RECOMMENDATION
Approve an amendment to the January - June 2023 Public Safety, Finance and Strategic Support (PSFSS) Committee Work Plan to move the following item from the April 20, 2023 PSFSS Committee meeting agenda to the June 15, 2023 PSFSS Committee meeting agenda:
Response to the Investigations of Police Misconduct in San José Report by Moeel, Lah, Fakhoury, LLP.
Purpose: Provide a report responding to the Investigations of Police Misconduct in San José report by Moeel, Lah, Fakhoury, LLP. (City Manager/Independent Police Auditor)
BACKGROUND
Response to the Investigations of Police Misconduct in San José Report by Moeel, Lah, Fakhoury, LLP.
At the December 13, 2023 City Council meeting, under item 4.1, the City Council considered a consultant report on Investigations of Police Misconduct in San José prepared by Moeel, Lah, Fakhoury, LLP. The report analyzed options for establishing civilian investigations of police misconduct, conducted by investigators not employed by the Police Department. The report recommended the City adopt a hybrid investigatory model under which the Police Department would continue to investigate misconduct through its Internal Affairs Unit, and the Independent Police Auditor (IPA) would gain the ability conduct investigations of police misconduct using civilian investigators.

RULES AND OPEN GOVERNMENT COMMITTEE
April 5, 2023
Subject: Update to the January – June 2023 Public Safety, Finance and Strategic Support Committee Work Plan
The City Council accepted the report and directed the Administration and the IPA to return to the PSFSS Committee in April 2023 with an analysis of the implementation steps necessary to implement the hybrid model. Pursuant to recent discussions with the City Attorney and the IPA, the Administration believes that more time is necessary to bring forward a fully vetted and coordinated report. As such, the Administration recommends deferring this item to the June 15, 2023 PSFSS Committee meeting.
