A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
JOSE AUTHORIZING “FREE USE” FOR EVENTS AND
ACTIVITIES HELD AT CITY HALL ON WEDNESDAY
AUGUST 23, 2023 FOR THE USA GYMNASTICS
NATIONAL CHAMPIONSHIP WELCOME RECEPTION
EVENT CO-HOSTED BY COUNCIL DISTRICT 9 AND THE
SAN JOSE SPORTS AUTHORITY
WHEREAS, in June 2019, the City adopted Schedule of Fees Resolution No. 79138 for the fees and charges for City Hall Facility and Plaza Use; and
WHEREAS, Resolution No. 79138 authorizes City Departments to have “Free Use” of the City Hall Facility and Plaza for events that 1) qualify as official City business; 2) are free and open to the public; 3) occur on a Sunday through Friday; and 4) are booked thirty (30) days in advance; and
WHEREAS, Council District 9 and the San Jose Sports Authority will co-host the USA Gymnastics National Championship Welcome Reception, a private, invitation-only event at the City Hall Rotunda on Wednesday, August 23, 2023, attended by members of USA Gymnastics, the San Jose Sports Authority, and elected officials; and
WHEREAS, the 2023 USA Gymnastics National Championships will take place at the SAP Center from Thursday, August 24 to Sunday, August 27, 2023 and run concurrently with the USA Gymnastics National Congress and Trade Show in the San Jose McEnery Convention Center, which is expected to have over 2,000 attendees; and
WHEREAS, the purpose of the Welcome Reception is to welcome the 2023 USA Gymnastics National Championship to San José, to commemorate this special sporting event, and increase visibility for the City of San José; and

WHEREAS, “Free Use” does not apply to events which are not free and open to the public, and, therefore, Council approval is necessary to authorize free use of the City Hall Rotunda for the USA Gymnastics National Championship Welcome Reception; and
WHEREAS, the USA Gymnastics National Championship Welcome Reception occurs on a weeknight and has been booked more than thirty (30) days in advance, in compliance with Resolution No. 79138; and
WHEREAS, the City finds that the USA Gymnastics National Championship Welcome Reception qualifies as official City business through its economic benefits, increased visibility of San Jose as a successful host city for world-class athletic events, a center of commerce, and in bringing together thousands of community stakeholders from around the country; and
WHEREAS, the City desires to allow for the free use of the City Hall Rotunda for the USA Gymnastics National Championship Welcome Reception on Wednesday, August 23, 2023;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:
The City Council hereby authorizes “Free Use” of the City Hall Rotunda for the USA Gymnastics National Championship Welcome Reception on Wednesday, August 23, 2023, co-hosted by City Council District 9 and the San Jose Sports Authority, because of the public benefit that the Welcome Reception and accompanying USA Gymnastics National Championships and USA Gymnastics National Congress and Trade Show events will provide to the City of San Jose.
