,
I am a San Jose native having lived here my entire 42 year life; in that time, I have experienced a lot including homelessness at one point, but I worked hard, put myself through school and am proud to be a contributing member of our community today. I pay taxes, and I vote in elections.

In my humble opinion, this proposed ordinance seems to punish law-abiding citizens for merely exercising one of their God-given, inalienable rights (just happens to be codified in our US Constitution); why would we want to do that?
There is a growing number of good people already fed up with high taxes who are now growing tired of being treated like “subjects” by their elected officials. These contributing members of our community (myself included) have been literally thinking every day about selling their homes and moving far, far away. Do we want to hasten the mass Exodus of the law-abiding, contributing members of our community? Please consider the following points:
-The proposed ordinance is a violation of court rulings against Jim Crow laws that tax constitutional rights. -Gun owners will not be able to comply with the ordinance. There are no insurance policies in existence that are available for gun owners to buy (what sound insurance company would be willing to write policies and if so, at what cost?).
-The ordinance will do nothing to stop the two overwhelming causes of firearm deaths: suicide and criminal activity. A 2017 PEW research study showed 97% due to suicide and criminal activity. -If passed, this proposed ordinance will be moot after the United States Supreme Court rules on New York State Rifle & Pistol Association v. Keith Corlett, No. 20-843 later this year. -Finally, the proposal implements taxes at the local level, in violation of the California Constitution on special taxes, Article XIII C Section 2(d).

Hello, this is a public comment on "Agenda Item 4 1 22 045 Gun Harm Reduction Ordinance."
It is also a comment on other proposed City ordinances against guns, as such local ordinances are unconstitutional, being that they are an attempt to circumvent state law, which local laws cannot do.

Neither can local laws place burdens upon gun ownership which would violate either state or federal laws, nor can local laws place a burden on gun ownership that would infringe upon one's Constitutional right, as this ordinance clearly would.

Therefore, not only must you cease any attempt to pass the "Gun Harm Reduction Ordinance," but as well, cease attempting to pass any local laws restricting gun ownership.

Americas legal gun owners will not put up with more intrusions on our second amendment and certainly will not pay for a right guaranteed by our constitution. Referencing The Firearm Owners' Protection Act of 1986:

FOPA is a United States federal law that revised many of the Gun Control Act of 1968 provisions. As such, FOPA makes it illegal for the national government or any state in the country to keep any database or registry that ties firearms directly to their owner. The exact wording of the provision is as follows:

No such rule or regulation prescribed [by the Attorney General] after the date of the enactment of the Firearms Owners Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or disposition be established Nothing in this section expands or restricts the Secretary's authority to inquire into the disposition of any firearm in the course of a criminal investigation

If you institute this tax, you are in essence, developing a firearm registry, which is illegal by Federal law.

So often people who care about the disparate impact of legislation point out that a given rule, code, or law will disproportionately affect the lower income citizens of a region. This proposed ordinance would do just that. If the fee or tax proposed in this ordinance is put in place, it will cost lower income people a greater percentage of their income than those who are better off It is a fact that people of color are a higher percentage of lower income citizens and they will be the ones, yet again, that will be discriminated against by this law. It should be noted that the initial "gun control" laws were passed in the South to prevent people of color from obtaining firearms for their own defense. This proposed ordinance is another instance of the just recently acknowledged bigotry inherent in the very fabric of our nation For that reason alone, not to mention that a fee will not lessen the violence in the city, this ordinance should not be passed.

I strongly object to a tax on legal gun ownership. Not only is a violaon of the Second Amendment to the Constuon, but it will do nothing to solve the illegal gun possession by criminals Does anyone really think that criminals will obey the law and pay a tax on their illegally owned guns? I don’t think anyone is truly that stupid.

Do NOT pass this ordinance. It is obviously related to "optics" merely a "feel good" measure to appeal to the public but ta ing gun purchases does nothing e cept line government pockets with more money that is rarely put to good use. It will prevent not a single gun sale, not a single act of misuse, nothing. What will stop illegal use of guns is proper policing, mental health awareness and training, better education in schools, employment, better parental involvement in schools, and a variety of other measures.

In the meantime, the good citizens of our communities should not be deterred from protecting themselves. It is their constitutional right to do so.

To whom it may concern,
I am writing this letter in reference to agenda item 4.122–045 as a concerned, tax paying, law abiding citizen.

As I understand the intent of considering a proposal like this, it is unconstitutional, and puts the burden on law abiding citizens to make up for criminal and negligent acts.

Unconstitutional in that, the 2nd Amendment clearly spells out that there is no requirement to owning a firearm to protect yourself other then being an American citizen. Having to pay for insurance to own a firearm along with the firearm being subject to confiscation if the individual is remiss on their payments is putting an undue barrier to owning a firearm, especially for people of limited means. Also the afore mentioned “fee” would also require the local government to collect and maintain a registry of firearm owners. All these things are against the citizen’s inalienable right of self defense spelled out in the 2nd Amendment. The phrase, “shall not be infringed” is very clear. These attempts of regulating a right are only a means of raising tax revenue, and creating a burden on the law abiding citizen.

The city also needs to look at what confiscation looks like. Are they prepared to go home to home and try to disarm citizens that disagree with the councils tax plan? This will be dangerous for the officers conducting these operations and be viewed highly unpopular nationally. There have been many situations where the government attempted to do the same nationally and it turned out to be dangerous with civilians and government officials being killed. Is the city of San Jose prepared for that type of public relations?

Why should I, as a law abiding citizen, pay taxes on a tool that criminals will not? If a criminal walks into a convenience store and buys a soda they pay taxes. When they obtain a firearm illegally they will not pay taxes...
