1. It will have zero effect on crime.

2. It punishes innocent people for the criminal acts of others.

3. It violates the 2nd Amendment and CA State Preemption laws.

4. It will force a lawsuit against the City that the city will absolutely lose wasting taxpayer money.

City Council members, respectfully, if you require citizens to pay what equates to a yearly tax against their very own security, I will be sure to vote out any Council member who votes for such a policy and vote in new members who will immediately overturn such and ordinance. I will advise all of my neighbors to do the same. This will be an embarrassing national issue on losing grounds and I cannot see any council member keeping their job if they vote for this and underestimate public sentiment for basic constitutional rights.

Increased taxes and liability insurance do not prevent accidents or save lives. You can do better. Focus on the actual issues and root causes instead of blindly penalizing those who you were asked to represent. Recognize that we have both criminal and civil law that govern accountability and act as prevention. Many citizens already have personal liability insurance as well, so there is no reason for them to be forced into an additional ultra specific gun based policy.

This action will only lead to high cost lawsuits that will force the city and its citizens into massive legal costs. I don’t want my tax money going to something so poorly connived. This future waste of resources could be better used to help the homeless, support our emergency services, reduce drug dependency, beautify our city, improve our schools, feed the hungry, etc etc.

Its obvious to all that the intent of this misguided policy is to simply discourage legal gun ownership.

This is the kind of careless, poorly considered, unconstitutional act that changes the political landscape and moves a liberal slanting, highly intellectual, Bay Area towards conservative policies.

It is hard to believe that your city is so anti-gun and anti-gun rights. Perhaps you have not read or have failed to understand the Constitution of the United States of America which I believe you have sworn to protect. If you proceed in this matter i along with thousands of others will donate whatever it takes to fight you in the courts to stop this attempt to limit, discourage and harass your citizens lawful right to peacefully enjoy and use their firearms by imposing restrictive taxes for political reasons. I am writing you to oppose this ordinance. In reading it, I do not see any provisions to reduce the supposed "gun violence" that San Jo e i e periencing We are one of the only large citie that did not ee a huge increa e in violent activity. All the data in the body of the ordinance is using numbers from other areas and not San Jose. This does not show that San Jose is experiencing this "dramatic rise".

1. How will this reduce crime?

2. Do you expect those that already that are prohibited from owning a gun to pay this?

3. Does any insurance company issue this insurance?

5. Why the exemptions? In the ordinance it mentions "same as car insurance". There are no exemptions there for low income.

6. Will the Chief of Police start issuing CCW permits to be able to apply for the waiver? If no, then why? The ordinance mentions in the findings item 8 that the insurance companies incentivized for the use of airbags.

Thi i not entirely true a thi wa mandated by the NTSB Al o car in urance i NOT mandatory to own a vehicle. It is only required if that vehicle is to be used on public roads. And to that end all that is required is to cover your fault accidents. You can also add onto your auto policy cover to cover other peoples damage if their coverage is not enough. So with this if you can find an insurance company to offer any of this coverage are you then going to encourage non gun owner to get thi coverage inca e they are accidently hot? The last question for this is do you not expect California Rifle & Pistol Assn, Gun Owners of California, Second Amendment Foundation and the NRA to file suit against this? They will most likely win this in court and then the City will be paying all the court co t and the money wa ted trying to defend thi Would that money not be better spent on other things the City desperately needs?

I’m not often surprised by legislation that is directed solely at our right to own firearms here in California.

Whether it be a magazine ban, additional waiting period, increase in age to buy a hunting rifle…all comes with the territory for legal gun owners.

Surprise, City of San Jose City Council thinks an additional tax to law abiding citizens is justified to miraculously cure its wows. We’ve been through background checks which include mental health and drug use questions. Seems to me that we are not your problem. Those who haven’t been vetted and have illegal access to a firearm might be where I started looking for crime culpability.

Why not tax all your citizens to cure the problem of illegal firearm usage? Money could/should go to mental health.

Don’t single out a minority group of law abiding citizens to pay for your supposed mess.

Taxes solve every issue. Hell with the payers.

Unfortunately, the City of San Jose fails to see why the increase in violent crime in the city is for reasons that don't have anything to do with the law abiding cizens that will suﬀer because of the new intended policy of eﬀecvely taxing such law abiding cizens The early release of criminals from jails, lowered penales for violent crime, less police presence, and the apparent apathy of government oﬃcials to act against this crime wave, are the real reasons we have such an increase of violent crime. Taxing law abiding cizens under the ruse of a Public Safety Gun Harm Reducon Ordinance, and then using that tax money to pay for legal fees to combat the ensuing law suits that will follow, is crazy Please rescind the ordinance and strike it from your agenda. It would be beer to address the problem, not use it to create more wasted tax policy.

The problem with this type of political initiative is that it only impacts honest citizens. You surely don't believe that someone who has a firearm illegally or who intends to use it in a crime is going to register it with the city. And, even if you catch someone with an unregistered gun what are you going to do:

I oppose the proposed gun tax and insurance requirement. This ordinance will only be applicable to legal and responsible gun owners
The non-profit group set up to manage this ordinance is nothing more than a slush fund. The proposal specifically states the city can not direct how funds are used by the slush fund
The ordinance will do nothing to stop the two overwhelming causes of firearm deaths : suicide and criminal activity. A 2017 PEW research study showed 97% due to suicide and criminal activity
The ordinance is window dressing. It ignores steps the city could take that are known to be effective at stopping gun violence. Confiscate guns in the hands of KNOWN armed prohibited persons Target gang members and drug sellers

The City has done no fact checking of the data it presents from various entities, including virulent anti gun organizations Much of the data is skewed 2 The City has failed to examine/address the millions of dollars expended in San Jose Police Officer shootings law suits, yet exempts peace officers from the ordinance

6. How is the Designated Non-Profit Organization to be determined? I assume any such organization who has contributed to any candidate or political issue would be prohibited.

7. From the Ordinance...Gun Harm Reduction Fee
"No portion of the monies from the Gun Harm Reduction Fee shall be used for litigation, political advocacy, or lobbying activities."
Really?

You follow that subsection with...

B "The City shall not specifically direct how the monies from the Gun Harm Reduction Fee are expended."
How are you going to monitor the expenditure of our taxpayer money? How are you going to establish this "fee"?

8. The City of San Jose has never hosted any firearms safety program. The San Jose Police Department has never hosted any firearms safety program WHY?
It appears the City wants to absolve itself of any liability. 9 Has the City reached out to insurers to see which, if any, would create such an insurance policy for citizens?

10. You have no exemption for licensed firearms dealers or clubs who store firearms
11 I believe the City already has an ordinance requiring firearms to be safely stored.

What effect has that law had on accidental shootings? Any? This is a silly politically motivated ordinance by a city which has never approached firearms safety with any positive educational program.
