JOINT MEETING OF THE RULES AND OPEN GOVERNMENT COMMITTEE AND
COMMITTEE OF THE WHOLE
SAN JOSE, CALIFORNIA WEDNESDAY, SEPTEMBER 6, 2023
The Committee meeting was held in a hybrid format, both in person in the Council Chambers and teleconferenced from remote locations. The meeting convened at 2:00 p.m.
Present: Councilmembers - Kamei, Davis, Jimenez, Foley, Cohen.
Absent: Councilmembers - All present.
Staff: Assistant City Manager, Lee Wilcox; City Attorney, Nora Frimann; City Clerk, Toni Taber; City Manager’s Office, Rachelle Blattman; and Deputy City Clerk, Grace Turner.
A. City Council (City Clerk)
1. Review September 12, 2023 Final Agenda
a) Add new items to Final Agenda
b) Assign “Time Certain” to Agenda Items (if needed)
c) Review of Notice of Waiver Requests for Agenda Items or Documents (if needed) Public Comments: None provided.
Action: Upon motion by Councilmember Pam Foley, seconded by Councilmember Dev Davis, and carried unanimously, the Committee approved the final agenda for the City Council meeting on September 12, 2023 with the Add Sheet, adding the “Boards and Commissions Appointment.” Item to the September 12, 2023 City Council Agenda. (5-0-0)
2. Review September 19, 2023 Draft Agenda
a) Add new items to Final Agenda
b) Assign “Time Certain” to Agenda Items (if needed)

Action: Upon motion by Councilmember Pam Foley, seconded by Vice Mayor Rosemary Kamei, and carried unanimously, the Committee approved the draft agenda for the City Council meeting on August 15, 2023. (5-0-0)
B. Consent Calendar
Action: Upon motion by Councilmember Dev Davis, seconded by Councilmember Pam Foley, and carried unanimously, the Consent Calendar was approved. (5-0.) Public Comment: None provided.
1. The Public Record for August 24 – August 31, 2023. (City Clerk) The Public Record for August 24 – August 31, 2023 was noted and filed.
2. Approval of “Free Use” of City Hall West Plaza and Rotunda for the 2023 Plaza Azul Farmer’s Market Series. (Davis and Torres)
The recommendation to adopt a resolution authorizing “Free Use” for the Plaza Azul Farmer’s Market series held at the City Hall West Plaza every Tuesday, August 29-November 14, 2023, cohosted by Councilmember Davis’ office, Councilmember Torres’ office, and the Office of Economic Development and Cultural Affairs was approved for placement on the September 12, 2023 Council Agenda.
3. Approval of Rotunda and Tower Lighting on September 13-14, 2023 to Recognize September 15-17, 2023 as San Jose Fallen Firefighters Memorial Weekend, Sponsored by Councilmember Doan’s Office as a City Council Sponsored Special Event to Expend City Funds. (Doan) The Rotunda and Tower Lighting to recognize September 15-17, 2023 as San Jose Fallen Firefighters Memorial Weekend, scheduled on September 13-14, 2023, sponsored by Council District 7, were approved for placement on the September 12, 2023 Council Agenda.
4. Retroactive Approval of the Berryessa Community Movie Night as a City Council Sponsored Special Event to Expend City Funds and Accept Donations of Materials and Services for the Events. (Cohen)
The Berryessa Community Movie Night scheduled on July 29, 2023, sponsored by Council District 4, were retroactively approved for placement on the September 12, 2023 Council Agenda.
