BACKGROUND

The City Pay Plan must be amended by City Council resolution when new job classifications are added or deleted and when salaries are revised. The City Pay Plan reflects all job classification and compensation changes made through a City Council resolution. The City Pay Plan is on file in the Human Resources Department and published on the City’s internet and intranet sites.

ANALYSIS

Regional Wastewater Facility General Manager
The San José-Santa Clara Regional Wastewater Facility is jointly owned by the cities of San José and Santa Clara and managed by San José’s Environmental Services Department. The Environmental Services Department requested the creation of a Regional Wastewater Facility General Manager classification (Attachment A - Regional Wastewater Facility General Manager (U) (3628)) in order to recruit and hire a candidate with directly related wastewater experience or an industrial facility background to oversee the Regional Wastewater Facility operations. This request was made due to multiple unsuccessful recruitment efforts to fill this position using the general Deputy Director and the Wastewater Facility Deputy Director classifications. Although the Wastewater Facility Deputy Director classification was specific to wastewater, it did not adequately represent the scope of work and level of responsibility required to manage the Regional Wastewater Facility that serves eight cities with 1.4 million residents and a business sector with more than 17,000 main sewer connections. It is essential to the Environmental Services Department that a potential candidate have experience managing a large facility with a considerable number of employees, as the Regional Wastewater Facility is the largest advanced wastewater treatment facility on the West Coast employing over 260 full-time equivalent positions. The Environmental Services Department and Human Resources recommend the creation of the new Regional Wastewater Facility General Manager classification because the new job description illustrates the unique role of the position and will yield a better-qualified candidate pool when recruiting for this vacancy.

The proposed annual pensionable salary range of $162,036.61 - $261,760.05 for the Regional Wastewater Facility General Manager is approximately 5% higher than the classification of Wastewater Facility Deputy Director, as the new classification is intended to compensate for the technical expertise required for the position.

The Wastewater Facility Deputy Director classification will be deleted (see below) and the Environmental Services Department will utilize the new Regional Wastewater Facility General Manager classification.

Chemist II and Microbiologist II
In recognition of the recruitment and retention issues for the Chemist and Microbiologist classification specifications, the Environmental Services Department and Human Resources staff revised the classification specifications to lower the experience requirement to allow for a broader candidate pool. Additionally, Human Resources reviewed classification descriptions for

the Chemist and Microbiologist classifications from comparable Bay Area Municipal/County wastewater laboratories. This analysis showed that the City is under market and the majority of the comparators have flexibly staffed classifications for Chemist and Microbiologist. The City and the Municipal Employees’ Federation agreed that Chemist I/II (Attachment B - Chemist I/II (5116/5106)) and Microbiologist I/II (Attachment C - Microbiologist I/II (5115/5105) flexibly staffed series would be created based on comparable market data. The creation of the level II also allows for promotional opportunities for internal candidates, addressing current recruitment and retention issues. On September 12, 2023, the City Council approved a tentative agreement on a successor Memorandum of Agreement between the City and the Municipal Employees’ Federation, AFSCME, Local 101 that included the establishment of the salary ranges for the Chemist II and Microbiologist II classifications. This memorandum memorializes the formal creation of these classifications in the City’s Pay Plan.

Legal Administrative Assistant III

As part of the City’s regular review of classification specifications, staff drafted updates to the Legal Administrative Assistant Trainee/I/II classification specifications. During the review, it was determined that the current minimum qualifications for the Legal Administrative Assistant I class do not meet the specialized needs of the hiring department, the City Attorney’s Office. As a result, the minimum qualifications have been increased for the Legal Administrative Assistant I class. Administration recommends deletion of the Legal Administrative Assistant Trainee position (see below) and the creation of a higher-level classification, Legal Administrative Assistant III (Attachment D - Legal Administrative Assistant I/II/III FT/PT (1167/1153/1168/1154/1169)), that requires higher technical expertise to meet the current demands of the City Attorney’s Office Support Services. On September 12, 2023, the City Council approved a tentative agreement on a successor Memorandum of Agreement between the City and Municipal Employees’ Federation that included an agreement to create the Legal Administrative Assistant III classification.

Deletion of Classifications

Recreation Supervisor
On or about June 17, 2022, the City and the City Association of Management Personnel, IFPTE, Local 21 agreed to a side letter agreement to consolidate the Recreation Supervisor classification, and all current incumbents in that classification, into the Parks Facilities Supervisor classification that was retitled to Parks, Recreation, and Facilities Supervisor, effective August 21, 2022.

Therefore, the Recreation Supervisor classification will be deleted.

Legal Administrative Assistant Trainee
The City identified that the Legal Administrative Assistant Trainee classification is currently not in use and has not been used in over 15 years. Therefore, this classification will be deleted.

Wastewater Facility Deputy Director
The Wastewater Facility Deputy Director classification will be deleted as it will no longer be used.

EVALUATION AND FOLLOW-UP

No further follow-up with City Council related to this action is anticipated at this time.

COST SUMMARY/IMPLICATIONS

Regional Wastewater Facility General Manager
The Regional Wastewater Facility General Manager is a specialized classification in the San José-Santa Clara Regional Wastewater Facility within the Environmental Services Department. The currently budgeted Wastewater Facility Deputy Director position will be deleted and a Regional Wastewater Facility General Manager classification will be added, which will result in additional costs of approximately $12,500. There is no impact to the General Fund since the position is funded out of the San José-Santa Clara Treatment Plant Operating Fund. The additional costs will be absorbed within the Environmental Services Department’s existing budget and included in the development of the 2024-2025 Base Budget.

Chemist I/II and Microbiologist I/II
As noted above, the City Council previously approved a tentative agreement between the City and Municipal Employees’ Federation that included establishing the Chemist II and Microbiologist II rates of pay and the associated costs were contemplated in that agreement. The City Council’s approval of this item will not result in any additional costs beyond those approved by the City Council as part of Item 3.4 on the September 12, 2023 City Council agenda.

Legal Administrative Assistant III
While an agreement to create the Legal Administrative Assistant III classification was part of the tentative agreement on a successor Memorandum of Agreement that the City Council approved on September 12, 2023, the cost associated with the classification was not contemplated in that agreement. The City Attorney’s Office currently has eight incumbents and one vacant position in the Legal Administrative Assistant II classification. The City Attorney’s Office identified approximately three incumbents to promote to the next higher Legal Administrative Assistant III flexibly staffed level. The estimated additional ongoing costs associated with the three incumbents potentially flexibly promoting into the Legal Administrative Assistant III classification is approximately $27,000 in the General Fund and will be absorbed within the City Attorney’s Office’s existing budget. These ongoing costs will be factored into the development of the 2024-2025 Base Budget.

COORDINATION

This memorandum was coordinated with the City Attorney’s Office, the City Manager’s Budget Office, and the Environmental Services Department.
