BACKGROUND

Construction Inspector Series

As part of the City’s regular review of classification specifications, staff drafted updates to the Associate Construction Inspector and Senior Construction Inspector classification specifications.

These updates included broadening the minimum qualifications for the Associate Construction Inspector level and creating a new, flexibly-staffed, feeder classification series of Construction Inspector I/II under the Associate Construction Inspector classification to improve the candidate pool for recruitments (Attachment A). The broadening of minimum qualifications and the creation of the feeder classifications is also expected to assist the City’s efforts regarding

diversity, equity, and inclusion. During this process, the City identified that the Associate Construction Inspector and Senior Construction Inspector classifications have experienced relatively high vacancy rates and incumbent turnover since the beginning of FY 2020-2021, and conducted a salary survey of comparator public agencies, which found that the City’s classifications were below the average of the marketplace.

On January 23, 2023, the City and MEF agreed to the terms of a Side Letter Agreement that would provide the salary adjustments shown in the table below, which would raise the rates of pay in these classifications to the average of the City’s marketplace (Attachment B).

Senior Construction Inspector 2.29%

The City identified that the Principal Construction Inspector and Operations Manager classifications, which are represented by CAMP, would experience salary compaction with the MEF-represented classifications listed above without further adjustment. On January 23, 2023, the City and CAMP agreed to the salary adjustments provided in the table below (Attachment C). Wastewater Facility Engineer

On June 28, 2021, the City and the Association of Engineers and Architects, IFPTE, Local 21 (AEA) formalized a Side Letter Agreement stating that the City would conduct a classification review for the Engineer, Architect, and Designer series (Attachment F). Based on this review, the parties agreed that a separate Wastewater Facility Senior Engineer classification in the Environmental Services Department (ESD) would be created, acknowledging that the Wastewater Facility Senior Engineers in ESD are performing work that is more specialized than work performed by other Senior Engineers. The parties further agreed that in conducting surveys of comparator agencies and establishing a new compensation range for this new classification, the City would include California agencies which provide wastewater treatment services.

The Human Resources Department worked with ESD to create a Wastewater Facility Senior Engineer classification in response to the Side Letter Agreement between AEA and the City (Attachment G). During the creation of this classification, a second higher level professional classification titled Wastewater Facility Principal Engineer with an emphasis on wastewater processes and treatments was created to ensure the department recruits staff at the appropriate education and professional experience (Attachment H). The creation of the Wastewater Facility Senior Engineer and Wastewater Facility Principal Engineer classifications resulted in the creation of a two-class series with an emphasis on wastewater processes and treatments expertise.

The City reviewed agencies in California which provide wastewater treatment and found 10 comparators at the senior level with an average maximum salary of $182,735.47 annually. The proposed pensionable salary range of $137,488.00 – $174,033.60 annually for the Wastewater Facility Senior Engineer is based on market average after accounting for the 5.00% ongoing non- pensionable compensation increase that incumbents will receive. Senior Engineer incumbents in ESD Wastewater Facility will be moved into this newly created classification of Wastewater Facility Senior Engineer.

The proposed annual pensionable salary range of $153,175.55 – $192,172.15 for the Wastewater Facility Principal Engineer is intended to compensate for the additional level of responsibility, authority, and years of experience that is required for this position. Principal Engineer/Architect incumbents in ESD Wastewater Facility will be moved into this newly created classification of Wastewater Facility Principal Engineer.

Work is supervised while in progress and fits an established structure or pattern. Exceptions or changes in procedures are explained in detail as they arise.

Construction Inspector II – This is the entry level class in the Construction Inspector classification series.

Initially under close supervision, incumbents with basic construction inspection experience learn City public works construction inspection practices and procedures. Positions at this level are governed by established procedures that need to be learned , are not expected to function with the same amount of knowledge or skill level as positions allocated to the Associate Construction Inspector level, and usually exercise less independent discretion and judgment in matters related to work procedures and methods.

Work is usually supervised while in progress and fits an established structure or pattern. Exceptions or changes in procedures are explained in detail as they arise. As experience is gained, assignments become more varied and are performed with greater independence.

Associate Construction Inspector – This is the journey level class in the Construction Inspector classification series responsible for performing the full range of contract administration, materials testing, and construction inspection work in support of public works related operations, projects and programs.

Incumbents are expected to work independently and exercise judgment and initiative. Positions at this level receive only occasional instruction or assistance as new or unusual situations arise and are fully aware of the operating procedures and policies of the work unit. This class is distinguished from the Senior Construction Inspector in that the latter is responsible for (i) serving as a project inspector on large and complex public contracts; (ii) inspecting a large number of public or private contracts; or (iii) supervising a materials testing program function.
