ORDINANCE NO.
AN UNCODIFIED ORDINANCE OF THE CITY OF SAN
JOSE ADOPTING SERVICE RATES FOR THE
RESIDENTIAL GARBAGE AND RECYCLING PROGRAM
EFFECTIVE JULY 1, 2023, AS SPECIFIED IN THE
RESOLUTION
WHEREAS, on June 6, 2023, the City Council adopted a resolution adopting Service Rates for the Residential Garbage and Recycling Program effective July 1, 2023; and
WHEREAS, this Ordinance was found to be categorically exempt from environmental review per the provisions of Section 15273 of the California Environmental Quality Act of 1970, as amended, under File No. PP17-005;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SAN JOSE:
SECTION 1. The City Council hereby adopts the findings and amounts of the Service Rates for the Residential Garbage and Recycling Program specified in Resolution No. _____, adopted on June 6, 2023.
SECTION 2. The Service Rates for the Residential Garbage and Recycling Program specified in Resolution No. _____ and this Ordinance are for property related services as provided in the California Constitution, Article XIIID, or for reasonable charges for a specific local government service or product provided directly to the payor that is not provided to those not charged.
SECTION 3. The provisions of this Ordinance shall take effect retroactive to July 1, 2023.

SECTION 4. The Service Rates for the Residential Garbage and Recycling Program shall continue until modified or superseded by either resolution or ordinance.
