AND CITY COUNCIL

Approved Date

SUBJECT: LATERAL POLICE OFFICER HIRING INCENTIVE PILOT PROGRAM
RECOMMENDATION
Adopt a resolution to approve the Lateral Police Officer Hiring Incentive Pilot Program for lateral Police Officers (2215), effective October 30, 2022, through the term of the successor Memorandum of Agreement between the City and the San José Police Officers’ Association, subject to the annual appropriation of funds.
OUTCOME
Adoption of the resolution will approve a Lateral Police Officer Hiring Incentive Pilot Program for lateral Police Officers (2215), effective October 30, 2022, through the term of the successor Memorandum of Agreement between the City and San José Police Officers’ Association for a total non-pensionable payment amount of $10,000 for each eligible lateral police officer that successfully completes the requirements of the program, subject to annual appropriations.
BACKGROUND
As part of the Fiscal Year 2022-2023, Adopted Budget authorization was provided to the City Manager to allocate funds from the Police Officer Hire Ahead Program to pilot an incentive for lateral police officers to join the San José Police Department and further the City’s efforts in increasing sworn police officer staffing levels.
On September 22, 2022, the City and San José Police Officers’ Association reached a Side Letter Agreement for the implementation of a Lateral Police Officer Hiring Incentive Pilot Program.
Lateral police officers hired into the Police Officer classification (2215) on or after the implementation of the Lateral Police Officer Hiring Incentive Pilot Program will be eligible for a total non-pensionable amount of $10,000, spaced throughout their one-year probationary period.

HONORABLE MAYOR AND CITY COUNCIL

Subject: Lateral Police Officer Hiring Incentive Pilot Program
ANALYSIS
Adoption of the Administration’s recommendation would result in the implementation of a Lateral Police Officer Hiring Incentive Pilot Program (Attachment A). Lateral police officers hired on or after the implementation of the Lateral Police Officer Hiring Incentive Pilot Program will be eligible for the following non-pensionable lump sum payments as specified in the table below:
The payment of any portion of the non-pensionable hiring incentive amount of $10,000 is contingent on the employee being continuously employed in the Police Officer classification through their one year anniversary of passing probation.
If an employee receives any portion or all of the non-pensionable lump sum hiring incentive, and separates from City employment or accepts another position within the City that is not within the Police Officer class series prior to their one year anniversary of passing probation in the Police Officer series, the employee forfeits the non-pensionable lump sum hiring incentive amounts that were received and, to the extent permitted by law, will be required to reimburse the City for all hiring incentive amounts received. The employee may sign an agreement to deduct the total hiring incentive amount from his or her final paycheck of wages, subject to applicable laws. In the absence of such an agreement, the City shall deduct the hiring incentive amount from the employee’s leave payouts. If the employee’s leave payout amounts are not adequate to cover the entire amount of the hiring incentive, the City shall pursue the reimbursement of the hiring incentive through any other lawful means, including the collection process.
CONCLUSION
It is recommended that City Council adopt the Administration’s recommendation outlined in this memorandum which would result in the implementation of a Lateral Police Officer Hiring Incentive Pilot Program for a total non-pensionable amount of $10,000 for each eligible lateral police officer spaced throughout the officer’s probationary period, effective October 30, 2022, through the term of the successor Memorandum of Agreement between the City and San José Police Officers’ Association, subject to the annual appropriation of funds.
