TO: HONORABLE MAYOR AND FROM: Councilmember Carrasco

CITY COUNCIL
SUBJECT: SEE BELOW DATE: April 8, 2022
Approved: Date: 3/11/22
SUBJECT: CHARTER AMENDMENT RECOMMENDATION

RECOMMENDATION
Direct the City Manager and the City Attorney to:

1. Return with language that will amend the Charter to state, “The Council may remove members of the Planning Commission at any time, with or without cause after giving the member an opportunity to be heard before the Council.”

2. Place on the November 2022 ballot that will amend the charter to align the planning commission, with the exception of the Salary Setting Commission, with the city commissions regarding removal of planning commissioners.

BACKGROUND
The Planning Commission has been governed by the Charter, since 1966. The current rules regarding the removal of Commissioners who sit on commissions governed by the City Charter do not give Council the opportunity to uphold our values of equity, justice, and accountability.

With exception of Salary-Setting Commission, this recommendation aligns all commissions to have the same mechanisms and procedures regarding removal of Commissioners.
