A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
JOSE AUTHORIZING “FREE USE” FOR EVENTS AND
ACTIVITIES HELD AT CITY HALL ON WEDNESDAY
OCTOBER 4, 2023, FOR THE 2023 CODASUMMIT: ART,
TECHNOLOGY, AND PLACE OPENING NIGHT
RECEPTION CO-HOSTED BY THE OFFICE OF
ECONOMIC DEVELOPMENT AND CULTURAL AFFAIRS
AND CODAWORKX
WHEREAS, in June 2019, the City adopted Schedule of Fees Resolution No. 79138 for the fees and charges for City Hall Facility and Plaza Use; and
WHEREAS, Resolution No. 79138 authorizes City Departments to have “Free Use” of the City Hall Facility and Plaza for events that 1) qualify as official City business; 2) are free and open to the public; 3) occur on a Sunday through Friday; and 4) are booked thirty (30) days in advance; and
WHEREAS, the Office of Economic Development and Cultural Affairs submitted a successful bid proposal to CODAworx, which, following a competitive process, resulted in the selection of the City of San José to host the international 2023 CODAsummit: Art, Technology, and Place conference by CODAworx at the Hammer Theatre Center on Wednesday, October 4 through Friday, October 6, 2023, which includes the Opening Night Reception, presentations, showcases, panel discussions and public art tours; and
WHEREAS, CODAworx is charging attendees $750 to attend the reception, conference, and related activities; and
WHEREAS, the Opening Night Reception, which will kick off the two-and-half-day CODAsummit Conference, is co-sponsored by the City of San José, Office of Economic Development and Cultural Affairs and CODAworkx, and is a private, ticketed event at NVF:NXN:DDH

WHEREAS, the 2023 CODAsummit: Art, Technology, and Place Opening Night Reception occurs on a weeknight and has been booked more than thirty (30) days in advance, in compliance with Resolution No. 79138; and
WHEREAS, “Free Use” does not apply to events which are not free and open to the public, and, therefore, Council approval is necessary to authorize free use of the City Hall Facilities for the 2023 CODAsummit: Art, Technology, and Place Opening Night Reception; and
WHEREAS, “Free Use” is being requested because of the public benefit the Opening Night Reception and accompanying Conference will bring to the City, which aligns with connecting and celebrating San José’s creative culture and strengthening San José’s brand within the City’s economic and cultural development goals; and
WHEREAS, the City finds that the 2023 CODAsummit: Art, Technology, and Place Opening Night Reception qualifies as official City business through its economic benefits, increased visibility of San José as a leading art and technology destination, and in bringing together internationally known artists, creative entrepreneurs, innovators, public art administrators, and thought leaders in San José; and
WHEREAS, the City desires to allow for the free use of the City Hall Facilities (City Hall Rotunda and parking in the City Hall Garage and the 4th Street Garage) for the 2023 CODAsummit: Art, Technology, and Place Opening Night Reception on Wednesday, October 4, 2023.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:
The City Council hereby authorizes “Free Use” of the City Hall Facilities (City Hall Rotunda and parking in the City Hall Garage and the 4th Street Garage) on Wednesday, October 4, 2023 for the 2023 CODAsummit: Art, Technology, and Place Opening Night Reception, co-hosted by the Office of Economic Development and Cultural Affairs, as official City business because of the public benefit that the Opening Night Reception and accompanying Conference events will provide to the City of San José.
