BACKGROUND

The City of San José Pay Plan must be amended by Council Resolution when new job classifications are added or deleted, or salaries are revised. The City Pay Plan reflects all job classification and compensation changes made through Council Resolution. The City Pay Plan is on file in the Human Resources Department and published on the City’s Internet and Intranet sites.

ANALYSIS

Regional Wastewater Facility General Manager
The San José/Santa Clara Regional Wastewater Facility is jointly owned by the cities of San José and Santa Clara and managed by San José’s Environmental Services Department (ESD). ESD requested the creation of a Regional Wastewater Facility General Manager classification (Attachment A) in order to recruit and hire a candidate to oversee the Regional Wastewater Facility operations with directly-related wastewater experience or an industrial facility background. This request was made due to multiple unsuccessful recruitment efforts to fill this position using the general Deputy Director and the Wastewater Facility Deputy Director classifications. Although the Wastewater Facility Deputy Director classification was specific to wastewater, it did not adequately represent the scope of work and level of responsibility required to manage the Regional Wastewater Facility which serves eight cities with 1.4 million residents and a business sector with more than 17,000 main sewer connections. It is essential to ESD that the candidate has experience managing a large facility with a considerable number of employees as this is the largest advanced wastewater treatment facility on the West Coast employing over 260 FTEs. ESD and Human Resources believe that the new Regional Wastewater Facility General Manager classification and its job description illustrates the unique role of the position and will yield a better-qualified candidate pool when recruiting for this vacancy.

The proposed annual pensionable salary range of $162,036.61 - $261,760.05 for the Regional Wastewater Facility General Manager is approximately 5% higher than the classification of Wastewater Facility Deputy Director as it is intended to compensate for the technical expertise of the position.

The Wastewater Facility Deputy Director classification will be deleted, and the Environmental Services Department will utilize the new Regional Wastewater Facility General Manager classification.

Chemist II and Microbiologist II
In recognition of the recruitment and retention issues in these classification series, the Environmental Services Department and Human Resources staff revised the classification specifications to lower the experience requirement which will allow for a broader candidate pool.

Additionally, we reviewed classification descriptions for the Chemist and Microbiologist classifications from comparable Bay Area Municipal/County Wastewater Labs. This analysis showed that we are under market and the majority of the comparators have flexibly staffed DRAFT--Contact the Office of the City Clerk at (408) 535-1260 or [email protected] for final document.

classifications for Chemist and Microbiologist. The City and the Municipal Employees’ Federation (MEF) agreed that Chemist I/II and Microbiologist I/II (Attachments B and C) flexibly staffed series would be created based on comparable market data. The creation of the level II also allows for promotional opportunities for internal candidates, addressing the current recruitment and retention issues. On September 12, 2023, the City Council approved a tentative agreement on a successor Memorandum of Agreement (MOA) between the City and the Municipal Employees’ Federation, AFSCME, Local 101 (MEF) which included the establishment of the salary ranges set forth in this memorandum for the Chemist II and Microbiologist II classifications. This memorandum is merely memorializing the formal creation of these classifications in the City’s Pay Plan.

Legal Administrative Assistant III
As part of the City’s regular review of classification specifications, staff drafted updates to the Legal Administrative Assistant Trainee/I/II classification specifications. During the review, it was determined that the current minimum qualifications for the Legal Administrative Assistant I and II classes do not meet the specialized needs of the hiring department, the City Attorney’s Office. Therefore, the minimum qualifications have been increased for these two classes and we recommend the creation of a higher-level classification, Legal Administrative Assistant III (Attachment D) requiring higher technical expertise, to meet the current demands of the City Attorney’s Office Support Services. On September 12, 2023, the City Council approved a tentative agreement on a successor MOA between the City and MEF which included an agreement to create the Legal Administrative Assistant III classification.

Deletion of Classifications

Recreation Supervisor
On or about June 17, 2022, the City and the City Association of Management Personnel, IFPTE, Local 21 (CAMP) agreed to a side letter agreement that would consolidate the Recreation Supervisor classification and all current incumbents in that classification into the Parks Facilities Supervisor classification, which was retitled to Parks, Recreation, and Facilities Supervisor, effective August 21, 2022. Therefore, the Recreation Supervisor Classification will be deleted.

Legal Administrative Assistant Trainee
The City identified that the Legal Administrative Assistant Trainee classification is currently not in use and has not been used in over fifteen years. Therefore, this classification will be deleted.

Wastewater Facility Deputy Director
The Wastewater Facility Deputy Director classification will be deleted as it will no longer be used.

EVALUATION AND FOLLOW-UP

No further follow-up with City Council related to this action is anticipated at this time.

COST SUMMARY/IMPLICATIONS

Regional Wastewater Facility General Manager
The Regional Wastewater Facility General Manager is a specialized classification in the San José/Santa Clara Regional Wastewater Facility within ESD. The currently budgeted Wastewater Facility Deputy Director position will be deleted, and a Regional Wastewater Facility General Manager classification will be added, which will result in additional costs of approximately $12,500. There is no impact to the General Fund since the position is funded out of the San Jose-Santa Clara Treatment Plant Operating Fund. The additional costs would be absorbed within the Environmental Services Department’s existing budget and would be included in the development of the 2024-2025 Base Budget.

Chemist I/II and Microbiologist I/II
As noted above, the City Council previously approved a TA between the City and MEF that included establishing the Chemist II and Microbiologist II rates of pay, and the associated costs were contemplated in that memorandum. The City Council’s approval of this item will not result in any additional costs beyond those approved by the City Council as part of Item 3.4 on September 12, 2023.

Legal Administrative Assistant III
While an agreement to create the Legal Administrative Assistant III classification was part of the TA on a successor MOA that the City Council approved on September 12, 2023, the cost associated with the classification was not contemplated in that memorandum. The City Attorney’s Office currently has eight (8) incumbents and one (1) vacant position in the Legal Administrative Assistant II classification. The City Attorney’s Office has identified approximately three (3) incumbents to promote to the next higher flexibly staffed level. The estimated additional ongoing costs associated with the three incumbents potentially flexibly promoting into the Legal Administrative Assistant III classification is approximately $27,000 in the General Fund and will be absorbed within the City Attorney’s Office’s existing budget.

These ongoing costs will be factored into the development of the 2024-2025 Base Budget.
