As a homeowner in the Los Paseos neighborhood, I was shocked to hear of the City’s plan to place a 78 bed Jail Diversion Program for mentally ill and drug addicted offenders at the Monterey and Bernal location. I believe the City should have been more transparent and provided the community more time to assess the impact this would have in our peaceful neighborhood. Hello,
I'm writing because I am concerned about this intrusion into my community. I live near Bernal and Monterey Highway in a neighborhood called Los Paseos. We have 2 schools here. They are an Elementary and a Middle School. The concern is the properties the City wants to sell to the County for use as a Jail and Mental Health Living space. I notice the property is NOW being used to house the homeless. We still have plenty of HOMELESS on our streets and nearby areas. Why is the City selling this when there STILL is need for it? And the property being sold doesn't look like a high SECURITY area that would house Mentally Challenged people much less prisoners that were removed from society by the court.
Please vote for item 8.1 of the council agenda for August 27th to be deferred to after December 1st of this year, 2024.
The COMMUNITY and NEIGHBORHOODS in the nearby area were not NOTIFIED PROPERLY of this change. And we want input to who is forcibly HOUSED in our neighborhood for CRIME and SAFETY issues with our CHILDREN who attend schools nearby and residents who live there.
Thank You for reading and I do hope your attention is on this URGENT issue when you vote.

None of the residents have been informed about this program let alone that it's to be voted on! I urge you to delay the vote until December 1st to properly notify and allow your constituents to let there opinions be known. This is an extremely concerning issue and I hope you will postpone the vote.

I currently am a homeowner in the Basking Ridge area of San Jose. I have just come to learn that there will be a vote on the sale of the
Monterey/Bernal EIH site to place people that have been convicted of crimes to be housed there instead of going to jail (Jail Diversion Program).
As a community member, I urgently request for this vote to be delayed until after Dec 1 as the community has not been adequately informed and we have not been given the details of this Jail Diversion Program. There is an elementary school in our community and we need time to learn about this potential upheaval in our neighborhood and assess for potential risks that this would impose on our community
Thank you

Some people who received this message don't often get email from Learn why this is important This letter is to formally request that the vote for item 8.1 of the council agenda, that being the proposed transfer of the Bernal/Monterey EIH site, be postponed and formally moved to a date after December 1, 2024. The City of San Jose has failed to be transparent with the community as is required by City code and state law. A date prior to December 1 does not allow a sufficient timeline for community engagement.

Please look up the following names of shooters who were enrolled in similar diversion programs to clearly understand why a community would be (and should be) up in arms about this proposal. I am a mother of two with children in the local school. I reasonably do not want mentally ill criminals living within a 1 mile radius of my children. The current purpose of the sites serve the community well. Why change it?? Nikolas Cruz (Parkland school shooter)
Jim Miller (Phoenix shooter)
Freddy Flores (Manhattan shooter)

Until the zoom meeting, we had no idea of the planned change for this EIH site.
Candidly, we were not properly informed, nor given a chance to understand the plan and voice our views.
Kindly postpone the vote on the sale of this property; until at least until after December 1, 2024.
The postponement will permit time for us to understand the plan and allow us participate in the process.

Some people who received this message don't often get email from Learn why this is important Dear Council Members
As a concerned resident and parent, I am writing to express my opposition to the proposed sale and repurposing of the Monterey/Bernal EIH site for the Jail Diversion Program. While I understand the need for programs that support rehabilitation, I have serious concerns about the safety and security of my family and other families in the area.
The idea of housing individuals convicted of crimes so close to a residential neighborhood raises significant worries about the safety of our children and the broader community. Many parents, including myself, feel that we have not been adequately informed about the details of this program or the precautions that will be taken to protect our families.
For these reasons, I strongly urge the Rules Committee to delay the vote until at least December 1st, 2024, to allow time for the community to be fully informed and involved in discussions regarding the potential impact of this decision.
Thank you for considering the safety of our children and the well-being of our neighborhood in your decision-making process.
Sincerely,
Mahsa Karbaschi, Ph.D.

Our family of 4 lives in the Silver Leaf neighborhood less than a mile away from the tiny homes site we recently learned was going to be converted to house individuals with mental illness and substance abuse as part of the Jail Diversion Program. I'm frustrated and disappointed with our city and county officials who made this decision without giving the community who is directly impacted enough time to hear/discuss the matter.
I have 2 daughters under 10 years old, and I don't want my family to feel unsafe in our own neighborhood. The city and county should give us a forum to voice our concerns and choose if we want this type of program implemented in our own backyards not far from where we live. We pay taxes and deserve that right.
It's very hard for me to believe there are no alternative sites in this city or county which could serve this purpose. Would you want this literally down the street from where you live? Ankit Shah

[Some people who received this message don't often get email from Learn why this is important at https://aka.ms/LearnAboutSenderIdentification ] Dear Ms Davis,
Please delay the city council vote for item 8.1 until after December 1, 2024.
This is regarding the sale of the EIH site at Monterey/Bernal to the county for a jail diversion program.
Our peaceful residential community has already been negatively impacted by the homeless housing, without springing criminals on us too.
Our neighborhood needs time to understand the proposal and its further impact on our safety.
Please delay the city council vote of item 8.1 on the August 27 agenda until after December 1, 2024.
Thank you,
Rose Cipoletti

We are members of the Los Paseos Community and have received news that the County may purchase the Monterey/Bernal EIH site for use in their Jail Diversion Program. We strongly oppose this effort and urge you to postpone the vote until at least December 1st. It is not acceptable to keep members of the public in the dark or have as little notice as the County has provided. To do this is to bypass our democratic system and ignore the rights of those impacted. Please represent your constituents by postponing the vote.

I am writing to express my deep concern about the proposed sale and repurposing of the Monterey/Bernal EIH site for the Jail Diversion Program, which would house individuals convicted of crimes. While I understand the importance of rehabilitative programs, this proposal raises serious concerns about the safety and well being of the surrounding businesses and community.
As a local business owner/resident, I fear that placing individuals convicted of crimes in close proximity to businesses may pose risks to both customers and employees. The community has not been given adequate information or an opportunity to assess the potential impact on safety, security, and business operations.
I urge the Rules Committee to delay the vote until at least December 1st, 2024, so that the community can be fully informed and involved in a thoughtful discussion about this significant change.
Thank you for considering the concerns of local business owners and the community at large. I hope you will prioritize safety and transparency in this decision.

You don't often get email from Learn why this is important Sir or Madam,
Why would we allow a diversion program for criminals be set up so close to schools and in a residential area, by allowing the county to buy city land? See below…
The meeting ended with by the County: I cannot allow anyone else to speak. That said, any meeting so close to a vote, does not allow people to listen to understand, just listen to respond, and at a level that has no control/influence, is deemed by your residents on the noted call, as useless.
We put two homeless housing spots right by the residential area, vs spreading them out across multiple districts, and they are working, so we come back to the same residents, and let’s change it and put criminals there… If you approve, please ensure police are there to keep your residents, especially the kids, safe. So close to Rita Ledesma Elementary School, makes zero sense.
Sorry, but always love, when people don’t want something, we force them (vs spreading), and then it works and then we change it just for money.
Please protect our city, and let them buy a hotel, not near a residential or kid’s schools.
Thank you,

The community needs time to hear and discuss this project and learn more about its details. We greatly appreciate you considering delaying this critical decision until later with more careful planning in collaboration with the members of our community who will be directly affected by it. Thank you.

I’m Anton Bion, a registered voter and homeowner within the Los Paseso neighborhood that is located within about 1 mile from the tiny homes on Bernal & Monterey Rd. I was recently informed, from a social media (YouTube video link) post about the proposed site transformation.
My request is to postpone the voting on item 8.1 of the council’s agenda that is set for August 27th. This will give adequate time for my fellow neighbors to be informed of this proposal as well as give them a lawful vote of the matter.
Thanks

All,
The county wants to change the operation of the Monterey/Bernal EIH site with the purchase of this location and place people that have been convicted of crimes to be housed there instead of going to jail (Jail Diversion Program). The vote was to happen next Tuesday but since the community has not been informed correctly and given the details of this Jail Diversion Program; the rules committee will be delaying the vote tomorrow.
CALL TO ACTION: PLEASE CUT AND PASTE THE EMAILS BELOW OF THE 5 MEMBERS OF THE RULES COMMITTEE TO DELAY THE VOTE TILL AT LEAST DECEMBER 1ST.
How can you help?? Send an email to the council members of the Rules Committee below asking to postpone the vote on the sale of this property until after December 1st, 2024. Your email must be sent before 9:00am tomorrow morning (Wednesday, August 21, 2024). [email protected]

Some people who received this message don't often get email from Learn why this is important Just asking for the vote for item 8.1 of the council agenda for August 27th to be after December 1st of this year. This was not mentioned to the citizens of South San Jose in time to be considered or have an opinion on what this sudden change can impact the current individuals residing there or our community that is near that location.
We have no idea what type of crimes these induvial have committed and if this sudden unforeseen change will create an unsafe environment for our families. We should have a right to be informed ahead of time and be able to vote on whether we agree to this sudden change that will impact our neighborhoods. We should have a right to know where our tax dollars are being spent.
A very concerned citizen,

Members of the Rules Committee,
I am amongst many community members not limited to CSJ District 2 and District 10 ask for your consideration to help postpone the vote related to the sale of the subject property until after December 1, 2024.
Furthermore, I am of the opinion that this issue needs to be addressed through a process which includes local D2 & D10 residence.
Sincerely,

Before gerrymandering, l lived in District 2 with my neighbors across Santa Teresa Boulevard who share common interests. I am greatly concerned that the community was not given sufficient time to consider and respond to this action. The timing is unworthy of the Council on such a significant item.
I REQUEST THAT YOU DELAY THE VOTE FOR ITEM 8 UNTILL AT LEAST DECEMBER 1ST. THE
COMMUNITY NEEDS TIME TO HEAR AND DISCUSS THIS PROJECT AND NOT HAVE IT JUST RAMMED INTO OUR COMMUNITY AS THE TINY HOMES WERE DURING COVID DAYS.
You also need more time to consider this item. With almost 7000 unhoused people in San Jose, do you really want to take on solving a County prison problem by adding a prison facility to our neighborhood.

Our community needs time to hear and discuss what the county is planning to do with the current homeless tiny homes. I would ask that you put yourselves in our shoes. I live just down the street - I have children. Putting criminals a couple blocks away from where I live is a huge concern.
I have just heard about this - we, as a community, need time to voice our concerns. Making the decision before this happens is not how I expect our legal or moral system should run.
Please extend the vote.
Thank you
Jan Stephen

Some people who received this message don't often get email from Learn why this is important Hello,
As a person who has lived in San Jose for 64 years I am requesting that you give our community time before voting to sell the new EIH facility located on Monterey Rd and Bernal to the county. We were informed of this plan only days before the city planned vote. Please give the community until Decenber before holding this vote.
Respectfully

You don't often get email from Learn why this is important City of San Jose Rules Committee,
I reside in District 2 and more specifically in the Basking Ridge area. Yesterday I became aware that the City is considering selling the Emergency Interim Housing (EIH) facility at Bernal Road and Monterey Road (on Rue Farrari near the entrance to Highway 101) to the County and for the County to repurpose the facility to a Jail Diversion Program site. I was also informed that we had until 9am this morning to provide comment. This is not acceptable.
If this is true, the City needs to reevaluate its noticing policies and make sure that the surrounding community is aware and has reasonable time to comment. I received no notice from the City and only learned of this pending decision from the Basking Ridge Homeowners Association. I live approximately 1500' from the site.
The current EIH site was forced into our community at the onset of the Covid19 Pandemic. At that time, the City declared an emergency and bypassed all environmental review and greatly curtailed the public notification process. Regardless of the merits or concerns of the EIH site, using the pandemic as a tool to bypass community input left an untrusting feeling to many in this area. State and local funds specifically earmarked for the unhoused were used to build the EIH project. If it is true that the City is considering a sale and repurpose, the very emergency that built the site is called to question as well as the inappropriate use of the spent funds. Any change to the site should be subject to conditions of a new development and not a re-development since the current improvements were completed without CEQA or an EIR.
Your immediately reply is requested as well as all information regarding what may be proposed at this EIH site and how the community will have time to comment. I look to Council Member Jimenez to be an advocate for the rights his constituents living in District 2.

I reside in the Los Paseos community, and it has just, as of last night, come to my attention that the county has decided to repurpose the 'tiny homes' to be used by people who have been convicted of crimes to live there instead of going to jail (Jail Diversion Program).
The vote was to happen next Tuesday (8/27), but since we, the community, have not been informed correctly and given the details of this Jail Diversion Program; the rules committee will delay the vote tomorrow.
Please vote for item 8.1 of the August 27th council agenda after December 1st, 2024.
Thanks,

Some people who received this message don't often get email from Learn why this is important Hello Members of the Rules Committee,
I am writing to encourage you to extend the voting on Item 8.1 on the August 27th agenda to be pushed to on or after December 1st 2024 to allow community members proper time to be informed of the vote and fully understand the implications of the action. As a community member the Tiny Homes project has brought an increase in homeless people and petty crime to our area. The initial communication to the neighborhoods was that these homes were a temporary solution which would last for 5 years while more permanent solutions were identified and implemented. The decision by the board to move forward with selling the property to the County with little to no communication to residents is very disappointing, I am very concerned with the process with which the decision to sell this property was made and the lack of transparency and communication with members of the community.
Sincerely,
Matt Sidlauskas

In fact I’ll give you a link.
https://nextdoor.com/p/pY5yMgkJnr3s/c/1205365389?utm_source=share&utm_campaign=1724246163465 We are starting to talk and we see that back deal are being made for our neighborhoods, which will go to the newspapers, and even lawyers are being contacted.
We voted you in to do a job of taking care of your constituents, and this is what we got.
Sergio, actually started it, he lied in community meeting, and did what he did to bring a lot of this here. And some deals are being reported that may be criminal.
Mahan was suppose to clean it up, he lied also. It’s worse.
We don’t trust any of you.
The people in these neighborhoods are going to get organized. And if crimes have been committed, they will be outed.
Take a good look at what you all brought to this area, a nice area I lived in for 50 years, and raised two kids in. I’m scared for my grandkids. They won’t be able to walk to school.
Or walk to the store, or anywhere.
But yes, It’s not in your neighborhood…..
That was the goal, right?
Take a good look at your decisions……………………………………
