Hello City Clerk,
I have the following issues with Agenda Item 22-045 1 4.1 “Gun tax/insurance”, that is open for public comment.

1. The ordinance does not actually specify what are the requirements for a qualifying insurance policy.

2. There is nothing in the ordinance that addresses what happens if such a policy is unavailable to purchase.

3. 180 days is not enough time for people to know about this. The City Council also needs time to figure out how to implement this. Such as setting the fee schedule, and publishing it. 180 days isn’t enough time for the Council to figure out the details AND have the public enough time to find out about it and do something about it.  This is something that the public should have at least a year notice about. 180 days is much too short of a time.

4. It doesn’t put any limits on how the tax would be levied. Making it open for any value to be specified.

5. It doesn’t say anything about people who are unable to comply with the new ordinance. For example, what if someone was in a coma, or in the ICU with COVID?  They were unable to know about or perform any action on this ordinance. What are they supposed to do?

Those are the issues I have specifically with how the ordinance was written.

Furthermore, I do not believe such an effort will have any impact on gun violence. I believe the effort should be placed into suicide prevention, and greater requirements on firearm training for gun owners

Thank You,
-Jotaro Aoi

Similarly, this proposed tax on gun ownership, along with its burdensome mandate

This is a racist ordinance which would if enacted, discourage poor people from gun ownership, harming them by taxing them for the constitutional right to defend themselves. No government should be allowed to impose a discriminatory tax or expense upon those who wish to exercise their fundamental constitutional rights, including the right to keep and bear arms.

Dear Mayor and Councilmembers,

As a doctor I care deeply about reducing firearm deaths and injuries. I practiced primary care medicine at Kaiser Santa Clara for 30 years. Most of my patients were San Jose residents. When I retired a few years ago I decided to dedicate all of my volunteer efforts toward reducing gun violence from a public health perspective. I am now on the Board of Scrubs Addressing the Firearm Epidemic (SAFE), a nonprofit organization of physicians and medical students founded at Stanford. We work to improve medical education and research on all aspects of preventing firearm injury and death.

I believe the Gun Harm Reduction Proposal ordinance is a much needed innovation in the field of gun violence prevention. Requiring firearm owners to have liability insurance has the potential to significantly incentivize safer firearm practices. And using the small annual fees to fund local gun violence prevention programs to reduce firearm deaths is something we should all stand behind. No one wants to lose a loved one to a firearm injury that could have been prevented.

I applaud you in advance for voting yes on the San Jose Gun Harm Reduction Ordinance.

Respectfully,

Su ie MacLean, M D

To Whom it may concern.

This city ordinance the mayor is trying to pass is unfair and unconstitutional.  Why punish us legal and law biden citizens for what your police is unable to complete successfully. It's unconstitutional and not legal. Then every citizen of San Jose should be taxed not just us legal gun owners. Our current police department is incompetent of completing their job.

I ask you to not pass this gun tax, guns in the hands of normal law abiding citizens are safe and quell violence. Criminals will not be affected in any way by this measure.

Please reconsider and do not punish law abiding citizens for crimes committed by criminals that just stand to benefit from this measure..........

To whom it may concern,
Taxing gun owners for exercising a constitutionally guaranteed right will not stand up to critical review. It will be overturned by the SCOTUS.

Shame on you for ignoring the Constitution. Shame on you for wasting your residents money on a scheme bound to fail.

Sirs and Madams,
We have been made aware of the gun tax proposal possibly submitted very soon.  Although we don’t have any firearms, we support the right to bear arms against all foes, foreign and domestic.  This right is God-given.  I suggest you pray on this issue to seek Divine-direction before proceeding.  It occurred to me that you folks have ARMED guards.  Aren’t we given the same right?  I can only assume that if you go against this God-given right, that God will expect the same be practiced by political people inclusively at the local, state, and federal levels.  Shouldn’t laws you make apply to you and not exclude you?  For instance, we know you approved of the vaccine shots for us, but exempted yourselves.  Did you feel that that law applied to us but not you?  Is not your job to protect those God-given rights?  Is there a God- given exemption for you or should all laws apply equally to the entire population.  That’s what you need to think about before you move forward.

Greetings:

I am a long-time resident of San Jose, a retired Federal law enforcement officer that includes service in Iraq and Afghanistan, and a taxpayer. I'm writing to explain my strong opposition to the proposal entitled above. I feel it is a total affront to those of us who lawfully have acquired and retain ownership of firearms for legitimate purposes, i.e., shooting sports, hunting, and personal protection. The imposition of additional costs of liability insurance and a so-called annual fee to own a firearm merely because we reside in a specific geographic location seems arbitrary and specious. The City appears to be faulting law abiding citizens who exercise a right as being responsible for the criminal acts that are increasingly pervasive throughout this City and the surrounding Bay Area. My law enforcement experience has provided me with the knowledge that we have sufficient Federal, State, and local criminal and civil sanctions that can address gun violence, crime related and otherwise. Those remedies need to be applied to those who are committing the firearm related criminal acts. Although I've been an advocate for firearm safety and storage, addressing accidents and harming oneself with a firearm, has to be dealt with on a case by case basis. Again, I think there are statutory remedies to address this that are already in place. They need to be applied and applied aggressively.

I respectfully request that the Mayor and City Council not continue to promote or consider this Ordinance which appears to be nothing more than an opportunity to extract additional funds (taxes) from a segment of the City's citizenry and a misguided attempt at reducing firearm misuse that will most certainly result in costly and lengthy civil litigation.

Respectfully submitted.

Robert A. Gorini, CFE, CA

I respectfully Oppose the City’s So Called “Common Sense” Gun Control Measures.. . It is common knowledge and supported by Nationwide Crime Studies, that the Vast Majority of Crimes, and Often Violence involving a Gun are committed by a Small number of the Population, and are Associated with either Gangs or Career Criminals...

I would Ask WHY THEN DOES THE COUNCIL SEEK TO ADVANCE ORDINANCES THAT HARM LAW ABIDING GUN OWNERS?

CRIMINALS ALREADY IGNORE LAWS, So what makes the COUNCIL Think they will Adhere to these New Ordinances?

..

THESE ORDINANCES ARE VERY LIKELY TO BE DEEMED UNCONSTITUTIONAL, ILLEGAL and DO NOT REPRESENT THE WILL OF THE MAJORITY OF LAW ABIDING CITIZENS...

I would Support Additional Law Enforcement Personnel, Outreach in to All Communities by SJPD, Community Based Neighborhood Councils or Groups that Regularly Meet/Correspond with Law Enforcement..

Hard Working, Tax Paying, Law Abiding Gun Owners ARE NOT THE SOURCE OF GUN VIOLENCE in the CITY, and the COUNCILS Proposed Ordinances will  only further HARM SAFETY and PEACE in the City and Alienate further Citizen’s  from their Leaders....

A gun ownership tax is not only unconstitutional, but divisive and would have no public benefit.  Such measures only serve to hold the unit of government up to ridicule and highlight a radical liberal ideology.

Dear sirs, It sickens me to always hear about new proposals to undermine our Constitution and the 2nd amendment! All of you public officials swore to uphold our rights as free citizens of the United States of America, and you blatantly undermine and scheme to circumvent our freedoms constantly! Your mentality and reasoning is childish and we are tired of being blamed for every tragedy that happens when a shooting is involved. Any normal thinking human being would put the blame on the individual or individuals responsible, and not a whole group of law abiding people. I hope you trash this proposal where it belongs, and start thinking of how fortunate we are to live here!

City Clerk,
Please pass this on and have it placed into the minutes of any meeting regarding taxing gun ownership.

Ladies and Gentlemen,
You will be in for a long, costly, legal challenge that you will be forced to defend using your citizens tax dollars if you pursue a tax on gun ownership. Taxing a Constitutional Right is in fact,  unconstitutional and violates the 2nd Amendment at it’s core. You will have to expend far more tax dollars than you could possibly gain by this tax.  In the name of fiscal responsibility, I urge you to not tax guns or gun ownership.

Hello
Please do not pass this anti American, back door attempt,at destroying this country’s constitutional rights!
Every unethical overreach starts with these seemingly small, seemingly well guided guises. The state of California has already become one of the worst states in America, and people know it,leaving in larger numbers then ever before! The state squeezes hard working people of their hard earned money, calling it bigger and bigger taxes when it’s a lousy excuse for those in Sacramento who recklessly spend and steal without remorse or regard!Gas prices are a crime in themself!Crime is out of control with no end in site while so called “politicians”,build higher walls around themselves and pay for private security, all while taking the safety and security away from the states citizens! And all the while these uncaring, selfish crooks call to “defund the police”,while trying everything above and under the table to take people’s own ability to protect their families away!!
Do not let San Jose continue this wreckless demise, which has already forced born and raised Californians like myself,to move to safer, greener pastures, leaving the filth and degradation behind!!
One day,all this self centered behavior will come full circle on to your own children and grandchildren in a lawless, dirty, third world nation that long ago lost all the principles that once made America the greatest nation on earth!Do not continue the March towards destruction by enacting this tax that is nothing more then California’s further assurance of a lawless, sold out society!
Thank You

Agenda Item 4.1 22-045
The suggestions made under the Gun Harm Reduction Ordinance pretend that the gun violence will become less, which is unlikely.

It does appear that responsible gun owners will be penalized for already doing the right thing with their guns.  These proposal would take guns from responsible gun owners leaving them defenseless to protect their families while the streets of San Jose are still filled with illegal guns moving across the border without any effort to be stopped by the state of California or the federal government. Maybe the illegal immigrants, which are many, should be paying taxes for bringing guns into the United States.

This proposal would seem to be good for social support and media approval, but lacking in respect to many of your citizens and their right to gun ownership, without added infringement on their personal liberties.

This law and anything like it is truly absurd. Simply ridiculous. How about you stop neglecting the facts and tackle the real issues. I can tell you it's not guns. You're trying to impose fees and taxes on people who aren't committing crimes. You think criminals have guns registered in their names. This will only harm law abiding citizens, like all gun laws do. This is why good people don't support politicians in San José. You guys are corrupt and only push your agendas that help the political elites, law enforcement and wealthy. You're breaking the law. Most crime happens in poverty stricken area, but you're exempting the poor? Please stop this foolishness. Do not pass this bill. Matter of fact, do not bring up gun control again. Focus your time in office on mental health and homlessness.

Honorable Mayor and Council Members,
I want to applaud you on the bold move you are taking to mitigate gun violence with your vote to pass the gun harm reduction ordinance on 25 January.  As I write these words it seems incredulous to feel the need to congratulate and encourage a yes vote after the unprecedented gun violence in cities throughout our country.

As a Sunnyvale resident, I felt safer when our community passed Measure C.  In retrospect, this measure set the stage for new gun legislation on the county and state level as I hope your ordinance will do as well.

Thank you for your concern with gun violence and the safety of all members of our community.

Kind regards,
Agnes Veith

Oakland, Stockton, Fresno and San Jose are cities you don’t want to be in at night.  So preventing people to defend themselves and one of the cities is a stupid idea.  And since this law works against the law abiding Citizen and not no criminal, they should not pass

Dear City Clerk,
Where in the world do you get your authority to tax the ownership of a gun? The Second Amendment of the United States Constitution is quite clear, and the U.S. Government and City and State governments do not have the authority to do that.

If you try this, you may end up starting a civil war that is not too civil.

To the City Council,

As a physician in Santa Clara County and Board Member of Doctors for America--an organizaon of thousands of physicians that aims to promote healthy families and communies--I am wring in strong support of San Jose’s Gun Harm Reducon Ordinance. Firearms homicides, suicides, and accidental deaths have all been on a steep rise, cosng our country approximate $280 billion dollars per year; this total translates into over $2000 per household annually. Requiring liability insurance and using a Gun Harm Reducon fee to promote programs for gun owners will serve three important purposes:

1. It will promote safer behaviors, such as firearms storage, reducing accidental deaths and suicides

2. It will provide injury prevenon resources such as firearms educaon, mental health services, and violence prevenon programs, to gun owners

3. It will reduce costs to all cizens—gun owners and non-gun owners alike—by reducing injuries and by ensuring liability insurance covers some of the costs
Just as car insurance supports good drivers without decreasing car ownership, requiring small fees for gun owners will not inhibit legal gun ownership but has the potenal to reduce costs for everyone.

Throughout my career at Stanford, I have cared for countless paents from San Jose. On behalf of them as well as my many colleagues at Santa Clara Valley Hospital and the County Health Department, I strongly endorse this common-sense ordinance.

Councilmember Pam Foley,
I live in your district and am against the proposed Gun Harm Reduction Ordinance. It will do nothing to solve the real problems,
to stop the causes of firearm deaths, and criminal activity. There must be a better way to reduce these problems.

This proposed ordinance seems to punish responsible law-abiding citizens for merely exercising their constitutional rights. It will eventually end up in the court system, costing much wasted money and time for all concerned.

I can never support / vote for anyone who attempts to take away / restrict any of our constitutional based rights.

Respectfully,

Hi,
I am writing in opposition to the Public Safety Gun Harm Reduction Ordinance. This ordinance does nothing to prevent gun violence. In fact, this ordinance will make it harder for members of poorer communities to protect them elve with a firearm by making it more e pen ive for them to legally own and po e a firearm Thi ordinance will only allow criminals to commit more crimes because they know their victims are disarmed by the government. I don't live in San Jose. I live in a neighboring county. I will never be traveling to San Jose or doing business with any business in San Jose if this ordinance passes.

Please REJECT Public Safety Gun Harm Reduction Ordinance; Agenda Item #4.1.

Good morning.

I commented on the proposed gun ordinance last week. It appears that those comments have not made it into the written comments for the meeting.

The fact that the links have been changed and the meeting time changed twice is extremely suspect to the open process that the Mayor speaks about. It is disappointing that I am having to track my comments to make sure my voice is heard.

Below are my comments to submitted last week. Please add this to the meeting document.

I am writing in opposition to the proposed taxes or mandatory insurance on lawful gun owners. Your attack on gun owners to combat the costs of crime are severely misplaced and offensive. You choose to be easy on criminals and come after lawful gun owners instead. This approach is ignorant and misplaced at best and unconstitutional because you are attempting to tax a fundamental right thus disproportionately affecting women, minorities, and the less fortunate segments of the community.

The ordinance is window dressing to make it appear like you are doing something when in fact this does nothing to stop crime and will place you in the position of spending tax payer dollars that will be wasted.

You have already been told in numerous meetings that passing this ordinance will bring a swift response and great legal cost.

Do not bring this on us. Take a stand against the gun control groups who want this for purely policy wins. Handle the crime problems which is what you should be doing anyway and VOTE NO on this bad law.

As a resident and law abiding gun owner in San Jose, I am opposed to the ordinance put forward by the city. I am opposed to the idea that I should be required to pay into a fund to offset city costs related to gun violence incidents when I am not responsible for said violence. Gun owners are being singled out to bear the burden of cost proposed by this ordinance as if implying that we, legal and law abiding owners of firearms, are responsible for the violence in our city.

Rather than adding another obstacle for San Jose residents to e ercise their second amendment rights, the city should be working harder to hold the criminals and gangs accountable for the violence, as these are the true perpetrators of the violence we are seeing. Perhaps the city can consider those convicted of gun related crimes be made to pay fines to offset the costs this ordinance seeks to cover.

Thereby making those causing the problems to be the source of the solution. If this does not work for the city, and a levy is truly required to offset these costs related to gun violence, then that cost should be shared by all residents of the city, as this violence is a threat to all.

I further oppose this ordinance as it calls for costs to be determined after it would be adopted. How can we be asked to support a city ordinance when the true cost and impact are not known at the start?
Yours Respectfully.

Pennsylvania, 319 U.S. 105 (1943) the Supreme Court ruled that “since the privilege in question is guaranteed by the Federal Constitution, and exists independently of state [or municipal] authority, the inquiry as to whether the State [or Municipality] has given something for which it can ask for a return is irrelevant ” Proposed Change 10 32 245 Impoundment
“The Firearm or Firearms of a person that is not in compliance with this Part may be impounded subject to a due process hearing.”
Violation of the proposed changes will most likely result in an infraction.

State law only allows for the impoundment of a firearm for a felony or one of 20 defined violent misdemeanors Infractions do not reach the state threshold requirement to legally confiscate and/or impound property.

Because the ordinance improperly compares the Second Amendment right to the privilege of owning a car for justification of these changes:

California state law does not grant peace officers the authority to impound a vehicle on site for lack of insurance and requires a minimum of six months registration expiration before they can impound a vehicle [CVC 16028(a-c) and CVC22651(o)].

Focus on Real Solutions to Stopping Gun Violence
Our elected officials need to address the criminals who commit violence in our city and the solution to this problem should not be to punish the innocent law abiding residents of San José. Please look at taking the following actions to stop gun violence:

1. Have the city council write and approve an amicus curia resolution to send to the California Assembly and Senate to repeal Propositions 47, 57, and AB109 2 Establish the Gun Harm Reduction Commission (GHRC) pilot program with balanced community representation

3. Enforce and prosecute existing gun laws

4. Support recommendations 1 through 5 of the 9/16/2021 Rules and Open Government Committee memorandum entitled, "Community Violence Prevention & Response" 5 Fund attorneys that will prosecute gun crimes in the county 6 Hire more police officers
7 Build mental health hospitals and fund sobriety programs Yours Sincerely,
Your Constituent

As a resident of Santa Clara county, I am writing to vote my strong support for the passage of Mayor Licardo’s proposal to require gun owners to carry either homeowners, renter’s or gun liability insurance and to pay a $25-$35 dollar annual fee to a non-profit dedicated to promote GUN SAFETY in the community.

With the COVID pandemic, there has been a very large increase in the numbers of guns purchased by ordinary citizens for potential self defense. This increase has also been seen in the numbers of suicides and deaths in the case of domestic violence. The money which will be raised from the $25-$35 annual fee is a very small price for a gun owner to pay to a NON-PROFIT organization whose sole purpose is to reduce the incidence of gun violence in our community. We all want a community where we don’t live in fear of another Gilroy Garlic Festival incident or a VTA shooting.

Please support this measure.

Thank you,
Yvonne Freund
