A RESOLUTION OF THE COUNCIL OF THE CITY OF
SAN JOSE APPROVING THE NAMING OF DACE WAY,
AN APPROXIMATELY 1,350-FOOT-LONG PRIVATE
DRIVEWAY LOCATED ON THE EAST SIDE OF
OAKLAND ROAD AT ROCK AVENUE (2060-2110
OAKLAND ROAD), EXTENDING 400 FEET EASTERLY
FROM THE INTERSECTION OF OAKLAND ROAD AND
ROCK AVENUE, CONTINUING 500 FEET NORTHERLY,
THEN 450 FEET WESTERLY, CONNECTING BACK TO
OAKLAND ROAD

WHEREAS, the applicant, Carletta Cooley, on behalf of the property owner, Bible Way Christian Center, has requested the Street Naming of an approximately 1,350-foot-long private driveway on said property to Dace Way; and
WHEREAS, said driveway is already constructed, and located on the east side of Oakland Road at Rock Avenue, from 2060, 2090 and 2110 Oakland Road, as shown in Exhibit “A” attached hereto; and
WHEREAS, pursuant to City Council Policy 6-5 entitled “Street Naming and Renaming” (“Council Policy 6-5”), the City Council is responsible for the naming and renaming of public streets, boulevards, avenues, drives, courts, circles, and other public and private rights-of-way; and
WHEREAS, the City’s Director of Planning, Building and Code Enforcement has determined that this proposed action is exempt from the provisions of the California Environmental Quality Act of 1970, as amended, under Section 15301(c) for Existing Facilities;

WHEREAS, Bible Way Christian Center and Mass Precision are the owners of all parcels that are currently accessed from the private driveway, and the City has received written confirmation from Mass Precision that they support the naming of the private driveway to Dace Way; and
WHEREAS, pursuant to Council Policy 6-5, the Department of Planning, Building and Code Enforcement determined the proposed naming to Dace Way is a naming of a minor private street and therefore, subject to a more streamlined process since not more than twenty (20) occupied parcels are affected by the proposed naming; and
WHEREAS, pursuant to the Council Policy 6-30 entitled “Public Outreach Policy for Pending Land Use and Development Proposals” (“Council Policy 6-30”), Bible Way Christian Center posted a sign at the site notifying the public of the proposed street naming and identifying how to obtain additional information or submit comments; and
WHEREAS, pursuant to and in accordance with Chapter 20.100 of Title 20 of the San José Municipal Code, this City Council conducted a hearing on said application, notice of which was duly given; and
WHEREAS, at said hearing, this City Council gave all persons full opportunity to be heard and to present evidence and testimony respecting said matter; and
WHEREAS, at said hearing, this City Council received and considered all of the comments, reports and recommendations of the City’s Director of Planning, Building and Code Enforcement; and
WHEREAS, pursuant to provisions of Section 15061(b)(3) Review for Exemption of the State Guidelines for Implementation of the California Environmental Quality Act of 1970 NVF:AXY:DJF

(CEQA), this project is found to be exempt from the environmental review requirements of Title 21 of the San José Municipal Code, implementing CEQA, as amended;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE:
SECTION 1: Pursuant to the provisions of Section 34091.1 of the Government Code of the State of California, this Council does hereby find and determine that the approximately 1,350-foot-long private driveway, as indicated on Exhibit “A” hereto, shall be named as “Dace Way”, located on the east side of Oakland Road at Rock Avenue, encircling the buildings at 2060, 2090, and 2110 Oakland Road and that said City Council does hereby name said private driveway upon the date of adoption of this Resolution.
SECTION 2: The City Clerk is hereby directed to deliver a copy of this resolution to the Board of Supervisors of the County of Santa Clara.
