SOLUTION OF THE COUNCIL OF THE CITY OF SAN
JOSE APPROVING THE REVISED DIRECT DISCHARGE
TRASH CONTROL PROGRAM PLAN AND DIRECT ING
STAFF TO SUBMIT TO THE SAN FRANCISCO BAY
REGIONAL WATER QUALITY CONTROL BOARD BY
JANUARY 3, 2023, AS REQUIRED UNDER THE
MUNICIPAL REGIONAL STORMWATER PERMIT
PROVISION C.10.F.II; AND FURTHER AUTHORIZING THE
CITY MANAGER TO MODIFY THE PLAN AS NECESSARY
AFTER THE WATER BOARD REVIEW
WHEREAS, the City of San José (“City”) City Council desires to adopt this resolution for the reasons set forth in the memorandum, from Kerrie Romanow, Director of Environmental Services, Jacky Morales-Ferrand, Director of Housing, Jon Cicerelli, Director of Parks, Recreation, and Neighborhood Services, for the December 13, 2022 City Council meeting (“Memorandum”);
WHEREAS, this action is part of the City’s work to comply with its Municipal Regional Stormwater Permit mandates; and

HEREAS, the City staff determined this action is exempt from the California Environmental Quality Act and Council hereby agrees with this determination; NO
W, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:

he revised Direct Discharge Trash Control Program Plan is herby approved and staff is directed to submit the plan San Francisco Bay Regional Water Quality Control Board (Water Board) by January 3, 2023, as required under the Municipal Regional Stormwater Permit provision C.10.f.ii; and NVF:CDW:JLM

2. The City Manager is hereby delegated the authority to modify the plan as necessary after the San Francsico Bay Regional Water Quality Control Board review.
