A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
JOSE AUTHORIZING “FREE USE” FOR ACTIVITIES HELD
AT CITY HALL ON SATURDA Y, APRIL 30, 2022 FOR A
THE BLACK APRIL COMMEMORATION EVENT
WHEREAS, in June 2016, the City adopted Schedule of Fees Resolution No. 77829 for the fees and charges for City Hall Facility and Plaza Use; and
WHEREAS, Resolution No. 77829 authorizes City Departments to have “Free Use” of the facilities for those events that 1) qualify as official City business; 2) are free and open to the public; 3) occur on a Sunday through Friday; and 4) are booked thirty (30) days in advance; and
WHEREAS, “Free Use” does not apply to Saturday events, and, therefore, Council approval is necessary; and
WHEREAS, Council District 3 will hold a Black April Commemoration Event on Saturday, April 30, 2022 at the City Hall Rotunda; and
WHEREAS, April 30 is annually known as Black April and is a day to lament and reflect upon the fall of Saigon, which took place on April 30, 1975; and
WHEREAS, the Black April Commemoration Event is co-sponsored with the Vietnamese American Roundtable (VAR) and seeks to encourage an understanding of the Vietnamese American immigrant experience and how it weaves together the past, present and future, and to help educate the community about issues that impact the community at large while working to create meaningful partnerships for civic and community engagement; and

WHEREAS, the City finds that the event qualifies as official City business by providing a location large enough to safely and comfortably accommodate the number of participants expected to attend; and
WHEREAS, the City desires to allow for the free use of the City Hall Rotunda for the Black April Commemoration Event on Saturday, April 30, 2022, to allow members of the general public who may be working or attending school during the week to attend;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:
The City Council hereby authorizes “Free Use” of the City Hall Rotunda for the Black April Commemoration Event on Saturday, April 30, 2022.
