ORDINANCE NO.
AN UNCODIFIED ORDINANCE OF THE CITY OF
SAN JOSE ESTABLISHING CHARGES FOR POTABLE
WATER SERVICE AND RECYCLED WATER SERVICE
EFFECTIVE JULY 1, 2023, SPECIFIED IN THE
RESOLUTIONS
WHEREAS, on June 6, 2023, the City Council adopted resolutions establishing rates and charges for potable water service and recycled water service provided by the San José Municipal Water System effective July 1, 2023; and
WHEREAS, this Ordinance was found to be categorically exempt from environmental review per the provisions of Section 15273 of the California Environmental Quality Act of 1970, as amended, under File No. PP17-005;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SAN JOSE:
SECTION 1. The City Council hereby adopts the findings and amounts of the rates and charges for potable water service provided by the San José Municipal Water System specified in Resolution No. _____ and the rates and charges for recycled water service provided by the San José Municipal Water System specified in Resolution No. _____ adopted on June 6, 2023.
SECTION 2. The fees, charges, and rates for the San José Municipal Water System specified in Resolution No. _____ and Resolution No. _____ and incorporated into this Ordinance are for property related services as provided in the California Constitution, Article XIIID, or for reasonable charges for a specific local government service or product provided directly to the payor that is not provided to those not charged.

SECTION 3. The provisions of this Ordinance shall take effect retroactive to July 1, 2023.
SECTION 4. The rates and charges for potable water service and recycled water service provided by the San José Municipal Water System shall continue until modified or superseded by either resolution or ordinance.
