Honorable Mayor and City Council,
I urge you not to proceed with a ballot ini a ve to extend municipal vo ng rights to non-ci zens. This would be a feel-good ini a ve that would create more problems than it would solve, and s ll not make a meaningful difference in the lives of the target popula on. The same funds could make a bigger impact via other less-controversial ini a ves, for example:
Increase city council staffing in high-need districts to increase resident engagement Lobby at the appropriate levels to streamline the citizenship process Encourage and help our residents to become citizens
Foster formation of new neighborhood associations and community groups Bring back the Strong Neighborhoods Initiative and annual UNSCC Neighborhood Development Training Conferences Implementa on of mul ple voter databases, managing non-ci zen ballots, and cer fying elec on results would incur significant technical challenges, cost and risks. Meanwhile, non-ci zens probably wouldn’t avail themselves to the right to vote in meaningful numbers for fear of being added to a government database of non-ci zens.
Please consider the cost/benefit ra o of this proposal to the other op ons I suggested before deciding on this ma er. Also please consider that the other op ons could be implemented without the need for a divisive ballot measure, which could be counterproduc ve to the longer term goal of inclusiveness and equity.
Thanks so much,
David Noel

One of the rights of citizenship is the right to vote for our government representatives. Allowing immigrants living here illegally to vote in our elections, is a slap in the face of those who complied with existing immigration law to earn citizenship. That process includes learning about our Constitution and our country's history. Citizenship is a hard-earned right for these law-abiding legal immigrants.
When these illegal residents vote in local elections; the next step is to allow them to vote in county and state elections. From there the next logical step is to amend the Constitution to allow them to vote in federal elections.
A cynic might wonder if this is a way to increase membership in one of our two major political parties.
I urge you to vote against this proposal that will allow individuals, entering our country illegally the right to vote.

Elections should be "fair" and "honest" to legal citizens of this city.
Allowing non citizens to vote is a slippery slope one which can breed more corruption, an open invitation for this to happen.
Is that really what you want?
Hundreds of people could be brought in from any country or state and completely change the complexion of what our city wants.
I am shocked that this has even come about.
Please do not subject our citizens to this ill advised plan. I urge you to squelch it immediately. --

Dear Mr Mayor and City Council Members,
I am a resident of San Jose in district three, and I am writing to urge you to not proceed with your planned vote on the matter non-citizens should be allowed to vote in San Jose elections. Or to vote no should the vote go forward. This decision will directly affect the tax paying citizens of San Jose that you have been elected to represent not rule over. Not only would this negatively affect lower class citizens but also citizens of color and people of First Nations descent. As many studies have shown time and again, CAs sanctuary state status has only kept minimum wage earners in competition with non citizens, only to the benefit of big business (of which many of our politicians are beholden to). A vote to proceed or worse a yes vote will only further prove that the people elected to look out for our best interests, are in fact only looking out for their own, to the detriment of the least privileged among us. Finally I ask you how far this will go. Will we allow tourists to vote in our elections? Or anyone who will be able to walk away from any issues they create by participating in a democratic process for an area they do not live in or care about. Or better yet will you allow Republicans from other states to come in and vote in our elections? Thank you for your time.
Respectfully,
Noah

I am deeply troubled by the move to allow non-citizens to vote in our local and state elections. There are responsibilities to being a citizen and informed voter. There should be intent and effort to acquire citizenship; it should not be simply handed out as though it has no value. My family members fought and suffered defending this nation’s citizens from threats. I do not wish this precious right to be diluted by those who are not citizens.
I, and many of my family and friends agree that the privilege to vote should remain with legal citizens.
Thank you for considering my input in this very important decision.

Subject: noncitizen voting
There are great people from other lands coming to our country and why is that? Because the people/citizens believe in the rule of law, the ability to find work, learn about our country’s constitutional principles/ fairness, honesty, integrity, etc. People want to become citizens of this great country and work hard to become citizens and learn about the principles, rights, privileges, and responsibilities of the citizenry. If all people from every nation can vote in elections, does US citizenry have any meaning, anymore? Do our elected leaders care about their own citizens? We are a welcoming people/ city, but is there no limit to that welcome? Let us hold to some standards.. We, the citizens, need to work toward making laws that help them work toward legal citizenship as many others have done.
Noncitizens should not be voting!!

Dear Council members,
Voting is a right, and a privilege, to CITIZEN’S of our great country. If those coming into our country do not have the desire to become citizens like many who have come before them have done, then they should not have the right, or privilege, to pick our leaders, change our laws, or make any other decisions that affect the lives of our citizen’s.
I have not been able to find out who brought this insane idea up for a council vote, but I hope the mayor and other council members will abide by our constitution and laws that require voters be citizens in order to cast a ballot. There are a lot of other pressing issues our city is facing, that need your attention, than giving non-citizens the right to vote….. instead vote to set up a program that encourages them to become citizens! Has the Far Left abandoned all rule of law in a shameless and bald-faced power grab? Your reported upcoming study session regarding giving non-citizens the right to vote gave me an opportunity to review the definitions of “sedition” and “treason.”
My father was a first generation American who fought in WWII. My grandfather worked in Arizona copper mines. I’m part Native American and worked on a cattle ranch.
Lawful immigration and lawful citizen voting? By all means! But, a “study” of non-citizen voting? Are we in an episode of the Twilight Zone?

Dear Mayor, City Council, Chiefs of Staff, and City Clerk:
Beyond this study session, I recommend that this proposal go no further. This is a terrible idea that should not even be under consideration in San Jose. It complicates voting, increases the costs and complexities of an already-overburdened election process, will cost the city thousands of taxpayer dollars to defend against guaranteed lawsuits, creates the opportunity for foreign election interference, and separates the rights of voting from the responsibilities of citizenship.
Voting has long been closely connected with citizenship, not just in the United States, but throughout the world. Non- citizen voting dilutes the value of citizenship and places decision-making in the hands of immigrants who may have illegally entered the USA or who may be uninterested in citizenship, and who have never taken an oath to protect and defend our Constitution - the supreme law of the land. San Francisco's more limited non-citizen voting law has been struck down by a court as violating the State Constitution, and a similar law in Oakland is now under legal challenge. San Jose's radical proposal will surely face even greater legal scrutiny.
Non-citizens that are paying taxes have equal access to City services, but that does not mean that they should be voting in our elections. As one Councilmember rightly observed when this issue was raised in January of this year, “Everyone that pays taxes gets services for those taxes. Those services are available to you regardless of your citizenship status. You can use our parks. You can use our libraries. You can call the Police Department or the Fire Department when you need those protections. And those services are what cost money and why we all pay taxes, whether we vote in those places where we pay taxes or not.” Just like any non-citizen who is in San Jose temporarily - people like contractors working on projects in the City, on long-term work assignments, or on student visas - non-citizens should not be voting in our elections.
I am confident that your constituents are not clamoring for this regime of non-citizen voting being promoted by a small group of radical activists. Let's keep voting tied to citizenship, as it traditionally has been in the US and throughout most of the nations of the world, avoid the monumental complexity and costs involved with allowing non-citizens to vote in San Jose, and avoid the lawsuits that will cost the taxpayers even more money.
Let's continue to reward those immigrants who follow our nation's laws and immigration processes, and who go through the arduous process to become citizens, with the voting rights they have earned. Please do not devalue this right by handing it to just anyone who arrives in San Jose for a mere 30 days.
Best Regards,
Shane Patrick Connolly

Dear honorable members, I am amazed this is being considered, to allow non-citizens to make choices for American Citizens. How does our country run if we let other countries decide for us and do not study to become a citizen. I can not vote in their elections - I do not try to take their lands but I am to let someone who does not know our constitution vote as if they do. Then why not study to be a citizen and take the test. I attended school here and learned every President and capital in the United States. I believe in the United States and giving my freedom to vote to those of other countries leaves me to believe they are not able to decide for American citizens since they do not take the time to become a citizen in the first place. This looks to be a free card to those who have no idea how important our votes are and since they will not spend time to study and learn then why can they vote - so to influence and not issues at hand - this sounds like a political move only and why would they spend time to learn our constitution to become a citizen. It is a prerequisite to the most important tool a citizen has. I am afraid what our country values are if we are willing to give our country away to non citizens.

Dear City Council,
I cannot believe that this governing body called the San Jose City Council is even considering such a horrific idea!
First, it is unconstitutional to allow non-citizens to vote. Voting is both a right and responsibility of being a citizen. Many have fought and died for our rights as citizens.
Has our City Council really got the best interests of its citizens in mind with an initiative like this?
Second, it's an easy way to
corrupt our voting system with illegals voting the way they are "paid to vote" (George Soros and the like would probably fund how they want them to vote).
We already know that we are faced with widespread voting fraud - allowing non-citizens to vote further interferes with free and honest elections.
Please drop this initiative from consideration.

I understand that on Tuesday, August 23 you will be discussing an initiative to allow non-citizens to vote in municipal elections in the City of San Jose. I cannot speak more strongly AGAINST this initiative. Voting is a privilege that is conferred only to CITIZENS of a polity. It is not granted capriciously to everyone who simply resides in an area, or works there, or even owns property there.
By allowing non-citizens to vote, you are debasing the very idea of citizenship, a precious concept that dates back to the ancient Greek city states who originated the concept of democratic representative government on which ours is based.
As scholar Victor Davis Hanson has written, the American citizen is dying, snuffed out by an avalanche of forces that are destroying the fabric of our country. You are severely hastening that decline with this initiative. Withdraw it.

Dear San Jose City Council,
On behalf of myself and my family, I strongly oppose the initiative to allow non-citizens to vote in municipal elections.
The very process of attaining citizenship is designed to help one become a voter on which democracy relies. Voting is both a right and responsibility of being a citizen. Many have fought and died for our rights as citizens. We must not reduce the significance of citizenship by giving away the most fundamental right of citizens, which is voting, to non-citizens.

corrupt our voting system with illegals voting the way they are "paid to vote" (George Soros and the like would probably fund how they want them to vote).
We already know that we are faced with widespread voting fraud - allowing non-citizens to vote further interferes with free and honest elections.
Please drop this initiative from consideration.
Sincerely,
Joanie Murphy

Voting is a right and a privilege given to Citizens of the United States of America.
Don't diminish that right by allowing non-citizens to vote.
This is not something that should be taken lightly.
If you want to vote, become a citizen.
I respectfully request that you do not extend to non-citizens the ability to vote.

Mayor and Council Members,
Please stop wasting resources considering whether to allow noncitizens to vote. Such a move would be a bad idea, unfair to citizens, and make it too easy for people with very little stake in San Jose to vote.
Such a measure would appear to be a violation of the California State Constitution anyway:
CA Constitution art II § 2
SEC. 2.
"A United States citizen 18 years of age and resident in this State may vote." And you are probably aware that a Judge in San Francisco just found such a voting provision a violation of our state Constitution. As the attorney in that case correctly stated:
“The State of California has a long-standing requirement that voters must be United States citizens,” the lawsuit by James V. Lacy; Michael Denny; United States Justice Foundation; and California Public Policy Foundation opens with. “This requirement applies to every election in the state, even those conducted by charter cities, because determining voter qualifications is a matter of statewide concern where state law supersedes conflicting charter city ordinances.
Please don't waste time grandstanding or virtue-signalling on this issue and just kill it immediately.
Thank you,
Tim Zadel

Dear San Jose City Council,
I understand that you are considering whether to allow non-citizens the privilege of voting in local elections.
Allowing non-citizen voting has been struck down by the Supreme Court every time.
I served in the U.S. Army to protect our freedoms and liberties.
If non-citizens want to become citizens, there is a pathway for them to earn citizenship by serving in the U.S. military.
Various Carribean nations charge some sort of investment or equity into their respective countries in order to get a passport and citizenship.
Those who seek to give away the rights of citizenship for free in this country are ignorant of both the worth of our citizenship, and the number of U.S. Army soldiers who have been killed or wounded while making the sacrifice to defend our freedoms and liberties.
Do not give away or sell our rights short because of some desire to be nice to people, while treating our citizens as if they are unimportant and their rights don't matter. You jobs depend on us and our recognition of the quality of the job that you do or don't do.
In the federal code there is a section for the Honest Services of a Public Servant Doctrine. Giving the purported right to vote to non-citizens is dishonest and unconstitutional. Make the right decision and don't squander our rights paid for with U.S Army soldiers blood and sacrifice.
Best regards,
HI&RH Prince William-Bullock III: Stewart

Sirs & Madams; I’m writing to proclaim very strongly that your decision to allow non-citizens to vote is unacceptable.
Our country, from it’s inception, has relied in upholding fair and legal voting practices so what gives you the right to deviate from representing those who are citizens over those who are not?! I’m not sure what thinking goes into making these kinds of decisions but one thing is for sure ... it’s not a decision made by individuals who are grateful for the country they live in.
You are doing an injustice to the people you should be representing. I will not be surprised if someday one of these same non-citizens comes up to you and says, “I’m taking over your position, you can step aside now.” It may be that no one will need to vote them in because they will do to you what you are doing to the residents of San Jose.
Since you don’t seem to care about protocols, or laws, or the dignity of your elected position; maybe you should step down now. Ladies and gentlemen, if you keep disregarding your duties, sooner or later you may find you’ve bitten off more than you can chew.
Please reconsider what you are about to do before it ruins the quality of life for those in San Jose and surrounding cities.
Hoping for a wise decision on the matter .... vote No!! Vic

Hello members of City Council,
I learned this evening, August 22, 2022 that "The San Jose City Council will hold a study session tomorrow 8/23/22 at 6:00pm to explore whether to move forward with a November ballot initiative to amend the San Jose City Charter to allow all residents of San Jose (including non-citizens) to vote in local elections." I am very much opposed to such move for several reasons:
1. Only citizens should be allowed to vote in municipal and government matters.
2. Allowing non-citizens, or people who are here temporarily, or who are here illegally, or who cross borders to vote sets a bad precedent.
3. Non-citizens, or people who are here temporarily, or who are here illegally, or who cross borders to vote may exert undue influence on the election results that may not be in the best interest of the city, local government, or school districts.
4. Only registered voters who are 100% committed to this nation's well being and best interest should be allowed to vote.
5. It is illegal for non-citizens to vote and having a law or policy that opposes this law is bound to fail in the court of law and incur a tremendous amount of legal fees that the city will have to pay. That money can be better spent on worthwhile causes
6. Allowing non-citizens, legal residents, and illegal residents to vote on municipal and local government matters can be viewed as an affront by the citizens who took the trouble to naturalize.
7. Incarcerated citizens lose the right to vote, in the same way, outsiders should not have the right to vote until they earn it.
There are likely many more reasons why we should not allow non-citizens to vote, but with the limited time and intellectual abilities, these are the seven reasons I have come up with. I hope you consider this and stay on the righteous path. Please do not get influenced by special interest groups who may use the newly acquired voting rights to self- aggrandize and obtain favors for themselves.
We have generous benefits for non-citizens, residents, and everyone who is here, legally or otherwise. Schools, libraries, healthcare systems, employment, and business opportunities are open to them. Voting must not be one of them. I was a non-citizen once; and in my wildest dreams I would not have thought of voting in local elections.
Thank you very much.
Sincerely,
Nandini Y. Garud

I strongly oppose the initiative before the city council to allow any non-citizen, legal or illegal, to vote in our municipal elections.
· The United States belongs only to its citizens. Therefore only US citizens are allowed to vote at all levels of government. Allowing anyone to vote is a serious threat to the sovereignty of our great country. · It is unconstitutional to allow non-citizens to vote. · If this initiative is approved by the city council then there will be expensive legal challenges to this illegal initiative. The result will be wasting taxpayers' money and ultimately having this illegal initiative struck down.
· The San Jose Mercury News just published an article about both San Francisco and Oakland being sued over their similar proposals.
Vote NO on this illegal initiative. Honor the rights of the citizens of San Jose.

Dear Council Members and Staff:
Having noncitizens voting is the most egregious violation of the rights of U.S. Citizens. I immigrated here many years ago and knew nothing about local or national issues. It took me many years of citizenship to understand and vote intelligently. I question the motive of those who push noncitizen voting rights and illegal immigration. Many Americans already question the integrity of our voting system with the chain of custody of ballots taken away by the Voters Choice Act. Why are you perpetuating this nonsense? This is true voter suppression: when you have noncitizens who know nothing about our country voting, you discourage those who understand our country from voting, as they believe their votes won't count.
Please do not entertain this concept and maintain the rights of U.S. Citizens.
Respectfully,
Anna Kramer

I respectfully ask that all receiving this message reject the initiative that would allow both legal citizens and illegal non- citizens to vote. I concur with those council members who declare that citizenship means something! Please do not degrade and dishonor this precious freedom! This is dangerous! Voting is both a right and a critical responsibility of being a citizen…not a frivolous irresponsible entitlement! Citizenship requires work! It means nothing, as any freedom that is abused, if freedom is not earned…and an informed citizen and responsible voter is one who has earned the privilege by becoming an informed citizen! We must honor a system of freedom that has been built on a foundation requiring great suffering in battle by those who fought valiantly to attain it. Please valiantly and respectfully honor that reality!

Dear All:
Just want to send my voice to you that allow non-citizens to vote in municipal elections is totally not acceptable. This will ruin the voting system. I love San Jose and this country so i applied for my US citizenship 30 years ago. I know that a lot of people who also lived in this country for decades but they are still green card holders. If they don’t want to be the US citizens, they shouldn’t be given the opportunity to vote because this is not their country. Why we should let them to make decisions for us? Would you let anyone to decide where you send your kids to schools, when is the dinner time for your family, what outfits you should buy for your family….? Of course not. Why, because they are not part of your family.
Thank you!

I object to non-citizens being given the ability to vote. Voting is a right and responsibility of citizenship and must NOT be diluted with the votes of those who are non-citizens, some of whom are in this country in order to destroy it (particularly relevant as we come to the anniversary of September 11).
If non-citizen voting is to be considered, it needs to be placed on the ballot for the CITIZENS to decide: This decision should NOT be made by the City Council, a infinitesimally small fraction of the population of San Jose! Regards,
Cynthia Freedman

To all,
I am a first generation of immigrants and resident of San Jose for over 20 years. I am glad the US is welcoming immigrants. However, becoming a citizen is not only a monumental event in one's life, but huge responsibilities as well. Allowing non-citizen to vote would cheapen this event. I hope all of you will oppose this motion.
There are many consequences in association with this decision. First, it will encourage illegal immigration. City government is already burdened with services provided to this group. There is no reason to encourage it.
Second, allowing voting would encourage voting fraud. Imagining a large group of "guests" to visit San Jose, and making decisions for us on various local issues. This is not what residents of San Jose want.
The right thing to do is to build consensus on a complete solution on immigration.
--

Jason Xu

Dear public servants:
Allowing non-citizens to vote is a terrible idea, for the following reasons:
It will dilute the rights of San Jose citizens to exercise their voice and impact their community.
Non-citizens could come from anywhere and have any agenda for America and our local community. Indeed, the flood of illegal immigration across our southern border includes individuals from at least 100 countries. Non-citizen voters could even come from China, a nation well-known for its immoral policies and plans to undermine American democracy. What plans are in place to educate these voters about American history and government, about what makes this great country work? I haven't heard of any.
Citizenship is the foundation of our republic. It should be earned. It should be doled out without discretion.
Thank you for considering my input. I know I'm not the only one horrified by this initiative.
Sincerely,
Columba Booth
