The proposed Public Safety Gun Harm Reduction Ordinance is an abuse of power by a city government by taxing lawful gun owners for the ownership of legally purchased firearms and then using those tax funds to encroach upon the Constitutional Rights of US citizens protected by the Second Amendment This proposed ordinance is a mockery to our Constitutional freedom and I am opposed to its passage.

I am in opposition to San Jose’s ordinance to tax lawful firearm sales.

Outside the debate that it is or may be unconstitutional, it is an overriding burden on lawful gun owners who follow the laws and purchase firearms legally.

This tax will NOT stop illegally obtained firearms. Criminals and others who are banned from purchasing or possessing firearms have already shown that they do not believe in or behave in accordance with ANY laws. These persons WILL illegally obtain firearms however and whenever they desire.

This proposed firearm tax will only affect law abiding gun owners.

Let’s go after the
real problem - those who break the laws. Arrest, convict and incarcerate those criminals - don’t coddle them. Send a signal that they will be convicted and incarcerated.

Be tougher on crime and criminals - not law abiding citizens.

San Jose Council members:

I just heard of this ridiculous proposed "Gun Harm" Ordinance. Given the state law preempting gun control measures, which is is nothing more than a thinly disguised gun control law, the city will undoubtedly be sued, once again, for infringement. It will wind its way through the courts but this time I think we should demand punitive damages.

I encourage you to avoid a lawsuit and reconsider this ordinance. The fact is, gun owners are the not the problem, the lack of enforcement of existing laws are one of the problems. The other is the reduction in police force - boots on the street.

Dear San Jose,
This bill is just silly. If the city wants to stop crime and violence, catch, prosecute, and incarcerate the criminals. It makes no sense to burden law abiding citizens who have passed background checks and who have lawful guns, with many of those handguns certified as safe for sale in California by the Department of Justice, and used for legal purposes. You are effectively punishing San Jose residents who are the good guys while diverting your attention from criminals.

Please don't pass this legislation. It only harms the City of San Jose and it's citizens while ignoring criminals. This bill makes zero sense.

Taking away my 2nd amendment rights is not the way to fight criminals go after the criminals and not the law abiding people. Street gangs are the criminals, so go after them.

People must keep their guns to protect themselves and their property and families When anyone calls the police for help, they are minutes away when seconds count to save a life.

People with permits to carry are vital everywhere to help save lives when criminals are around. Support people having permits to carry guns in public. Support people having guns in homes to protect their homes and families

Please understand that your efforts to tax citizens for exercising constitutionally protected rights is misguided. Please enforce the laws currently on the books and seek to remove criminals from society instead of focusing on law abiding citizens. I understand the impetus, and do not wish to see any more firearm violence, but taxing law abiding citizens isn’t going to stop what’s occurring.

Please focus on mental health, homelessness and policing true criminals. Your efforts there will be appreciated by all of your citizens and your neighboring communities too.

When a crime is committed it’s the mentality of the individuals. You don’t ban or tax vehicles for all the DUIs that happen in the city or State. If an individual commits a crime they need to be punished to the full extent of the law.

Criminal control not gun control.

Why is Michael Russells killer being release from prison early? They cut his head off with a knife when he was 15 years old. You’re not taxing knifes or banning knifes.

Again criminal control. If you kill or attempt to kill someone you should be in prison for life or put to death using the death penalty.

By Taxing law abiding citizens it shows how cowardly the city counsel is. Instead of truly getting tough on crime this proposed action of taxing law abiding citizens is an “easier” path similar to a parent who chastises the “good, compliant child” who won’t talk back rather than dealing with the rebellious, obstinate child who is much more difficult to deal with because it’s uncomfortable.

I get it. NOBODY likes confrontation, so avoid the difficult. Your jobs are not supposed to be easy. Your job is to keep the city running and the citizens safe. ALL THE CITIZENS! Not a single person can logically justify how a tax on already law abiding citizens will affect ANY change in the violent behavior of criminals! Only a fool would believe that. There are ample laws on the books now. Try enforcing those laws and incarcerating the guilty criminals instead of letting them go without bail to go out into society, the community you’re supposed to be protecting and making a better place to live.

Get tough on criminals! That’s your job! Don’t pass yet another law so you can sit back and say “look at what I did. I passed another useless law (tax) that will in no way enhance our communities or make them safer.

I understand that your looking to the “root” cause of your increase in violence. Weather it be gun or other means, maybe you should look at the judicial and punitive end of the enforcement continuum.

That’s where the system is FAILING, miserably. Some people are taking the “rehabilitation “ part of the system with a grain of salt.

Well, here are the results, did/would you expect anything else.

I have spent over 25 years a a police officer in this State, and the only thing criminals understand is a swift and severe punishment for their dastardly deeds.

For example:

The “three strikes” law changed the criminal behavior. The chaos in the city (Long Beach) I patrolled in changed, for the better.

I took an oath to uphold the constitution and to protect from ALL enemies, foreign and domestic.

And by declaring a bill to tax all legal owners is an infringement on their Constitutional Rights.

And in my eyes unenforceable.

Let’s bring back California back to a civilized society.

Keep and USE/ENFORCE the existing gun violence laws AND the enhancements. The results will be astounding. I’ve seen the difference, FIRST HAND.

I don’t think the Gun Harm reduction act is fair to law abiding citizens. It taxes them for crimes committed by criminals. Yet we already pay property taxes to get police protection. Also we are not getting our protection we are paying for with those taxes. This is an unjust tax. It assumes gun owners are the cause of violence. Wrong. I live next to San Jose, in one of the safest and most prosperous areas of the United States. Six years ago, my neighbor was the victim of an assault with a deadly weapon. After opening the door to assist someone he thought was in distress, the intruder forced his way into the home and struck my neighbor on the head with a firearm, causing him to fall into a 3-day coma. His wife pulled a fire alarm, which scared the intruder away. The Santa Clara County Sheriff's office searched for the assailant, and told me the next day they thought he abandoned his firearm somewhere on my property and to be on the look out for him or his associates who may come to retrieve it.

The reason I repeat this story is that this ordinance does the exact opposite of what it should do. Today, I am reading reports of deaths and violent assaults in Saratoga, and all of it is caused by criminals knowing that home entry crimes are low risk. Guns are not a significant risk to adults or children, as cars and alcohol kill multiple times more than firearms do, but the perceptions (incorrect as they are) persist. Now would be the perfect time for the city government to show moral and political courage, and stand against the headwinds, clear up misperceptions, and stand for something that makes us all safer.

Please do not go forward with the ordinance, and encourage a society where we all have a stake in keeping each other safe.

The “Gun Harm Reduction Ordinance” must be opposed. This is a silly, ineffective, foolish, unconstitutional effort that will do nothing to stop crime. Instead, efforts should be taken to enforce laws on the books, deal with the criminals, NOT punish law-abiding citizens.
