Subject: Mobilehome Park land use designaon

Item 8.3 on agenda
I totally support that ALL mobilehome parks in San Jose receive the Mobilehome Park General Plan Land Use Designaon as soon as possible. The long delay in achieving this designaon has created much anxiety with mobilehome residents. Mobilehome parks are the
last bason for affordable housing in San Jose and many of the residents cannot locate elsewhere.

Regarding Land Use Designation for Mobile Home Parks in San Jose <

SUBJECT: MOBILEHOME PARK LAND USE DESIGNATION STATUS REPORT RECOMMENDATION Consistent with prior Council Direction, direct staff to return to Council with a plan to begin necessary environmental reviews and work to amend the General Plan land use designation of the 13 parks found in its analysis to have surrounding prevailing densities that would support potential redevelopment.

BACKGROUND On March 10, 2020, the City Council approved General Plan land use amendments to a new "Mobilehome Park" designation for two of the most vulnerable Mobilehome parks, Mountain Springs and Westwinds. Recognizing the need to apply this additional layer of protection from redevelopment for all of our City's 58 mobilehome parks, as part of that unanimous approval, Council directed staff to "begin necessary environmental reviews and work to amend the Envision 2040 General Plan to apply the "Mobile Home Park" land use designation to the remaining 56 mobilehome parks in the City. Staff should bring these resolutions back no later than March 2021." Two and a half years later, the more than thirty thousand residents of the remaining 56 mobilehome parks are still waiting to see this protection applied to their parks. While the pandemic has understandably delayed this work, it has also exacerbated the challenges and anxieties faced by many of our mobilehome residents, who are more likely to be low or fixed income, seniors, and medically vulnerable. The obvious need to protect and preserve one of the last de facto forms of affordable housing in our city has never been greater. Now that staff has provided us with a clearer analysis of which parks are most at risk of future redevelopment, we need to move forward with this work, prioritizing not just five parks, but all of the parks that meet the prevailing density criteria as assessed in staff's memorandum. That is why I ask staff to return to Council with a plan, including additional resources needed, to ensure that these 13 parks, less than a quarter of the 58 total mobilehome parks in our city, receive the Mobilehome Park General Plan Land Use Designation as soon as possible. Our residents have waited long enough.

Subject: 8.3

On 10-13-22, Mobilehome Park residents who attended the meeting of the HCDC (Housing and Community Development Commission) read this in the agenda packet:
“Mobilehome Park General Plan designation for remaining 56 mobilehome parks - Apply the Mobilehome Park Land Use Designation through City-initiated General Plan Amendments to the remaining 56 mobilehome parks, and rezone the sites, to promote preservation, public input, and transparency on any future mobilehome park conversion proposals.”
This was one of the presented strategies for the preservation of affordable housing in the San Jose draft 2023-2031 Housing Element Study Session.

Year after year after year such a strategy has been proposed, discussed, and debated, but still after year after year after year, Mobilehome Park residents are waiting for the implementation of this reasonable and prudent strategy to add another layer of protection against the closure of MH Parks.

We have made hundreds of telephone calls, sent hundreds and hundreds of emails, sat in Council Chambers or hung on the telephone for hours in order to have two minutes to speak and plead for this MHP land use designation.

We are tired.

It did not have to be this way.

End this years old delay. Support the Maya Esparza memo. Allocate the necessary funding.

Let MHP residents sleep better at night instead of continuing to deal with this stress, uncertainty and exhausting need to continue to organize for this goal.

This message is in regards to 8.3 Council meeting _10-18-22. We all know affordable housing is low in the Bay Area so this is why protecting these mobile home parks is very important. I have lived in my north San Jose mobile home for 40+ years and raised both of my children here. Now as a retired senior this is still a place I can afford to live in this area. Please protect all mobile home communities . Thank you.

To: HONORABLE MAYOR AND CITY COUNCIL,
Seven years has past since the initial discussions on the Mobile Home Land Usage designation began in 2015. During that time, multiple studies have been completed,  permits issued and construction is underway at multiple residential and retail/residential locations in San Jose, granted not all mobile home communities. Along the Bascom Ave corridor several retail/residential structures have been completed with others in process. How can it take so long to change the land use designation of existing mobile home communities where no feasibility or construction is required.

Please end this emotionally charged roller coaster ride for the residents of the  twelve (12), vulnerable mobile home communities in San Jose by issuing the Mobile Home Land Use designation to those communities.

Thank you,
Joan MacKay

I am a resident of Quail Hollow Modular Home Park retired and living on fixed income I have been aware for years that mobile home parks are scarce low-income housing I have also been aware for years that although mobile parks are recognized there is no protection  in the San Jose General plan.

It seems inconsistent to build low cost homes on Bascom Avenue and not protect and leave vulnerable existing low cost housing out of the general plan Please complete the General Plan Land Use designation work for the remaining 56 parks in the city Sincerely

Please vote to have ALL San Jose mobilehome parks designated with the MHP designator.

Do the correct thing by designang all MH Parks as MHPs. Because we ARE Mobilehome Parks!

Why discriminate against the 51 remaining parks?

Mobilehome parks are the last avenue for low income housing whereby we own our home!

As a senior cizen, the independence of my single family mobilehome is a treasure. No noisy neighbors upstairs, downstairs or beside me sharing a common wall.

Do not jeopardize mobilehome park residents by not designang our parks as MHP . Do not allow greedy developers to take my neighborhood and home away from us!

I’m on a fixed income and cannot afford to move nor buy a million-dollar home. I’ve worked for 50 years so I can have a comfortable life. Please allow me to live out my life in my beauful home with my wonderful neighbors.

Think about the over 30,000 MHP residents in this City who are hard-working families and rered individuals that live within their means. We may have a small home, but it is OUR HOME!

God Bless our Mobilehome Parks!

Dear San Jose City Council Members,
I encourage you to give all San Jose Mobilehome Parks the "Mobilehome Park General Plan Land Use Designation". These are natural "affordable living" areas of which San Jose is in great need of. The MillPond community is a shiny example of an older adult community where neighbors know and take of each other.

Please come visit our community. We would love to show you around! Thank you,
Manuela Kolpin

To Major Liccardo and Council
My name is Hanh Nguyen, a GSMOL chapter vice-president and representative for Vietnamese Mobile Home Park residents who are not only living in a low-income area but also dealing with daily hardship due to limited of English speaking.

In the past over seven years since 2015, we are living in an anxious and unstable home environment on the top of having daily hardship. It became a burden and stressful living condition since we do not know what will happen to us if we are no longer having a place to live.

On March 10, 2020, we were so please that Major and Council promised to support Mobile Home Park residents. As of today, 10-15-2022, I am sending this letter to Major and Council again with the hope continuing receive your positive support by keeping your promise on this matter.

Thank you so much for your time and consideration.

Sincerely,
Hanh Nguyen

Council Meeting - October 18, 2022 - Agenda Item Number 8.3 Nancy Stevens <

To:City Clerk <[email protected]>

You don't often get email from Learn why this is important

Attn: San Jose City Council Members,
My name is Nancy Stevens and I live in Millpond II
TWO THINGS I WANT TO ADDRESS TO THE COUNCIL:
#1 I urge you to approve changing the Mobile Home Land Use Designation not only for the mobile home parks identified as being most "at risk" but for ALL the mobile home parks in San Jose. Please approve and make a plan to expedite this process in a timely manner.

This has gone on long enough! Note: See copy of message I shared at the 9/26/22 CED Committee meeting below for details. #2 I urge you to recognize Millpond I & Millpond II as one mobile home park. They have the same owner, shared amenities, same park management, etc. Note: See copy of email sent to Michael Brilliot, Deputy Director, Planning, Building, and Code Enforcement below dated 9/27/22.

Here is the message I shared at the CED Committee meeting on 9/26/22 regarding Mobile Home Land Use Designation:

My name is Nancy Stevens and I live in Millpond II
I want to make some comments related to Christopher Burton's 9/16/22 letter to the CED Committee, specifically the second section called Background.

I fail to understand why, when the city began its efforts back in 2015 to take action to preserve mobile home parks in response to the effort to close and convert Winchester Ranch Mobile Home Park, why General Plan Land Use Amendments protecting ALL mobile home parks were not put in place at that time regardless of the size of the mobile home park?! Instead, analysis continues year after year after year (2015, 2017, 2018, 2019, 2022). Every time this topic comes up for discussion the anxiety, anxiousness and fear levels of the families and seniors living in these mobile home parks rises. We are fearful of losing our homes and some or all of our hard-earned money spent to purchase them. Many would be at risk of becoming homeless and/or having to move out of the area away from extended family, friends, medical care and so on. I am sick and tired of this way of living! Most of the people I know in my community are thrilled to live here but many are on a fixed income. If I must move, apparently Bakersfield is the most affordable city in the state of California to live. If that did not prove to be financially feasible, Mississippi would be the cheapest state in these United States to live. Neither of these options appeals to me and why should I beforced to move 100's or 1000's of miles away to survive? Economic times are hard enough without this added worry.

Let us not wait until staff "is aware" of any intent to convert a mobile home park in the city because that could be too little too late. I support the Mobile Home Park Land Use Designation for the five parks deemed "at risk" and ALL the other mobile home parks in San Jose!!!! Also, here is a follow-up email I sent to the Michael Brilliot, Deputy Director, Planning, Building, and Code Enforcement as well as all members of the CED Committee on 9/27/22 regarding Mobile Home Land Use Designation:

Hello, my name is Nancy Stevens. I live in Millpond II.

Yesterday, I attended the Community & Economic Development Committee (CED) meeting via Zoom. First, I want to say thank you for the status report yesterday, I didn't have an opportunity to express that sentiment at the meeting as my message was timed and I just made it under the wire with what I you. So, thank you to everyone for all your hard work. I also want to say how encouraging it was for me to hear everyone at the meeting support and s hardship on mobile home owners that has taken place over the past 7 years.

Unfortunately, it was not until after all the public speaking was completed and the CED Committee and presenter from Planning Building, and Code Enfo discussions that a BIG red flag sprung up for me.

Fact: Mill Pond I is on the 5 "most at risk" list.

Question 1: As it relates to this status report, does the Planning, Building, and Code Enforcement Department consider Mill Pond 2 to be a separa Question 2: If they are considered two different parks, I'd like to understand why? Is it because of differing ownership (Mill Pond I is on a leased is owned by a different owner than Millpond I)?
Question 3: If they are considered one park for these purposes, why is only Mill Pond I identified as one of the 5 "most at risk". It should say Mill P Here are some things I want to point out:

Mill Pond I & II are both managed by the same company (Landlord)

Mill Pond I & II receive/sign the same paperwork upon tenancy application/approval. There is no distinction between Mill Pond I & Mill Pond II. It a Community Mill Pond and includes your space #, period.

Mill Pond I has 310 homes / Mill Pond II has 52 homes
Mill Pond I & II are in the same general area; however, we are separated by a Hwy 87 overpass and a street named Canoas Garden Mill Pond I & II share the same Site Manager & staff (physically located on Mill Pond I property) Mill Pond I & II share all the same amenities the park offers (also physically located on Mill Pond I property) Mill Pond I & II share the same 5 Star Rating based on the amenities offered The only notable difference between Mill Pond I & II (beside property owners) is Mill Pond II's electric, gas and street light systems are owned and o owns and maintains the pedestals through which the electric and gas systems are connected to each home site.

Both Mill Pond I & II are managed by the same Mill Pond rules Both Mill Pond I & II are provided with the same Mill Pond Emergency Preparedness & Evacuation Plan Both Mill Pond I & II follow the same residency guidelines All that being said, if you are regarding Mill Pond I and Mill Pond II as two different parks, this has the potential of very detrimental effects to the residents scenario, Mill Pond I's property owner decided to se]] or redevelop the property and it becomes a condo village or whatever, Mill Pond II no longer has on no longer has any amenities (loss of 5 Star Rating) and quite frankly would end up being the MOST at risk location of any mobile home park in San Jose surrounded by high density housing with more to come (planned Curtner VTA Station development plans as well as rumored redeveloping of the Scottish was re-developed, I fail to see why Mill Pond II's owner would not jump at the chance to sell.

I propose that Mill Pond I & Mill Pond II should be recognized as one mobile home park or, if that cannot be done due to two property owners or whateve most definitely be included on the 5 "most at risk" parks on your list. If you do recognize them as one combined park, then the status report should reflec for clarification.

I thank you for your time to read by concerns. I hope that this information will be considered as we move toward the October 18th City Council Meeting. everything so, if I have misunderstood or misrepresented something,I would appreciate your advising me. I would like to hear from you regardless so th to speak before the council.

Regards,
Nancy Stevens, A Concerned Home Owner - Mill Pond II

Dear Sirs:

As mobile home residents for over 50 years in the California-Hawaiian Mobile Park and members of a 7 year lawsuit against the owners of our Park (Equity LifeStyle Properties) for failing to maintain the park,
we agree to the following items to be addressed by the Council:

Please return to Council with a detailed multi-year plan and timeline to complete the General Plan Land Use designation work for the remaining 56 mobilehome parks in the City, including returning through the Mid-Year Budget Review with resources needed to complete land use designations this fiscal year for the 12 most at risk parks identified in the Staff Report, and returning through the Budget Process with resources needed to redesignate all of the remaining parks in the City, and a detailed plan and timeline for doing so.

Streamline the public outreach process for the land use designation work, recognizing that this is work that our mobile home residents have both been aware of and actively fighting for since 2015.

Please include Millpond 2 along with the other 12 parks assessed by staff to be highest risk to be redesignated this fiscal year through the Mid-Year Budget Review process.

Thus making the complete list of parks to be redesignated this year: Oak Crest, Lamplighter, Quail Hollow, Chateau La Salle, Mill Pond 1 and 2, Caribees, Hometown, San Jose Mobile Home and RV Park, San Jose Trailer Park, La Buona Vita, Sunshadow, and Silver Creek Mobile Estates.

Please align the relevant portions of the Housing Element with the plan and timeline for this work to ensure consistency.

Thank you for your consideration.

Robert and Nancy Buckles

My family and I have lived in Magic Sand Mobile home park since 1996. My husband and I have raised 3 children here, 2 of which are still at home due to unaffordable rent in our city.

We have enough space to be comfortable and have wonderful neighbors who make up our safe enjoyable and affordable community that we call home.

Please take the stress and uncertainty off us all regarding this issue. We would never be able to afford apartment or condo rent if our land was to be sold and we are told we have to move.

We are good valuable residents and we need to know that our homes are safe so we can truly live in peace and comfort.

Regards,
The Patrick family

Dear Mayor Liccardo and Council,

I, Delia Aguirre support the Mobile Home Designation for all Mobile Home parks here in San Jose. I have lived in my mobile home for 33 years (The same day as the Loma Prieta Earthquake, on Oct. 17, 1989).

This is my home. I want to stay here until the end of my life.

Please support the Mobile Home designation for all parks.

Thank you,
Delia Aguirre

You don't often get email from . Learn why this is important

To Honorable Mayor and City Council
Russ and Beth Paige are writing in support of all Mobilehome Parks in San Jose receiving the Mobilehome Park land use designation.  We have lived in San Jose our entire lives including working and raising children.  We currently live in Quail Hollow Mobilehome park and really love it here.  It is a warm, friendly and supportive community of seniors.  We have watched San Jose grow and mobilehome parks are the last affordable housing for seniors and other low income individuals in the area.

Please take the necessary steps to assure all San Jose mobilehome parks receive this designation.

Russ and Beth Paige
