TO: HONORABLE MAYOR FROM: Councilmember Arjun Batra

AND CITY COUNCIL

SUBJECT: SEE BELOW DATE: August 15, 2023

Approved Date August 14, 2023

SUBJECT: ORDINANCE AMENDING TITLES 2, 4, AND 26 AND ADDING TITLE 28 TO THE SAN JOSÉ MUNICIPAL CODE TO ESTABLISH A MUNICIPAL UTILITY

FOR ELECTRIC SERVICE

RECOMMENDATION

1) Approve recommendation 1(a) from the August 11th Memorandum by Councilmember Peter Ortiz and Omar Torres
2) Direct SJCE staff to return to Council on September 12th with additional information about how SJCE will impact the quality of service to the residents served by PG&E infrastructure and transmission lines.

BACKGROUND
Today, all residents and businesses in San Jose receive their electric services through PG&E transmission lines. In recent years, constituents have experienced blackouts and brownouts. By establishing a municipal utility, SJCE should explain how those residents will be served and explain any impact of SJCE establishing a municipal utility for electric service.
