A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
JOSE AUTHORIZING “FREE USE” OF THE CITY HALL
WEST PLAZA AND ROTUNDA FOR THE 2023 PLAZA
AZUL FARMER’S MARKET SERIES FROM AUGUST 29,
2023 THROUGH NOVEMBER 14, 2023
WHEREAS, on June 11, 2019, the City Council adopted Schedule of Fees Resolution No. 79138 for the fees and charges for City Hall Facility and Plaza Use; and
WHEREAS, Resolution No. 79138 authorizes City Departments to have “Free Use” of the City Hall Facility and Plaza for events that 1) qualify as official City business; 2) are free and open to the public; 3) occur on a Sunday through Friday; and 4) are booked thirty (30) days in advance; and
WHEREAS, “Free Use” does not apply to events which are recurring weekly events involving commercial activities, therefore, Council approval is necessary to authorize free use of the City Hall West Plaza and Rotunda for the 2023 Plaza Azul Farmer’s Market Series (Event); and
WHEREAS, Council District 3, Council District 6, and the Office of Economic Development and Cultural Affairs will co-host the Event, which will be held every Tuesday from August 29, 2023 through November 14, 2023; and
WHEREAS, the purpose of the Event is to provide the San Jose downtown community with access to purchase fresh, healthy produce, promote sustainable changes, encourage a healthy lifestyle, to promote civic pride, and support small and local businesses, including vendors from the Berryessa Flea Market;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:
The City Council hereby authorizes “Free Use” of the City Hall West Plaza and Rotunda for the 2023 Plaza Azul Farmer’s Market Series from August 29, 2023 through November 14, 2023, co-hosted by City Council Districts 3 and 6 and the Office of Economic Development and Cultural Affairs, because of the public benefit the Plaza Azul Farmer’s Market Series will provide to the City of San José and its downtown by helping drive economic development to make San José a more vibrant place to live, work, shop, eat, and visit, and by increasing visibility and drive foot traffic and tourism to the City’s downtown.
