I oppose Digital Billboards in San José

You don't often get email from Learn why this is important Dear Mayor Mahan and San Jose City Council Members,
I am writing to urge you to oppose any new billboard proposals in our community. My reasons are below:

Billboards and the myth of urban vibrancy are all talking points of the billboard industry. There is no evidence electricity-hungry digital billboards on public buildings downtown would be good for the economy. It's more than likely just the opposite would happen. Billboards all over downtown will drive people away. Lobbyists and special interests are the ones asking for digital billboards. Council members have had many meetings with lobbyists from billboard companies in the last three months and not one meeting with anyone who thinks digital billboards are bad news. Is that because they are getting financial encouragement from these lobbyists? Driver distraction - Digital billboards threaten driver safety and runs counter to the city's Vision Zero policy to eliminate traffic fatalities. They are removing them in Gilroy.

Light pollution - Lick Observatory would be negatively impacted due to light pollution, similar to the already intrusive Pay Pal and Levi's stadium Jumbotrons. The Wildlife disruption is immense. Digital billboards are opposed by the Audubon Society and the Sierra Club. People who live downtown will be negatively impacted by this light as well.

The City just lost a lawsuit related to not following its own rules and making a backroom deal for billboards at the Airport. Cities with lots of billboards are cities with lots of lawsuits costing taxpayers lots of money. Why does the city council continue with this silly concept?
The City survey with over 2000 respondents showed 90% opposition to billboards? Bottom line - the public is not asking for billboards in San Jose. We passed two resolutions prior stating that the citizens do not want any more billboards, one in the 70's and one in the 80's.

Please vote against any new proposals.

Please include this comment in the public record for the next Community and Economic Development Committee meeting.

Regards,
María Hennessy

I have lived downtown since 1996. It has changed in many ways since then, some better some worse.

This looks like an absolute nightmare:

Please have some respect for your constituents and for this city, and vote against this new form of blight.

I was appalled when I toured the suggested sites with their placement and size and would make me less likely to go anywhere near them.

Six years after approving digital billboards on public property NO elected or appointed official knows the total amount of money the City will earn by allowing new billboards. How can the City Council make major policy decisions without knowing the details of what they've signed up for? Billboards and the myth of urban vibrancy are all talking points of the billboard industry. There is no evidence electricity-hungry digital billboards on public buildings downtown would be good for the economy. I could find no information as to who would pay for the electricity for the electronic billboards.

We want green/renewable electricity, these would waste electricity. How many birds will be lost due to the excessive light. Digital Billboards are just light pollution.

Digital billboards threaten driver, pedestrian and bicyclist safety and runs counter to the city's Vision Zero policy to eliminate traffic fatalities. Before he was elected, I met Omar Torres at an open forum for Vision Zero.
"Electronic Billboards are an important part of a multi-pronged strategy to revitalize downtown San José by integrating art and digital signage." Per Omar Torres memo from 1/11/2024. Does he feel this way because he is the council liaison for the Arts Commission? policy to eliminate traffic fatalities. I was just driving in Los Angeles a couple of weeks ago where there are many digital/backlit billboards. I was very distracted because of the motion/changing content. And, at night, the lights and motion were even more distracting and potentially dangerous (in my opinion). • Light pollution - Lick Observatory would be negatively impacted due to light pollution, similar to the already intrusive Levi's stadium Jumbotrons.

You don't often get email from Learn why_this is important Dear Mayor Mahan and San Jose City Council Members,
The US Food and Drug Administration is mandated by 21 U.S.C. 360hh - 360ss "to minimize the emissions of and the exposure of people to, unnecessary electronic product radiation." The FDA has failed to comply with these statutes, and therefore, Mark Baker, President of the Soft Lights Foundation, filed a lawsuit in federal court on January 22, 2024 to compel the FDA to comply. (https://www.softlights.org/us-food-and-drug-administration-sued-for-failing-to-regulate-led-lights/).

LED digital advertising billboards emit Visible Light radiation that is unnecessary and harmful. If the FDA had complied with the law, the necessary restrictions to protect public comfort, health, safety, and civil rights would have already been established. Instead, there are currently zero regulations. However, this failure by the FDA does not authorize the city of San Jose to expose residents and guests to unnecessary and harmful Visible Light radiation. There is no legal justification for causing this harm by installing and operating LED digital advertising billboards.

The city of San Jose must take this FDA lawsuit into account during its decision making process as to whether the city will authorize LED billboards which subject individuals to hazardous and discriminatory Visible Light radiation and will subject San Jose to litigation.

Sincerely,
Mark Baker

Mayor Mahan, Dev Davis (district 6), and all San Jose City Council Members, I am writing to urge you to oppose any new billboard proposals in our community. Remember that City survey with over 2000 respondents showed 90% opposition to billboards? That's because of the light pollution, wildlife danger, quality of life in those areas, driver distraction, and general tackiness in a great city. Where is the benefit? You haven't shown what billboards will be taken down, haven't asked residents in areas with billboards how they'd like that money to be spent (despite the previous Mayor's offensive email suggesting the Mayor and City Council were representing areas without a voice instead of giving them a voice by asking them what THEY wanted), shown no specific income guarantees, and haven't addressed the issues I've already mentioned. This seems like special interest groups and politicians are pushing something for their own benefit against resident wishes and voters are tired of being treated this way. Bottom line - the public is not asking for billboards in San Jose. Please vote against any new proposals.

I am writing to urge you to oppose any new billboard proposals in our community. Billboards and the myth of urban vibrancy are all talking points of the billboard industry. Dear Mayor Mahan and San Jose City Council Members,
I am writing to urge you to oppose any new billboard proposals in our community. Six years after approving digital billboards on public property NO elected or appointed official knows the total amount of money the City will earn by allowing new billboards. How can the City Council make major policy decisions without knowing the details of what they've signed up for? Other reasons to stop this:
• Driver distraction - Digital billboards threaten driver safety and runs counter to the city's Vision Zero policy to eliminate traffic fatalities. • Light pollution - Lick Observatory would be negatively impacted due to light pollution, similar to the already intrusive Levi's stadium Jumbotrons. • Local businesses do not benefit - Digital billboards typically advertise national consumer products and services.
• Wildlife disruption - Digital billboards are opposed by the Audubon Society and the Sierra Club.

Please help protect the quality of our city and vote against any new proposals.

Please include this comment in the public record for the February 26th 2024 Community and Economic Development Committee meeting.

Take down those blighted conventional billboards! Remember that was the major argument billboard proponents advocated in return for allowing new digital billboards.

The trouble is members of our City Council knew from the start that new digital billboards downtown were deliberately exempted from the requirement to take down 6 conventional billboards for each new digital going up.

Billboards and the myth of urban vibrancy are all talking points of the billboard industry. We strongly urge you to oppose any proposals for new billboards in our community.

And, please take down the blighted conventional billboards we have as well ! The City survey with over 2000 respondents showed 90% opposition to billboards. Bottom line - the public is NOT asking for billboards in San Jose.

Instead what we are asking for is a return to Downtown San Jose of family friendly venues, stores, shops, fairs and activities to make it the vibrant and safe place it used to be.
