Subject: Support an appointment process guided by the values of a broad and vibrant democracy

San Jose City Clerk Toni Taber,
I am writing in regard to the appointment process to fill San José Districts 8 and 10.

As a San José resident, it’s clear to me that our city is currently at a critical juncture, in dire need of resources and solutions for public safety, parks, and vital infrastructure. The people of San José are ready to work together with our neighbors and our communities to build a better city!
As you decide who will represent District 8 and 10 on our city council, I urge you to consider leaders that truly represent our broad and vibrant democracy and can deliver good jobs, accessible housing for all, safer neighborhoods, and the prosperity that we all dream of for our families and communities.

I stand alongside a broad coalition of partners from labor, community, and multi-ethnic organizations in supporting a process that would lead to genuine representation for our communities.

Wednesday, January 25, 2023

I am a stakeholder/resident for District 8.

I am disgusted at the City Council Meeting I went to (to speak) on Tuesday, January 24.

Here are my reasons for being disgusted...

1. I was told I could speak at 3pm

that was not true, you city council members just made it up as you went along. the agenda was in error.

I was informed by Mayor (public comment by him) that each candidate would go first and this took 30 minutes and so a member of the public had to wait 3 hours to do public comment, and then to make matters worse , a full hour for dinner took place so I had to wait over 4 hours to do my one minute public comment.

So, this should have been properly agendized. and figured out better by Mayor Mahan.

2. upon walking up to speak, I was treated bad by security. (now the security up stairs was excellent, but the security monitoring speakers is bad. I was told where to stand and rudely too.

I then did not see the TIMER on the visual screen. THEY DO NOT USE THE VISUAL TIMER but you board members can't see, so I could not see my time eroding and that is key to making presentation for one minute.

I did the best I could but was rudely cut off by the time monitor.

NOW MR. M A Y O R you got to speak to the timer person, she is rude and mean.

yes mean.

I ask you to get a new timer person or better help the current one to be kind and respectful for speakers (especially those who wait over 4.5 hours to speak )

what happened is she says TIME

AND that is bad way to treat San Jose residents.

what should have happened is San Jose, needs to do a complete review of this entire process of public comment

A. put an X on floor where people stand to wait as they are asked three at a time to wait to speak

B. Train the mean security lady to not be rude and to be kind, also the other security person is now trained to physically walk up to speaker (see video) and kind of physically (with close proximity) encroach on speakers if they go a bit over on time. This could be a safety issue in my view.

C. invest in a nice new method for public speakers... give them ONE MINUTE AND 15 SECONDS... as the time hits one MINUTE, then use a dull buzzer, as the time hits ONE MINUTE 15 SECONDS, then use an automatic other tone buzzer that will inform speaker time is up.

STOP THIS RUDE METHOD OF A PERSON SAYING

TIME

I have been told by many who spoke last night that they were treated rude, had a bad experience, and were cut off in mid sentence.

D. This is key point. ALWAYS ALWAYS ALWAYS, LET THE

SPEAKER FINISH THE SENTENCE AND NOT BE RUDE WHEN
THE COMMAND OF TIME IS DONE.

many are very upset at the way they were treated at the meeting last night. Many are very disgusted.

E. Mayor Mahan, you did well and were earnest in how you ran the meeting, but you got to be tough and enforce kindness. the current situation as to how public speakers are treated needs lots and lots of better oversight. the person who yells
out TIME!!! needs a new system (
A simple buzzer (automatic) and
as stated above a dull sound for
first minute than a sharper sound
once a person gets to one minute
15 seconds). SO ALL FUTURE SAN

JOSE CITY COUNCIL MEETINGS

NEED TO CHANGE FROM ONE

MINUTE SPEAKING TIME TO ONE
MINUTE AND 15 SECONDS

SPEAKING TIME FOR ALL SUCH
CRUNCHED TIME MEETINGS.

many people are livid at how they were treated with regard to the one minute (some cut off short) time and the bullying of the way security is treating people at speaking area, the one lady is mean, and the other is kind but told to physically walk to podium (instructed) as time is gone... this is a safety issue in my view.

many very very upset at the way they are treated.

==============

possible law violation with regard
to how city council voted for
candidates

EVER HEAR OF THE BROWN ACT

that states no city council
members are allowed to talk in
private as to who they will vote
for

SO, I REQUEST MATT MAHAN

THAT YOU ASK YOUR CITY

LAWYERS TO SEE IF YOU
VIOLATED BROWN ACT because
you all took at one hour supper
break and you all chat and you
may be telling others how to vote
etc. THIS IS WHY THIS ENTIER

SELECTION PROCESS IS BOGUS
in my little parent opinion.

AND in my opinion, could be that
labor groups who pay for vast
campaign fliers are influencing or
could influence certain council
members in how to vote, yep, my
opinion, so what you should have
done is had each city council member
sign a form that said they would not
speak with any other city council
member on which way to vote. This
did not happen. This is why this
entire process is bogus.

and worse, you got hundreds of
people really mad at you for how you
do your job in getting the
replacements for District 8 and
District 10. some people such as
myself are livid and do not wish to get
involved in volunteering to help City
of San Jose because of how you are
doing this MADE UP AS YOU GO

ALONG SELECTION PROCESS FOR
THE new two city council office
people.

I was rudely cut off last night at the
podium so I want to express what I
wanted to express here.

I was so very happy to see Magdalena
Carrasco in audience last night. She
represents the "SAN JOSE FAMILY" in
how she is so gracious and helpful to
all people. I think and know Sukhdev
Bainiwal is a like person to her in that
he too, is helpful to all people, and
kind and more.

I threw my notes away, but from memory, I was going to express to you all that Sukhdev is the best choice for District 8. He made a gallant effort to speak so well to you. His experience is keen. He walks with the people (just as Magadelana Carrasco does, and too, I don't always agree with Magadalena Carrasco's political ideas but so greatly respect her).

I see out of all your votes, you gave or awarded Sukhdev only 3 votes. Shame on all of you.

the people you voted the most
votes for are not experienced in
what they can do for district

8. they are not the proper
choice. i THINK and this is my
opinion, you made all of you a
great big mistake in awarding
Sukhdev only 3 votes.

So, I can't forgive you. This
experience will and does leave a bad
taste in my mouth. This entire process
may save ten million dollars in ballot
fees (or maybe it is only 5 million,
who knows) but it has devolved all of
you City Council Members to a place
that is in violation of Brown Act in my
view and it has shined a light on why
ELECTIONS and not SELECTIONS ARE
what built our country called America.

response requested from Mayor
Mahan

I put the above email on a pdf and I
ask all or one of you city council
members to send this and the other
two attachments above to MAYOR
MATT MAHAN.

Mr. Larsen,

Thank you for your feedback. While I am normally the one who is running the timer, I had a staff person handling the in person speakers last night. I will provide better training to her and the rest of my staff in how to handle the end of the time limit.

For in person speakers, we don’t use the powerpoint timer that we use for Zoom speakers, so it doesn’t display on the overhead screen. There is a timer on the podium as well as a light that turns red when the time is up. I can understand how if this is your first time speaking at the meeting that you may not have seen the podium timer.

I appreciate that you took the time to provide that feedback.

Dear Tori Taber,

I ask you give a copy of this email to Mayor Mahan

and I ask you send me back the email to his Chief of Staff,

this entire situation was a stain on the City of San Jose

and I do appreciate you sending me back the response today, but I want the Mayor's Chief of Staff to respond. I want Mayor Mahan to personally see my 3 pdf's so I want to get email back from either Mayor Mahan or his servant leader , chief of staff.

it is hard to unring a bell Tony Taber. Actually you can't unring it.

The entire city council meeting was blasphemous and in my view illegal due to violation of brown act.

so, here is my 4th pdf that made the newspapers

and you might enjoy watching the video clip

and

Toni Taber, please send me back the email of the chief of staff for Mayor Mahan

thanks,

this newspaper article says one hour hold up to go over breaking of law possibllity in selecting

city council members instead of electing them

this is why we needed to ELECT

read this and weep

https://sanjosespotlight.com/san-jose-officials-to-select-new- district-8-city-councilmember-appointment/

can someone give Mayor Matt
Mahan these emails and articles,
he has a mess on his hands in my
opinion as a parent, and too,
many residents don't want to
work with someone who may
have had the questions in advance

i as a resident of District 8 request a
full investigation as to if cheating took
place with answers given in advance
to any candidate. this needs to be
done in my parent opinion, no matter
the delay or costs.

and it says one person may not have
qualified to interview because they
don't live in district 8, this needs to be
vetted

and as i stated to all of you

the BROWN ACT was violated in
how you interviewed the
candidates and how you spoke
when you were alone and
more. who knows who called up
who and again, there is alleged
sharing of questions to only some
candidates. this all has to be
investigated.

I hope Mayor Matt Mahan has the
strength to take a deep breath
and fix this mess.

maybe have a special election

I ask some council members write
Mayor Mahan and say...

look, we got a big problem here, the
way we selected may be corrupt

also,

I ask all of you council members read
all of the comments under this
spotlight article

such as this one

if the guy who was selected had the
answers to the questions and read
them off of an electronic device,
then someone needs to ask him

who gave you the questions, and if it
is found out he did get access to
questions (needs to be carefully
investigated inside the City Hall)...
then

you city council members need to
have a special meeting to go over it
all.

plus, you violated the brown act (see
above)

but look and read these comments
after this article

https://sanjosespotlight.com/allegations-surface-against-san-jose- city-council-hopefuls/
example of one comment at end
of article above that needs
investigation, one can view the
video and make conclusions...
etc...

My_OpinionJAN 24, 2023 AT 11:40PM
Since the process is (allegedly) in the City Chart to appoint representatives, change the Charter.

There were 2 things that were very troubling to us about Domingo Candelas:
1). He didn’t deny the allegations. Was it improper conduct or wasn’t it?? Neither Mahan, Toni Taber, or any of the Council members called foul on Domingo Candelas’ part. 2). He was constantly looking down as he was giving answers to the Mayor and Council members. It wasn’t just a glancing down. It looked like he was actually reading fr om something.

Having said all that, Domingo Candelas was our #1 pick.

Congratulations, Council-chosen Council member. We wish you success.

this is real important in my view

I would suggest delay of
interviewing any people
for District 10

I think, and maybe it happened or
maybe not, but the video if
studied might show things

this may have happened on
January 24, the worst city hall
council meeting in history in my
opinion

the following is just a possibility
and would need to be proven out

just a hunch but I may have figured out this whole mess...

------------------
you can watch the video

https://sanjose.granicus.com/player/clip/13576?view id=51&redirect=true&h=b40ef3647 bfd0f5051b2d7847497373b

I think I figured out what went wrong in the process...

a person waiting to be called in the chamber to get the 9 questions ( each city council member and the mayor asked the same question to the candidates (30 minute period)

so, someone in the audience may have texted all 9 questions to a potential candidate waiting in the back to be called up to be interviewed

then if that candidate was say the 4 candidate to go and get interviewed

this gave the candidate one hour or more to prepare answers to the questions texted to the candidate by the candidate using internet and drafting responses which
if it did happen was unfair and unethical.

so as the candidate went through the same questions... such a candidate may have just read the
prepared answers (over one hour of prep) to the city council members and mayor and had an unfair
advantage for the candidate did not have to think of answers on the fly

I'd make a good spy

so, if the above is proven out,
delay the selection of the district
10 candidates till this gets figured
out better. it is as many are
saying a "circus" so I ask one of
you city council members to copy
this out on paper and give it to
your city council leader

ok, so as a parent, i took the time
to review the film (above) of you
city council members asking the
same questions to this candidate

1hour 55 minutes in

Domingo is looking down and
reading his answers for
questions... please view

why would a person look down to
review things?

this is suspect of a flawed process
in my parent opinion

many tell me the same in District
8 where I live

==========

so Mayor Mahan blew it and so did
all of you.

you treat District 8 as a second
class citizen because today, you
remove all electronics from
almaden district 10 candidates
but you practice test and flawed
and perhaps against brown act
and more district 8

so, it is very very very clear that
this candidate (in my opinion as a
parent of district 8) it is clear
that perhaps this person had all
the questions in advance.

I suggest more camera check in
the room where all candidates
were waiting and interviews with
other candidates waiting as to
why this person was allowed to
break your rules of NO

ELECTRONICS

so, this has put a bad taste in my
mouth so to speak of Mayor
Mahan and all of you city council
members (who I know are very
intelligent and good

This is a violation of law and
please show this email to the
lawyers of the city.

this is why you took the one hour
lawyer break in my view

you got to check the cameras and
ask this candidate Domingo

did you get access to the
questions before you walked out.

did you?

and you can ask him to check his
phone and more

what did he bring to the podium,
was that a computer or notes
, can you ask him to show you his
notes at the podium,

why would he look down say like
100 times, why.

did the other candidates look
down at notes when speaking to
you city council members

I ask you to have a closed private
agenda session on this.

I ask you to RE DO this entire
process with new questions and
re interview any candidates who
wish to try over this process
which in my view broke the brown
act and too, in my opinion the
cameras show a person reading
things to the city council members
and

how would a person know what to
write to read to a council person if
they did not know in advance the
questions.

could be, and this is just a
possibility and as a resident I am
free to express myself

could be, since electronics were
allowed to be used, phone and or
laptop computer, not sure

then could be

THE CITY COUNCIL DID WELL AND

ARE ALL HONEST, BUT MAYBE

maybe someone from audience
texted questions to one or more
candidates

I ask this to be checked and this
can be checked by checking the
camera on all the candidates
waiting.

check that camera

and if you can

zoom in on whatever Domingo is
reading as he answers each
question

this is democracy

I come to you to ask you to honor
my VOICE and many others agree
with me who live and work and
care about District 8.

RESPONSE REQUESTED FROM either
Mayor Mahan or chief of staff of his,
don't see Jim Reeds email anyway,
maybe one of you city council
members can print out all of this
information including the pdfs I sent
and news articles and

maybe you can care just a tiny bit
about Democracy. Do you care

people go to war (my family included-
many generations) to fight for
Democracy

are you city council members going to
review

one hour and 55 minutes in (on the
video above)

are you

do you care?

kevin larsen
parent
community helper

I want to make another point

I am writing you about justice, not to push one candidate or another

if you as city council members break the fabric of democracy our city devolves

you are harming not only District 8 but yourselves too

===============

I again ask one of you city council members to copy off this email and put it on a pdf or on paper and hand it to Mayor Mahan,

it is impossible to contact him, he is buffered too much by staff

so, can you do this for the kids and humanity

we must have San Jose integrity in all we do

there is just no good reason in my mind for a person to read notes to answer each and every question , something very suspect here

and your breaking of the NO ELECTRONICS THING was done

so this has to be cleaned up

===============

if not, no one will help the city , no volunteering, no nothing

and Mayor Mahan will have a city of non integrity.

so, in parting to you

I do request some kind of response back to say,

GOT YOUR EMAILS, THANKS

the thing I want to let you know is...

I am in a way, a kind of good voice for District 8

I write many many articles on District 8 and have for years and years

here is a window to one subject I wrote on called HOUSE-LESS- NESS

I send it because you may not know that I work with 100's or residents and

organizations and more

also, I include some other things, but this is only 1/10th of my writing

also, I won an award from the City of San Jose for writing

journalism for District 8, which I am very proud of and have on the wall in my bedroom

I am a regular joe, and when someone steps on Democracy, I speak out.

ok, so, I ask Omar, can you make
sure your staff sends all of my
emails and pdfs to sheltered
Mayor Mahan, I want to ensure he
also reads this...

and in this last pdf... make sure to
scroll down to the end...

a lot of simple humble wisdom at
the end of the writing

can you city council members take
time to save yourselves for you
violated Democracy and you can
ask Domingo, this

"Domingo it was our fault, we
need a re-do on interviewing all
candidates for district 8 because
we all violated NO ELECTRONICS
RULE, and Domingo, we enforced
no electronics for Almaden
candidates, so we must make it
equal for our District 8.

here now, the last pdf from me.

hope you all know how hard it was for
me to do all of this... why not you or
one of you be a change agent for
health of all.

Omar, can you or your team email me
back to say

we copied Mayor Mahan so he can if
he chooses to read you things,

I have written well

need to do an about

I send you these
articles to let you
know how invested I

work with are
invested in District 8

vote for this person
or vote for that

The day democracy died in San Jose

The farce of having San Jose City Council select new
councilperson for District 8 and District 10

I was there when a profound failure of government
occurred. It
was on Tuesday, January 24, 2023.

What happened was unprecedented in San Jose history.

Instead of allowing the voters to elect two city council members
the San Jose City council decided to save millions by
selecting
two city council seats. This was a first!
The process was made up as the meeting went along. It
was
flawed. I spoke and was appalled at in my opinion the
possible
collusion of votes for certain candidates by San Jose City Council
members which could be political in nature.

I think, and this is my opinion as resident of District 8 (the Sylvia
Arenas slot) that there could have been collusion in that there
could have been private conversations by the San Jose
City
Council members on who to vote who for. I believe this is in
violation of the Brown Act.

I am too tired to help prop up law and the Brown Act our city
officials let us all down as residents in my view. I believe the new
mayor did not take enough precaution in announcing
there is no
private discussions or phone calls for City Council
members to
collaborate and or collude as to who to pick. In my
opinion, the

fix was in because the best candidates were not
considered as
finalists. This is why we have voting instead of selection by City
Council. We broke our code of honor in honoring
Democracy.

Laws need to be enacted so this never occurs again in my opinion.

I waited 5 hours to speak less than a minute in favor of a candidate. That candidate was so wonderful and
received few
votes from City Council because no proper election was
held.

This selection process is un-American, flawed, maybe
corrupt.

As far as I am concerned in San Jose, Democracy is dead.
