Transportation and Environment
Committee Direction
Expedite the acquisition and deployment of a towing service software solution by utilizing one of these options:
1) The ability to rapidly purchase the desired software through existing cooperative agreements with other cities;
2) A contract amendment with existing vendors; or
3) Other method such as sole source
If none of the above options is feasible, the City Manager is directed to:
• Expedite this procurement within the City process to ensure the desired software can be rapidly acquired and deployed; and
• Return to the August T&E meeting with a verbal update on the status of the acquisition of the software and where it falls into the prioritization www.sanjoseca.gov/CodeEnforcement 3

Option 1: Using Cooperative Agreements
Staff Determination: Not Feasible
• RFP seeks options for the tow software providers to directly contract and provide towing services on behalf of the City potentially revamping the city’s existing tow delivery model.
• Given the City’s localized requirements for tow service delivery, a cooperative agreement would not be an appropriate procurement vehicle to utilize nor is one likely to exist.
• Cooperative agreements are normally reserved for commodity-type equipment and services where lack of diversity in vendors or distributors exists.

Option 2: Contract Amendment with
Existing Vendors
Staff Determination: Not Feasible
The City does not have an existing contract with tow software providers that can be amended to include the tow services requirements. • The existing contracts, awarded in 2016, do not include the expanded services/new tow model.
• Amending contracts with one or all existing tow providers for this purpose would not meet the City’s intent to contract with a new software provider to potentially establish a new tow model and administer City-Generated towing services 5 www.sanjoseca.gov/CodeEnforcement
Option 3: Other Method such as Sole Source
Staff Determination: Not Feasible
• The Request for Information that the City conducted in 2019 for tow software providers yielded responses from multiple
companies.
• It would be unfair practice for the City to sole source with one company when there are multiple potential providers in the market
• It does not meet the criteria under Municipal Code 4.12.230 to qualify for a sole source agreement.
