SUBJECT: ACTIONS RELATED TO CITYWIDE OPEN PURCHASE ORDER WITH AT&T FOR

FIRSTNET PRODUCTS AND SERVICES
RECOMMENDATION:

Adopt a resolution authorizing the City Manager to:

(a) Amend Citywide open purchase order OP 62482 with AT&T (Atlanta, GA) for the purchase of as- required AT&T FirstNet products and services through CalNet to increase compensation by $1,000,000 for a revised maximum compensation of $3,500,000 for the current option ending August 7, 2023, subject to the appropriation of funds.

(b) Negotiate and execute additional annual options to extend the purchase order as required, subject to the appropriation of funds.

(c) Negotiate and execute FirstNet-related contract documentation as required, subject to the appropriation of funds.

BASIS FOR RECOMMENDATION:

The State of California Department of Technology Services procures deeply discounted telecommunication services through volume purchases on its own behalf as well as other government agencies. These competitively bid contracts are collectively known as “CalNet.” In August 2014,1 City Council authorized staff to execute multiple master services agreements and other enrollment documentation for the City to participate in the CalNet program pursuant to Section 4.12.225 (B.3) of the San José Municipal Code, which allows the City to purchase from vendors on terms obtained by another public agency’s competitive process that substantially complies with City procurement procedures. The CalNet contracts provide easy access to telecommunications and network products and services, including FirstNet.

FirstNet is a nationwide wireless broadband network for first responders built and deployed through a public- private partnership between the federal government and AT&T after a competitively bid process. The FirstNet network uses a specific wireless frequency band reserved for use only by emergency responders in the event of an emergency. This provides reliable voice and data connectivity during emergencies and disasters by avoiding the congestion of the public cellular network and enables maximum interoperability between San José and other jurisdictions for emergency responders.

1 2014 City Council Resolution 77124: https://records.sanjoseca.gov/Resolutions/RES77124.PDF

COUNCIL AGENDA: 6/20/23
FILE: 23-909
ITEM: 2.19

In June 2019,2 City Council approved the FirstNet deployment. At the time, staff estimated startup costs of approximately $2.2 million for device acquisition, equipment installation, network development, and telecommunications voice and data plan charges. It was also expected that costs for ongoing services and expansion as required would not surpass $2.5 million per year.

As part of enhanced public safety planning efforts, multiple City departments now need to refresh their FirstNet mobile equipment and purchase compact rapid deployable devices to provide critical cellular and internet coverage in the event of an emergency. The FirstNet compact rapid deployable devices generate an area of cellular, Wi-Fi, and internet coverage in any location by utilizing satellite connectivity and a built-in generator. These devices were not available in 2019, but have since been developed to augment public safety management services when faced with impacts to infrastructure due to disasters, such as major wildfires, floods, and earthquakes. Purchase of these devices will exceed the previously approved FirstNet annual maximum compensation of $2.5 million.

Approval of this recommendation authorizes staff to amend the current purchase order with AT&T to increase available funds, issue additional one-year options to extend the term of the purchase order, and execute FirstNet contract documentation as required, subject to the appropriation of funds.

Commission Recommendation/Input: There is no commission recommendation or input associated with this action.

COST AND FUNDING SOURCE:

Various departments, as appropriated. Ordering on this open purchase order is managed by the Information Technology Department. Each department places orders through the Information Technology Department as required, subject to the appropriation of funds.
