SUBJECT: SECOND AMENDMENT TO THE AGREEMENT WITH CAL ENGINEERING AND GEOLOGY, INC. FOR CONSULTANT AND PROFESSIONAL ENGINEERING SERVICES FOR - FEMA KELLEY PARK STORM OUTFALL (SCSJC88/PW1137)
AND FEMA ALUM ROCK PARK MINERAL SPRING BRIDGE EMBANKMENT (SCSJG01/PW745) PROJECTS
RECOMMENDATION:
Approve the Second Amendment to the Standard Agreement with Cal Engineering and Geology, Inc. to extend the term from October 31, 2022 to October 31, 2024, and increase the maximum compensation from $659,312 to $754,540 for the sole purpose of completing the FEMA Kelley Park Storm Outfall (SCSJC88/PW1137) and FEMA Alum Rock Park Mineral Spring Embankment (SCSJG01/PW745) projects.
BASIS FOR RECOMMENDATION:
Heavy rains from the storm events in February 2017 caused significant damage to the Kelley Park Storm Outfall and Alum Rock Park Mineral Spring Embankment, resulting in the outfall and embankment to collapse into the creek below. The Kelley Park Storm Outfall is located in Kelley Park and Alum Rock Park Mineral Springs Embankment is located in Alum Rock Park, both in San José. On October 23, 2018, the City Council approved a consultant agreement with Cal Engineering and Geology, Inc. for 8827-FEMA- Kelley Park Storm Outfall Repair (SCSJC88/PW1137) and Alum Rock Park Mineral Springs Bridge Embankment (SCSJG01/PW745) in the amount of $659,312.
These projects have both been delayed as a result of procedural coordination efforts with other agencies. This includes securing an obligation letter from FEMA, permitting from various State agencies, and obtaining National Environmental Policy Act (NEPA) clearance. The projects continue to move toward completion.
The City is currently working with the California Governor’s Office of Emergency Services and FEMA on obtaining a final obligation amount (agreed upon project cost) for the original scope of work. In addition, another rain event in April 2020 caused the Kelley Park Outfall to deteriorate and require a redesign. To ensure the completion of the projects in a timely manner, it is imperative that Cal Engineering and Geology, Inc. remain on the projects to provide support during the bid, award, and construction phases of the projects, expected to finish in fall 2024.
The requested 24-month term extension to this Agreement and increase in compensation in the amount of $95,228.00 would allow sufficient time and resources to complete the remaining NEPA and Environmental and Historic Preservation coordination with FEMA, adjust and finish final design plans and specifications, provide bidding and construction support, and FEMA review for reimbursement processes.
