Concern with 3.5 - Nov 2018 Ballot Measure T
Cindy Luong <

To:Agendadesk <
You don't often get email from Learn why this is important
Hi San Jose City Council,
Hi, my name is Cindy Luong and I've been a long-time resident of East San Jose. We need to retain the original funds for the environment to make this place a safer place and add value to our community.
For far too long our communities' environmental issues have been put on the back burner and our representatives have faced constant pushback when bringing forward recommendations to make improvements to Lake Cunningham.
Since the mid-1990s, the water quality at Lake Cunningham has experienced a detrimental decline, which has compromised access to the lake, threatened the environment, and jeopardized the safety of park meadows and amenities during algae blooms or natural flooding on this historical floodplain.
It’s been over 30 years that the lake has been off-limits for recreational use.
This reality begs the question, if not now, then when? Your vote will show us how much you value environmental equity and justice for East San José.
I strongly urge the council to:
Accept the Candelas & Ortiz memo, and
Give voters what was promised in measure T, putting these funds towards preventing flooding and water quality contamination.
Thank you,
Cindy Luong

Dear San Jose City Council
I am writing to you regarding an environmental equity issue. Do not shift funding that would allow the city to take a step toward improved water quality at Lake Cunningham. Further delaying any action would be a continued injustice.
I ask that you not shift the $3.2 million in funding previously designated for water quality improvement that would allow the City to begin a path to improved water quality at Lake Cunningham. This 50-acre open space is a vital resource for all San Jose residents and especially those in East San Jose. After years of deteriorating water quality and major fish die- offs, the lake was closed down, taking away open space and unmatched recreational activities for families in East San José and residents of all ages. Our families deserve more access to open space, not less. Our families deserve investments in water quality improvements. Our families deserve nearby access to recreational activities. Now is the time to begin working toward improved water quality, not time to shift these funds to potential construction projects or other potential uses.

Dear San Jose City Council
I am writing to you regarding an environmental equity issue. Do not shift funding that would allow the city to take a step toward improved water quality at Lake Cunningham. Further delaying any action would be a continued injustice.
As a resident of San Jose for my lifetime of 44 years, I am appalled at all of the resources that were available to me as a kid growing up that our city is neglecting and removing from the East Side of San Jose. Our communities are constantly being pushed under the rug while all other areas of the city, predominantly the affluent areas. This is ridiculous. How are we to give families with children safe spaces and places to live or work when all of our parks, malls, rec centers, and social gathering areas and activities are being torn down? How do we keep our youth from joining gangs if the community is constantly being left to deteriorate? The city of San Jose needs to do better and with all the taxes being paid whether from an affluent neighborhood or a deteriorating neighborhood, why is the non affluent neighborhood suffering here? You keep taking my money but you are also stripping away the reasons my family moved and settled here: multiple schools, neighborhood parks, after school programs for kids, and family activities for all ages. I am not in favor nor vote to further let our last resources fall. We need to bring East San Jose back to life as the people who still live here are vibrant an love our city. We don't want it to become overcrowded without resources, we need San Jose to thrive. In order for that to happen, ALL of San Jose needs to keep their communities, not just the ones filling salaries.
Contact me as you need, I'm a born and raised East San Jose resident and remain here to advocate for our future! I ask that you not shift the $3.2 million in funding previously designated for water quality improvement that would allow the City to begin a path to improved water quality at Lake Cunningham. This 50-acre open space is a vital resource for all San Jose residents and especially those in East San Jose. Our families deserve more access to open space, not less. Our families deserve investments in water quality improvements. Our families deserve nearby access to recreational activities. Now is the time to begin working toward improved water quality, not time to shift these funds to potential construction projects or other potential uses.

Subject: 3.5 - Status Report on the November 2018 Ballot Measure T - The Disaster Preparedness, Public Safety, and Infrastructure General Obligaon Bond.
Dear Mayor, Vice-Mayor, and Councilemembers:
I am a concerned resident of San Jose, living in District 3 but still interested in our natural and built environment--including Lake Cunningham in District 5. From where I live, I can ride VTA to the lake. But the water quality is so bad that if the lake floods into the park during these atmospheric river events, it leaves dangerous residue behind. (Let alone try to boat or swim on the lake.) This is one of the reasons the voters passed Measure T in 2018.
For far too long, our communities' environmental issues have been put on the back burner, and our representatives have faced constant pushback when bringing forward recommendations to make improvements to Lake Cunningham.
This reality begs the question: if not now, then when? Your vote will show us how much you value environmental equity and justice for East San José.
I strongly urge the council to:
· Accept the Candelas & Ortiz memo, and
· Give voters what was promised in measure T, putting these funds towards preventing flooding and water quality contamination.
Thank you.
Sincerely,

Dear San Jose City Council
I am writing to you regarding an environmental equity issue. Do not shift funding that would allow the city to take a step toward improved water quality at Lake Cunningham. Further delaying any action would be a continued injustice.
I ask that you not shift the $3.2 million in funding previously designated for water quality improvement that would allow the City to begin a path to improved water quality at Lake Cunningham. Dear San Jose City Council

Since the pandemic, I’ve gained a new appreciation for Lake Cunningham as it was the only open space nearby me I felt I could easily walk and get fresh air after being cooped up inside after online teaching all day. Now As new parent I have been excited to begin taking my toddler to parks to explore and Lake Cunningham being one of them. It is necessary now to take action in protecting and investing in making our east side recreational parks safer for our children and communities. We deserve City Council actions to be taken in the right direction to ensure the health of our water for our current and future communities living in East San José.
I ask that you not shift the $3.2 million in funding previously designated for water quality improvement that would allow the City to begin a path to improved water quality at Lake Cunningham. Having a well taken care of lake in San Jose, would only improve everything surrounding it and it would also create more value for the neighborhood.
This Lake can be a place where people can rent paddle boats and create memories. The lake can become a destination where people from other parts of town come to visit. It would enrich the area.

As a 40 year resident of East San Jose I remember a time when my son was able to sail on Lake Cunningham. I remember when it was a joy to walk around the lake with water sparkling and little algae covering the shore. We on the East Side deserve to have a lake that is as well cared for as Lake Almaden.

Dear San Jose City Council
I am writing to you regarding an environmental equity issue. Do not shift funding that would allow the city to take a step toward improved water quality at Lake Cunningham. Further delaying any action would be a continued injustice.
I'd love to go spend more time at lake Cunningham park, but there's not much to do there, nor is there tons of shade.
I ask that you not shift the $3.2 million in funding previously designated for water quality improvement that would allow the City to begin a path to improved water quality at Lake Cunningham. This 50-acre open space is a vital resource for all San Jose residents. After years of deteriorating water quality and major fish die-offs, the lake was closed down, taking away open space and unmatched recreational activities for families and residents of all ages. Our families deserve more access to open space, not less. Our families deserve investments in water quality improvements. Our families deserve nearby access to recreational activities. Now is the time to begin working toward improved water quality, not time to shift these funds to potential construction projects or other potential uses.

Dear City Council,
I join 1,100+ community members in urging you to use a city-led community engagement process for any development of areas zoned Private Recreation and Open Space, including the 114 acre Pleasant Hills Golf Course site.
Use a city-driven and very robust community engagement and visioning process like you are doing for sites a fraction of the size. The city and community should drive that process, not the developer. Please also ensure any future plans for this site include dedication of a significant percentage of the site for public open space.

I am saddened that the nearest park to my home is so underfunded and dilapidated. I have gone for walks and runs, but every time, the park is dirty and never cleaned. The lake itself is lacking sanitation and cleanliness. It's impossible to walk around the lake without stepping in wild animal excrement.
I ask that you not shift the $3.2 million in funding previously designated for water quality improvement that would allow the City to begin a path to improved water quality at Lake Cunningham.

Re: Agenda Item 3.5 - Measure T Status Report
Dear Mayor Mahan and Councilmembers,
The Sierra Club Loma Prieta Chapter urges the Council to approve the memo from Councilmembers Candelas and Ortiz to maintain the City’s commitment to improving water quality at Lake Cunningham through Measure T funding. Please do not take the $3.2M in Measure T funds that was committed to improving water quality at a park located in a low- income community of color.
In 2018, the Sierra Club, with other organizations, engaged and mobilized our members and supporters to promote Measure T and provide information to voters. This $650M infrastructure bond measure allocated $50M for natural flood and water quality protection. With the City of San Jose, we celebrated the resulting acquisition of 937 acres of open space and farmland in North Coyote Valley for permanent conservation. The remaining $3.2M in the “Environmental and Flood Protection Projects” funding category should be dedicated to water quality projects, as envisioned in Measure T.
We support the allocation of the remaining $3.2M to improve the water quality at Lake Cunningham Park, which provides open space and recreation opportunities, as well as habitat restoration opportunities, to the less affluent community of East San Jose. Water quality in the lake has degraded so much that it has become toxic to fish and wildlife, and swimming and even boating have been prohibited for health and safety reasons. This is both an environmental embarrassment and an equity issue that San Jose should cure. The $3.2 million in environmental funding will help begin the path to improved water quality.
Lake Cunningham is not only a recreational resource, it is a remnant of San Jose’s historical geomorphology and heritage. Lake Cunningham was once known as Laguna Socayre, a wetland where creeks merged to support willow thickets and a rich fauna of fish, birds and wildlife. A project to restore water quality in Lake Cunningham could include constructed

Re: Agenda Item 3.5 -- Measure T Status Report
Dear Mayor Mahan and Councilmembers,
The undersigned organizations urge the Council to approve the memo from Councilmembers Candelas and Ortiz and maintain the City’s commitment to improving water quality at Lake Cunningham through Measure T funding. Please do not take away the $3.2M in Measure T funds that was previously committed to improving water quality at a park located in a low-income community of color.
Background
In 2018, San Jose voters overwhelmingly approved Measure T, a $650M infrastructure bond measure. In a groundbreaking move, $50M of that funding was designated by the City Council for natural flood and water quality protection, focused primarily on Coyote Valley. The 2019 acquisition of 937 acres of open space and farmland in North Coyote Valley for permanent conservation used less than the full $50M, leaving $3.2M unused in the “Environmental and Flood Protection Projects” funding category. In 2021, the Council unanimously voted to keep that $3.2M dedicated to water quality projects, such as improving the water quality of Lake
Cunningham – a purpose that is aligned with Measure T’s language concerning funds for natural flood and water quality protection.
This funding was always intended to be used for environmental protection. The vast majority of Measure T funding has already been used for other infrastructure projects. Voters were told in 2018 that $50M of the funding would go towards natural flood and water quality protection, and the Council reaffirmed that commitment in 2021. The City should not abandon that commitment to the voters by taking this $3.2M away from environmental protection and using it for other purposes.
Importance of Lake Cunningham
For generations, Lake Cunningham served as one of the primary open space recreation areas for the East Side. Families who could not afford weekends at Lake Tahoe had their own lake, in their own neighborhood, where they could swim, boat, and hold weddings and quinceañeras.
But for decades, water quality in Lake Cunningham has been degrading to the point where now, swimming and even boating have been prohibited for health and safety reasons. This is both an environmental disaster and a major inequity inflicted upon a low-income community of color.
The $3.2 million in environmental funding will help begin the path to improved water quality.
Furthermore, restoring the water quality in Lake Cunningham is an important natural resource issue. The area surrounding Lake Cunningham was once a freshwater marsh known as Laguna Socayre. Streams coming down from the hills spread out in the several thousand acres of bottomlands that lay at the foot of the alluvial fans, and formed wetland complexes where discontinuous streams interspersed with willow thickets. Lake Cunningham is not only a recreational resource; it is a significant remnant of San Jose’s historical wetlands, and as such could be providing valuable ecosystem benefits to the region, including flood protection, habitat, and climate resilience.
We urge the Council not to walk back the commitment made in June 2021 for the use of the $3.2M in funding for water quality improvement. Please reaffirm the Council commitment to the voters to use this funding for prevention of water quality contamination.
Sincerely,
Alice Kaufman, Policy and Advocacy Director
