COUNCIL AGENDA: 4/26/2022
FILE: 22-554
ITEM: 2.9

TO: HONORABLE MAYOR AND FROM: John Ristow

CITY COUNCIL

SUBJECT: SEE BELOW DATE: April 4, 2022

Approved Date
4/12/2022

SUBJECT: CITY ROADMAP - PAVEMENT, FIRE, EOC, TRANSIT CAPITAL IMPROVEMENTS: PAVEMENT MAINTENANCE PROJECTS FOR 2022
2023 ROAD MAINTENANCE AND REHABILITATION ACCOUNT
FUNDING FROM SENATE BILL 1 - ROAD REPAIR AND
ACCOUNTABILITY ACT OF 2017

RECOMMENDATION

Adopt a resolution approving a list of pavement maintenance projects eligible for the City of San José’s (City) 2022-2023 allocation of the Road Maintenance and Rehabilitation Account (RMRA) funding, which was made available by the approval of Senate Bill 1, otherwise known as the Road Repair and Accountability Act of 2017.

OUTCOME

Approval of the attached list of projects will make an estimated $23,473,532 in RMRA (Senate Bill 1) funds available to the City for pavement maintenance in the summer of 2023. The funding will be used to preventively maintain or resurface selected streets throughout the City, improving their condition and extending their useful life before more costly treatments, repairs or reconstruction is necessary.

BACKGROUND

On April 28, 2017, Governor Brown signed Senate Bill 1, which created the RMRA to address deferred maintenance on the state highway and local streets and roads systems. Senate Bill 1 requires the City to meet specific reporting and accountability requirements established by the California Transportation Commission (CTC). To receive the fiscal year 2022-2023 RMRA funds, the City must submit a City Council-approved list of projects (streets) to the CTC by May

1, 2022. Staff recommends that the City Council approve the attached List of Streets for completion during the 2023 construction season.

In February 2022, the City’s Department of Transportation (DOT) released its three-year Pavement Maintenance Plan (2022-2024) to preserve and rehabilitate streets citywide. DOT coordinated this plan with other City departments, external stakeholders that work on City streets, City Council offices, and the Mayor’s office.

The attached list of streets is consistent with
the three-year Pavement Maintenance Plan, however, it may change if unforeseen circumstances arise or new information regarding other street-related projects becomes available. Per the CTC guidelines, the actual projects completed may differ from the original list submitted.

ANALYSIS

The City is projected to receive approximately $23,473,532 in RMRA funds that will serve as one of the several funding sources that make up the estimated $119.4 million of pavement maintenance funding in fiscal year 2022-2023. This total level of funding will allow for maintenance on both the Major Street Network and the Local and Neighborhood Street Network in 2023. Although DOT may utilize RMRA funds on both street networks, DOT is providing the CTC with a list of streets on the Major Street Network in the interest of efficient and simplified reporting.

DOT utilized information provided by the City’s Pavement Management System to generate a candidate list of streets for pavement maintenance in 2023 using RMRA funds. The candidate list was then thoroughly analyzed by staff using the following criteria to create the list of recommended streets for submission to the CTC:

• Funding availability and funding use restrictions
• Streets not affected by current or future street related projects • Maintenance history and prescribed treatment schedules • Streets associated with planned safety, bikeway, or other complete streets projects • Community and City Council office feedback regarding roadway conditions and priority street segments
• Relative location of street segments to create multiple, continuous segments, consistency within neighborhoods, and project efficiency
• Multi-year geographic spread across the City and street network

RMRA funds are being used to support pavement maintenance activities on the Major Street Network. While equity was not specifically considered in the development of the major streets included in the attached List of Projects, DOT cross-referenced the selected streets relative to census tracts designated by the Metropolitan Transportation Commission as Equity Priority Communities. Based on this analysis, DOT will be maintaining a total of 23 Equity Priority Communities miles which is roughly 30% of the 78 miles selected for maintenance on the Major Streets Network in 2023.

Page 3 ends

The attached proposed list of streets is consistent with DOT’s current three-year Pavement Maintenance Plan but is subject to change due to unforeseen decreases in funding, private development activity, or construction conflicts. DOT will provide a final comprehensive list of streets highlighting 2023 projects and an updated three-year Pavement Maintenance Plan (2023- 2025) in an information memorandum to the City Council in early 2023.

CONCLUSION

Staff recommends that the City Council adopt a resolution approving the attached List of Streets described for fiscal year 2022-2023 RMRA fund eligibility.

EVALUATION AND FOLLOW-UP

As required by the CTC guidelines, DOT will submit the City Council-approved list of projects (streets) identified for RMRA funding to the CTC no later than May 1, 2022. DOT will also submit a Completed and In-Progress Project Expenditure Report for fiscal year 2022-2023 to the CTC no later than October 1, 2023. In this report, DOT will describe each project location, funds expended, completion date, and estimated useful life among other data points. No City Council action is anticipated for this requirement.

DOT provides an ongoing evaluation of the City’s pavement conditions and periodic reports on this topic to the Transportation and Environment Committee and the City Council. As stated previously, DOT will provide City Council an information memorandum in early 2023 that will include a full list of streets to be maintained in 2023 using all available pavement maintenance funds, along with an updated three-year Pavement Maintenance Plan (2023-2025).
