SUBJECT: SEE BELOW DATE: March 21, 2022

SUBJECT: SECOND AMENDMENT TO THE AGREEMENT WITH YWCA OF

GOLDEN GATE SILICON VALLEY FOR THE IMPROVING CRIMINAL

JUSTICE PROGRAM GRANT AGREEMENT

RECOMMENDATION

Approve the Second Amendment to the grant agreement with the YWCA of Golden Gate Silicon Valley to extend the term of the agreement from March 30, 2022 to September 30, 2022 for the Criminal Justice Program Grant for crisis intervention services and follow up services to victims of domestic violence, sexual assault and sex trafficking and funding victim safety and offender accountability by encouraging community response.

OUTCOME

The approval of the Second Amendment with the YWCA of Golden Gate Silicon Valley would provide continuous crisis intervention services and follow up services to victims of domestic violence, sexual assault, and sex trafficking.

BACKGROUND

On March 22, 2018, the San José Police Department received funding in the amount of $810,272 from the Department of Justice (DOJ), Office of Violence Against Women, to improve responses to crimes related to domestic violence and sexual assaults. The grant award was accepted and approved by City Council on November 27, 2018. The San José Police Department, serving as the lead agency, entered into a grant agreement on January 1, 2019, with YWCA of Golden Gate Silicon Valley (YWCA), as the subaward recipient.

As part of the Grant Agreement, the funding shall be used by the grantee, YWCA, to provide one domestic violence advocate and one sexual assault advocate to provide crisis intervention and follow-up services to victims of sexual assault and sex trafficking. was developed and implemented in collaboration with Community Solutions, a subcontractor to the YWCA. The intersection screening tool is to help advocates and law enforcement identify and connect victims to appropriate support services. The original term of the grant agreement was from January 1, 2019, through September 30, 2021.

ANALYSIS

In August 2021, the San José Police Department requested a 12 month no-cost time extension from DOJ to extend the grant award period from November 1, 2021 through September 30, 2022. The 12-month time extension was primarily due to the multiple state-issued executive orders to slow the spread of COVID-19, which causing interruptions in program activities. The grant extension request was approved by the DOJ on August 23, 2021.

In December 2021, the San José Police Department extended a retroactive grant agreement with the YWCA for six months, from November 1, 2021 through March 30, 2022, in accordance with Municipal Code Section 4.04.055 A. 1.; allowing only for a six-month extension without City Council approval.

Since DOJ, Office of Violence Against Women grant award will end September 30, 2022, the San José Police Department requests City Council’s approval for a Second Amendment to extend the term of the grant agreement to September 30, 2022. This will align the YWCA grant agreement with the approved award end-date by DOJ.

CONCLUSION

The recommendation in this memorandum will approve the execution of the Second Amendment with the YWCA grant agreement to continue providing crisis intervention services and follow up services to victims of domestic violence, sexual assault, and sex trafficking. The grant award provides funding to enhance victim safety and offender accountability by encouraging community response.

EVALUATION AND FOLLOW-UP

Expenditures will be made according to the spending plan and all funding must be expended by September 30, 2022. No additional follow up actions are expected at this time.
