Subject: Fill Vacancies in Council Districts 8 & 10 by Elecon Process
I am extremely concerned to hear that the council is considering appoinng new councilmembers rather than supporng the community's right to vote and elect their representaves. There should be an elecon held to fill these roles.
At a me when the democrac processes and vong rights are under siege, consider the message that it sends. It does not help to have the council downplay this right by considering appointment of new councilmembers to fill the remainder of the terms rather than holding a special elecon.

Honorable Mayor and Councilmembers,
I am a San Jose resident that lives in District 10.
Regarding the council vacancy in CD's 8 and 10, I support a special election, rather than an appointment by Council. As far back as 1995, special elections have been held at least six times to fill vacancies on City Council that were eventually filled by former councilmembers Pat Dando, Nora Campos, Madison Nguyen, Kansen Chu, Pierluigi Olivario, and Manh Nguyen.
A special election is the only fair and democratic approach that upholds the right of the people to elect their representatives, and is the only option that must be considered to fill a vacancy.
Thank you.

To all Councilmembers who no longer believe in elecons:
Power truly does corrupt. How in the world did you decide to deny elecons to two Council districts and then recommend that only 6 Councilmembers choose who to appoint to those Council seats? You are truly at least as corrupt as the Los Angeles City Council. Worse yet, you blatantly throw this in the face of the residents of San Jose.
We have a City Council with no Asian representaon and you decide to appoint someone to District 8 which has over 60% Asian populaon. And, yes, of course, we know you will appoint an Asian person just to say you support racial equity. That is NOT racial equity. Racial equity would be leng the people vote for their representaves.
The San Jose City Council members who support this are an embarrassment to our city. This is what you will be remembered for? There is no amount of jusficaon and no memos you can write that will make this ok! You are corrupt and care nothing about democracy or the voice of the people.
You do not deserve to be on the City Council. This is what you will be remembered for.

Heed Lincoln. Elect council replacements
The cheapest is not always the least expensive. Many have commented that the cost of a special election to fill two upcoming vacancies on the San Jose City Council is prohibitive or asked how many potholes can be fixed with those funds. What is the cost to our democracy? How many have given their lives so that we can have this privilege to elect our leaders? How many countries have we guided to conduct fair elections? U.S. President Abraham Lincoln, in his famed 1863 Gettysburg Address, may have best defined democracy as a “government of the people, by the people, for the people.” History has shown that democracy is a particularly fragile institution, especially at this time. I still trust President Lincoln. Let’s conduct a special election for the open council seats in San Jose.

Mayor + other Council,
When George Washington was elected as the first president in 1789, only 6 percent of the U.S. populaon could vote. In most of the original 13 states, only landowning men over the age of 21 had the right to vote.
Now we have a handful of Council Members who want to choose our representaves.
That's zero voter turnout! That's Voter Suppression!

Council Members Jimenez, Arenas and Davis,
Your recommendaon to let 6 of the 2023 councilmembers decide who will be appointed to two vacant council seats is despicable.
It does not represent the people. If you wanted everyone to work together, you would recommend that a unanimous vote is needed to appoint the new council members next year.
Arenas and Davis ran for office during their term. Now you’re concerned about other council members running for office during their terms. Complete hypocrisy on your part.
You say you will “handle this in a thoughul manner.” More hypocrisy when you want 6 of the council members to pick the new ones.
You say “It is important to note that mayor-elect Mahan will have a say in who is selected to represent District 10.” More hypocrisy. It’s only 6 of the council members who would choose the newly appointed members.
You say “not allow policians to play kingmaker via campaign commiees” and worried about “IE’s buying an elecon.” More hypocrisy. Where was your outcry when the 49ers spent $720,000 on your Chavez’ campaign? Now YOU want to play kingmaker with only 6 council votes?
You say “who sits on the Council, likely for the next 5+ years”. YOU want to play kingmaker for 5+ years on two seats. That is not an interim appointment! You want to hand-pick for 5+ years. Why didn’t you recommend someone who doesn’t want to run for re-elecon? More hypocrisy.
You say “We must demand beer from our policians and our news sources.” More hypocrisy. YOU are the policians and YOU control the news sources.
You say “Elecons which we are sure residents are red of.” Who put you in charge of deciding when residents are red of elecons?
Why didn’t you menon the cost esmate that costs half as much if we do all-mail elecons? The people of San Jose will not forget this divisive, corrupt, hypocrical power-play. You are liars and you are stealing two council seats because you know that Labor wouldn’t win in D10

Any Council members who vote for your plan to have the current regime appoint successors should be RECALLED.
And the successors should be RECALLED on Day One.
San Francisco did it. So can San Jose!
HERE’s the CORRUPT San Jose REGIME in ACTION …
Gerrymandering wasn’t enough!
If you can’t win at the ballot box, then STEAL the SEATS! Use the current regime, along with public spin from your “broad coalion”, to mandate appointments. Give 3 weeks for your comrades to submit “applicaons”. Select only six, yes six members, of the new regime, to hand-pick successors, who as you said, will likely be in office for 5+ years.
Power has gone to your heads! How dare you say that Mahan and Arenas should have a voice in filling the new seats. This is about the voice of the people. You are trying to take away the people’s voice and their right to vote! You have disdain for the people and you exemplify polics at it’s worst!

Dear Mr. Mayor and Members of the San Jose City Council,
I request the San Jose City Council create an expedited process for a Special Election to fill the vacancies in the D8 & D10 Council positions. I oppose the current 2022 Council appointing individuals to the D8 & D10 Council positions without a vote of the citizens of these districts.
To make the assumption that the District 8 and 10 residents want to forfeit their vote and leave it up to the City Council is both unreasonable and perceived as tyrannical.
Special Elections are not new to the City of San Jose; others have been elected in this manner and set a precedent for how this process should continue. District 8 and 10 residents must have the opportunity to make the choice for themselves about who would best represent their district.
A Special Election would demonstrate to the San Jose Citizens that their Mayor and City Council represents their best interest. Thank you.

Mayor Sam Liccardo,
I am writing in support of the City Council appointing new members of council to fill Districts 8 and 10. According to the City Charter, the City Council has the discretion to appoint someone to fill the two vacancies for the remainder of the term. This option would require no city funding and create an opportunity for a genuinely representative electorate to select their next councilmember. The alternative, a special election, could cost $7-11 million dollars, have extremely low, consequently unrepresentative, voter turnout and will not yield a councilmember until August of next year, months before the 2024 election cycle begins, according to the Santa Clara County Registrar of Voters.
As a San José resident, it’s clear to me that our city is currently at a critical juncture, in dire need of resources for public safety, parks, and vital infrastructure — every dollar that is unwisely spent means there is less, much needed, funding towards addressing our current housing crisis, and need for public safety and regional economic development. These are urgent issues that impact each and everyone that lives and works in San José. We need our local leaders to focus on funding and implementing solutions that make it possible for each of us to have a roof over our heads, feel safe in our neighborhoods and parks, and have access to critical infrastructure and care.
I stand alongside a broad coalition of partners from labor, community and multi ethnic organizations in supporting a process that would lead to genuine representation and afford for an electorate reflective of our community. I ask the San José City Council to put their constituents first and adopt a fair, transparent, inclusive, and expeditious process to appoint members to represent Districts 8 and 10 until the next regular election in 2024.

Now that two City Council positions are left with two vacancies (Districts 8 and 10), I would like to petition/admonish that the people from these districts be allowed to vote and choose the representatives that will lead them. It is imperative to the democratic process that ALL voices are heard; therefore, the voters of these districts should be able to pick their representatives, not Council members who do not live in those districts.
I have faith and hope that you will listen to your constituents and preserve our democracy.

Honorable Mayor and City Council members,
I strongly urge you to hold a special election to select permanent replacements to fill the vacancies for D8 and D10 City Council members.
There is no principle more centrally important to San Jose (and the United States) than the foundational value that the people should choose their public servant leaders – not special interest groups or politicians. Not holding this election would be a denial of the democracy we enjoy and greatly erode public trust in government.
Thank you for seriously considering my position on this important topic.

It is critical that Districts 8 and 10 voters should select their Council Members NOW; and should NOT appointed by Council members who may or not have the voters in those districts' best interests in mind.
Yes, a special election may cost several millions, but the cost is minimal compared to the millions the city spends on addressing homelessness, for example, with little success in eliminating the problem or significantly eliminating the problem.

Mayor & City Councilmembers -
As a District 10 voter I SUPPORT A SPECIAL ELECTION to replace our current Councilmember when he moves on to the Mayor's office at the beginning of 2023. I VEHEMENTLY OPPOSE ANY PLAN WHERE YOU WOULD APPOINT HIS REPLACEMENT and I hope that you won't take away my right to select my next representative.
The most basic tenant of our Democratic Republic is our right to select those who represent us at every level of government. The only true way to accomplish this is through a fair and free election. Without an election we are merely surfs serving a political class that rules us through edicts feeling that they know what is best for us. This is a direct threat to our Democracy, and it cannot be allowed to stand. Ask any combat veteran, "What is the value of Democracy?" they will tell you from their hearts.
Past City Councils have chosen to fill these vacancies via the Special Election because it relies on the voters in the affected district to make the choice. By Appointing my representative, you will have broken that long term precedent in favor of political expediency, no matter what criteria you put in place to make your choice seem fair and transparent. I caution you, DON'T DO IT! It will come back to haunt you when the shoe is on the other foot.
REMEMBER: as Abraham Lincoln said in his Gettysburg Address: "we are a government of the people, by the people, and for the people." Not for the political class and their next career positions.
Thank you for your consideration

Hello Mayor Liccardo and San Jose council members,
Please let District 8 and 10 residents vote for their council members. They should decide their representave in a special elecon, not by other council members. I live in District 4, but I believe that only residents in these districts should choose their council members and we should have a special elecon.
Please vote yes for the special elecon.
Thank you

To: Mayor Liccardo and the San Jose City Council Members.
Appointment in lieu of election to an elected office is unethical, immoral, and undemocratic.
Candidates are elected, through the vote of the people, as their representative.
In our recent mayoral election Ms.Chavez was endorsed by all of the Council Members except for the Mayor.
The council appointment to mayor would most certainly be Ms, Chavez.
The people's choice for mayor was Mr. Mahan.
Clearly this exemplifies the disparity between appointment and election and the necessity for special election.
I sincerely hope that the Council Members do what is right for the residents by giving them the voice in who should represent them in their district.
Respectfully,
Seigi Tadokoro, San Jose resident of D10

Dear Honorable Mayor and City Councilmembers,
As a resident of D10 I am asking you to appoint for the upcoming vacancies in D8 and D10.
There is an election scheduled for March of 2024 which will garner much higher voter turnout, at no additional cost to our city. Spending $11 million on up to four elections, at a time when we have thousands of unhoused people on our street is misguided priorities.
Our city Charter allows for appointments, if appointing city council members is so egregious we should have long ago removed that means of replacement from the Charter. We have not removed appointments from the Charter, and as such we can legally and prudently follow the Charter by making appointments for the city council vacancies.
And we should not forget that the City of San Mateo is currently filling a vacancy (two year term) on their city council via appointment. Many cities in the Bay Area fill vacancies with appointments.
As a D10 resident I do not want to wait until June or July to have representation, nor do I want to see someone elected in a special election, having campaigned for months only to continue to campaign for the March 2024 election.

We submied the aached Op.Ed (wrien Nov. 27) to the San Jose Mercury News last Monday. They chose not to run it, as they felt their Thursday 12/1 Editorial - supporng an Elecon - included all, or most, of of the points in our Op-Ed.
We are herein subming it to you as you and your fellow council members deliberate on how to proceed, and so that it can be part of the public record.
David Heindel - Pat Waite
How much do you value democracy? What is your vote worth? What is protecng your right to elect your City Council member worth to you and your family? On Monday, December 5th, the San Jose City Council will begin considering who represents the 200,000 San Jose residents of Districts 8 and 10 for the next two years. The city charter provides three opons for doing so: hold a special elecon, appoint a temporary councilperson pending the results of a special elecon, or appoint people to fulfill the reminder of the terms.
Conducng special elecons has been the norm for over twenty years, having been employed in the seven most recent vacancies. One recent example was in 2005 when now Senator Dave Cortese advocated for a special elecon.
Some City Council members, six of whom leave office in a few of weeks, have cited the cost of a special elecon, a break in representaon and expected low voter turnout as key concerns. Those in favor of a special elecon counter that the fundamental principles of America’s representave democracy require a vote of the people, that any break could be handled by a temporary appointment, and an appointment would be zero voter turnout.
LetMeVoteSJ.org is a grass roots group of San Jose cizens that has come together to advocate for a special elecon. We believe that our right to vote is too important for us to remain silent. We believe that a special elecon is the best way to replace our outgoing representaves. Our website will post informaon from all sides of the issue, as we believe the cizens should be as well informed as possible, and the voters should decide who represents them. We are not affiliated with any elected person and have membership from all ten San Jose council districts.
Currently, it appears that the City Council is leaning toward appoinng people to fill out the terms, which end in January 2025. District 8 council member Sylvia Arenas, vacang her seat aer being elected to the Santa Clara County Board of Supervisors, has stated she favors appointments for the remaining terms, with no vote by the people she currently represents. Councilmember David Cohen wants to review the data and analysis. District 10 Councilmember Ma Mahan, who is vacang his seat to become Mayor, favors a special

As of this wring, no other council member has stated a posion. As this process unfolds it will be difficult to determine what role, if any, special interests have in the outcome.
“A Republic if you can keep it” and “of the people, by the people, for the people” are senments expressed in America many years ago. They are powerful words that moved people and should sll move us today. The highest priority of our representave, democrac form of government is elecons – which means that cizens vote, and the majority selects their representave. To employ any system other than an elecon is fundamentally wrong and incompable with our democracy. This is even more so when it involves two council seats, 20% of the total. Any other process disenfranchises the residents of districts 8 and 10, no maer the voter turnout.
Senator Cortese put it best. “BEWARE. Any movement in the direcon of a quick appointment should be met with a huge public outcry. That may well be the only thing that will stop it.” We urge you to become informed about this issue and contact your council representave to advise them of your views.

Subject: SUBJECT: Dec. 5, 2022 Council Meeng, Filling Vacancies, Democracy Under Pressure
Dear San Jose Mayor and Council Members,
Please stand up for democrac rule. As Winston Churchill said, “democracy is the worst form of government – except for all the others that have been tried.” Certainly we can improve our democracy. Culture needs to change so that voters choose to be informed and engaged in civic life. Public funding of elecons is needed to reduce the undue influence of “special interests”, redistricng needs to be taken out of the hands of the legislave body of those districts, ballong should be reformed to beer reflect the public senment and with transparency and efficiency as with rank-choice instant runoff. Expectaons of civility for campaigns and the quality of public debate needs to rise above identy and parochialism. These reforms would be but a starng point needed to create the environment necessary to aract our truly brightest and most thoughul individuals with integrity to public policy making bodies.
Now is the me for you to begin the effort to encourage those individuals to run for public office who will focus on the peer reviewed, scienfically supported policy studies to solve problems and make the “rapid, far-reaching and unprecedented changes in all aspects of society” that the IPCC says is needed to prevent the worst effects of climate change and even collapse of civilizaon.[1] It goes without saying that we have been regressing in healthy democrac affairs at a naonal level but, locally, the recent redistricng and special interests’ campaign "literature" has also been a regression as well. And, it would be a further regression of our local electoral culture for the San Jose City Council to appoint the posions to its body beyond a short-term temporary caretaker role.
Response to Councilmember Jimenez, Davis, and Arenas’ memorandum:
· The Labor/Chamber divide has always been a shorthand term for a more complex relaonship between Council Members and undue influence from those special interests whose funding and long term relaonships are required for connued polical success of both pares – whether good or bad for the public interests of the governed. Those of us concerned solely with the public commons, for now and the future, for us as individuals and as a species, for future generaons and the diversity of species on the planet, and with a broad systemic economic and ecological perspecve have long viewed the division as superfluous – flip sides of the same, oen irresponsible growth inducing coin of the self-interested who use -- and oen abuse - - the public commons to maximize their own narrow interests. Regardless of the jersey the competors wear, the outsized influence remains.
· It is unfortunate that public interest in vong is so low. But to claim that an elecon with a turnout of 11 individuals (or possibly 9) is beer than thousands of residents is undemocrac and a cynical affront to the residents of our city. By rejecng rank-choice instant-runoff elecons you chose to connue low turnout primary elecons. · As for the meline, a rank-choice instant-runoff could have seled the maer in one elecon in May but you chose to preclude that possibility a few months ago.
This message is from outside the City email system. Do not open links or attachments from untrusted sources. · And as for the cost, you just created this situaon with an even more expensive mayoral elecon for the same 2 year period. And again, you also recently required primary elecons for all 10 districts and mayor by rejecng the cizens’ commission recommendaon for rank-choice instant-runoff elecons. Your concern about the cost is another cynical affront to residents.
While we should never be sasfied unl turnout is 100% and with all voters well educated, sll 1/4 of a million ballots were cast in the mayoral race with voters choosing a different candidate than your preferred candidate. Right or wrong, in democracy, their will is supreme; we have no beer soluon. Council Members Jimenez, Davis, and Arenas, you do not live in my district and you do not know beer than me who should represent me and my district. Let the voters decide for themselves.
Sincerely,
David Poeschel, San Jose District 10

It is imperative that the residents of District 8 and District 10 are able to vote for their council member.
A special election MUST be called to allow the people to choose their representative on the SJ City Council. It is NOT OK that this important choice is taken out of their hands. The City Council may have the right under the City Charter to choose these replacements but it is unconscionable in this day of election interference and doubt in the overall election process that the City Council over ride the rights of the residents of District 8 and District 10 by taking away their choice to elect the person they want to represent them.

I strongly believe that we, as citizens, should elect our own representatives in every aspect of government especially in regards to city council. As a strong advocate for individual choice, it highly concerns me to hear the vacant spots in Districts 8 and 10 are going to be filled through City Council's appointing.

Honorable Mayor & City Council Members
Let the people vote!
Approving the recommendaon memo from the 3 council members is the first step in “ending democracy as we know it” as it cements the idea that vong by the people shouldn’t be allowed if the council doesn’t want to rearrange their spending priories or vong is cancelled because of low vong turnout. Nor should anyone be swayed by their fear taccs that money would be diverted from community services if a special elecon is held. Remember, the city council approved their $6 billion budget knowing of 2 possible vacancies.
Stang that the memo was wrien with polical diversity is not enrely true. During the recent elecon process 9 councilmembers came out against the mayor elect and now 3 have wrien a memo recommending canceling vong rights in D8 & D10 which the mayor elect won. Apparently, their new approach is to avoid the people vong and let the council choose their own colleagues. Then jusfy their acon by stang they are spending money in more appropriate areas, all in the interests of the people, of course.
This would be a step in the wrong direcon.
A representave is only a representave if voted in by the people they serve.
Keep democracy flowing, connue to let D8 and D10 vote!

Good evening San Jose Elected Officials,
I am adamantly opposed to the two new city council vacancies being filled any other way than via a vote by we the people, whom you all have been elected to represent.
I strongly urge you to not break a long-standing precedent of Special Elecons to fill vacant Council seats. We the people do not want our voices eliminated from being heard now or in the future, which is what will happen should you decide to appoint individuals to these vacancies. Appointments would be a real threat to our Republic.

Subject: Let Me Vote SJ City Council!!
Dear Mayor Liccardo, Mayor-Elect Mahan and San Jose City Council Members,
Please allow for a "special election", so constituents in Districts 8 and 10 can vote for the new council member. Let Democracy prevail and allow voters their constitutional right to vote!
Going forward, I propose that the city charter specify that a special election will always be held to replace an outgoing council member mid-term, within 7 months of departure, and have this election be at the same time as the June primary. Then residents don't have to fight for their right to vote again!
Congratulations to Matt!! We look forward working with Matt to improve this city, and we hope that all city council members who endorsed Cindy can set aside their differences and work together professionally to make the quality of life better for all living in San Jose!
Thank you, Tami Sell - District 10 resident and voter in every election!

Dear SJ Council and Mayor,
As you head into today's vote to decide if you will muzzle democracy or do what has made this country a world leader through the voice of the people. I urge you to move to the side of democracy. San Jose needs passionate leadership, it doesn't need a polically movated stocking of open seats. I live in District 10 and will announce that I am happy to fill the seat of Ma Mahan as someone who has an important stake in the outcomes and decisions the city makes. The city wants change, and changemakers are people who come in with plans and visions they see as providing a beer experience for residents. Honestly allowing the Council to bypass democracy should not even be an opon.
As some of you seek other offices once you have served your term, what will you legacy be? Will it be that you stole the voice of your constuents for your favor, or will it be that you believe and exercise the freedoms of the vote that put you into office?
So I urge you to vote in favor of allowing the cizenry to vote and not steal this opportunity from us to make sure we have representaon that fits our community by our community instead of stealing democracy in your self-serving appointments.
Sincerely,
Greg Holsen
District 10 Resident
Greg Holsen

Mayor Liccardo, Vice Mayor Jones & Councilmembers:
I'm a resident of District 1, but feel compelled to speak out about the need to allow voters in Districts 8 and 10 to decide who will represent them on the San Jose City Council over the next TWO YEARS.
In our representave democracy, it's imperave that cizens be allowed to choose the people who make vital decisions on their behalf.
We value and protect the right to vote. This is our highest priority. We commit public dollars to ensure fair elecons, to make vong convenient and accessible, and to encourage parcipaon. We pay for elecons, we don't suppress them.
Please move forward as quickly as possible to hold a special elecon to fill these two vacant council district seats.
Sincerely,
Amy Cody

Re: San Jose City Council Vacancies
Honorable Mayor and Councilmembers,
On behalf of the Silicon Valley Biz PAC, we respectfully request that you allow the voters of San Jose City Council Districts 8 and 10 to decide who their next representative will be.
Democracy. A word conveniently tossed around by many politicians, including some if not all that sit on this City Council, and as an organization that focuses on elections, voter participation and democracy, we are pleased to have heard those words. At hand are two moderate city council seats vacated by two current city council members who won elections. How did they win those elections you may ask? By allowing our citizens to vote. Now it’s time for you to stand for democracy and support an open and transparent election for the residents of District 8 and 10.
The last five times the council has had a vacancy, dating back nearly 30 years, voters have picked their replacement via a very fair and open special elections process, not by allowing other politicians to pick new politicians. What is the argument made by those Council members who don’t want voters to decide? The cost. A cost that we now see is minimal considering the rights of citizens to participate in the democratic process. Unfortunately for those Councilmembers who want to strip away voter rights, that argument works against them. So why don’t we just stop all elections and just allow politicians to pick new politicians every general election cycle? Because it’s undemocratic.
Some others may argue that a special election will leave the seats unfilled for too long. Unfortunately for them, that argument also lacks credibility since the Council can still appoint a temporary replacement until the voters decide via a special election. Another not very well thought through argument against democracy is that the elections for 2024 open in September of 2023 and that its “only a few months after a special election result”, as if that’s the date that the terms will end for the special elections victors. Again, another baseless and undemocratic argument.
With that said, we respectfully request that you allow democracy to run its course and let San Jose City Council District 8 and District 10 voters decide who their voice on the Council will be.
Sincerely,
Victor Cuauhtémoc Gomez

San Jose City Council members, Mayor Liccardo, and San Jose City Clerk,
I am a resident of District 10 San Jose. I want to vote for the person who will represent me on the city council, not have a handful of people who don't represent me choose for me. How is it legal for you to decide this on my behalf? Why would you even consider this?
Do not choose for me. The people from the two districts must choose. Thank you for respecng my right and not disenfranchising me.
Ann Wolfe
