Jennifer Schembri, Jennifer Maguire:

I am sending this to you as authors of the City of San Jose’s COVID-19 Mandatory Vaccinaon policy as well as to the official City Manager, HR, and Emergency Services addresses, since I did not receive a response from Ray Riordan from Emergency Services, who authored the memorandum and resoluon to end the emergency at the upcoming City Council meeng.

Please answer: Will the City of San Jose’s COVID-19 Mandatory Vaccinaon requirement end with the terminaon of the City’s COVID- 19 emergency?

See item 1.3.12 here for a link to the policy in queson:

If not, when is the COVID-19 Mandatory Vaccinaon requirement set to expire? It had beer end no later than May 16, when the emergency proclamaon is set to be terminated by the City Council of San Jose. That said, I believe that item does not even need a vote from the City Council since the emergency is conngent on the State and Naonal emergencies, both of which have expired as of today (see Ray’s memorandum linked below).

Another reason why you have to eliminate this policy now is that this policy requires vaccinaons (original “monovalent” primary series) that are no longer recommended by the CDC. Also, the Biden administraon has rescinded its COVID-19 vaccinaon requirement for federal employees and contractors, so what are you waing for?

Please, when are you going to end mandatory vaccinaon in the City of San Jose? Emergency or not, it is wrong, because everyone now knows these vaccinaons do not stop the spread of the disease at all, and more importantly people have their own ways of staying healthy that you need to respect, the same way you make respecng personal dietary restricons part of your Wellness Policy (1.3.13).

What is doubly wrong is that the policy portends to apply to members of boards and commiees for the City of San Jose. What even gives the Director of Human Resources the right to do that? This is downright polical oppression if you ask me.

If you are going to have any vaccinaon policy, parcipaon must be oponal, as with your Wellness Policy. People have many ways of staying healthy. Just like love is love, health is health. You can’t say that vaccinaon is the best way to stay healthy, that it is more important than good diet, more important than physical exercise and other things you advocate in your Wellness Policy.

Anyway, Ms. Schembri and Ms. Maguire, your Office of Employee Relaons needs to do away with the COVID-19 Mandatory Vaccinaon policy. Do it now. Don’t even wait for the City Council to direct you to do this as I have already asked them.

Hoping to see some acon on this by Monday.

Would the end of the emergency declaraon also end the Mandatory COVID-19 Requirement for employees? If not, why not?

Your neighbor,

Alex
