COUNCIL AGENDA: June 20, 2023
FILE NO.: 2.10
ITEM: 23-893

TO: CITY COUNCIL FROM: Toni J. Taber, CMC
City Clerk

SUBJECT: APPROVAL OF UPDATED DATE: May 25, 2023

CAMPAIGN CONTRIBUTION
LIMITS

RECOMMENDATION

Adopt the resolution approving the updated campaign contribution limits in accordance with San José Municipal Code Section 12.06.210.C.

OUTCOME

Approval of the recommendation will update the campaign contribution limits for the Primary Municipal Election to be held on March 5, 2024 and the General Municipal Election to be held on November 5, 2024.

BACKGROUND

On March 5, 2019, the City Council adopted Ordinance 30231 amending section 12.06.210 of Title 12 of the San José Municipal Code (SJMC) in response to the movement of the State primary to March of even numbered years. As part of that Ordinance, Section 12.06.210.D directed the City Clerk to recalculate the campaign contribution limits based on the Consumer Price Index (CPI) for the San Francisco-Oakland-San José area for the month that is at least two hundred and eighty days (280) days before the regularly scheduled primary municipal election and round to the nearest one hundred dollars. Each adjustment period begins with the CPI as reported in December 2010 and the CPI reported for the month that is at least two hundred and eighty days (280) days before the regularly scheduled primary municipal election.

ANALYSIS

On March 30, 2023, the 280th day before the March 5, 2024 election, the City Clerk accessed the currently reported CPI in effect at the Bureau of Labor Statistics:
https://www.bls.gov/regions/west/news-release/consumerpriceindex_sanfrancisco.htm. The CPI change is calculated by subtracting the CPI from December 2010 from the current CPI, and dividing to find the percentage change. That percentage change is then applied to the base of $500.
