A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
JOSE CONFIRMING THE APPROVAL OF THE ANNUAL
REPORT FOR FISCAL YEAR 202 2-2023 OF THE
DIRECTOR OF FINANCE ON SANITARY SEWER SERVICE
AND USE CHARGES AND STORM SEWER SERVICE
CHARGES, AND CONFIRMING THE APPROVAL OF THE
PLACEMENT OF CHARGES AS SET FORTH THEREIN ON
THE 2022-2023 SANTA CLARA COUNTY SECURED TAX
ROLL
WHEREAS, pur
suant to San José Municipal Code Sections 15.12.550 and 15.16.1410 and the adoption of Resolution No. 80585 the City Council of the City of San José (“City”), the City Clerk set the public hearing on the Annual Report for Fiscal Year 2022- 2023 of the Director of Finance on Sanitary Sewer Service and Use Charges and Storm Sewer Service Charges (“Annual Report”) for August 9, 2022, at 1:30 p.m., or as soon thereafter as the matter may be heard, via teleconference pursuant to the provisions of California Executive Orders 29-20 and 08-21 which suspend certain requirements of the Ralph M. Brown Act and in accordance with City of San José Resolution No.79485; and

HEREAS, pursuant to the San José Municipal Code Section 15.12.550 and the adoption of Resolution No. 80585, the City Council approved an extension of the date the Annual Report, as it pertains to the Sanitary Sewer Service and Use Charges, was to be delivered by the Director of Finance to the City Clerk, and the City Council hereby approves the extension to July 18, 2022, the date when the Annual Report was made available;
WHEREAS, the Annual Report was filed with the City’s Clerk’s Office on July 18, 2022, in accordance with the San José Municipal Code; and
WHEREAS, the notices for the public hearing of August 9, 2022 on the Annual Report were published in accordance with the San José Municipal Code and state law; and

2 WHEREAS, the City desires to confirm the approval of the Annual Report and the placement of the Sanitary Sewer Service and Use Charges and Storm Sewer Service Charges on the 2022-2023 Santa Clara County Secured Property Tax Roll;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:
1. Approval of the 2022-2023 Annual Sanitary Sewer Service and Use Charge and Storm Sewer Service Charge Report of the Director of Finance is hereby confirmed.
2. Approval of the placement of the Sanitary Sewer Service and Use Charges and Storm Sewer Service Charges as forth in the Annual Report on the 2022-2023 Santa Clara County Secured Property Tax Roll is hereby confirmed.
