Subject: 11/19/2024 Meeting, Agenda Item 3.7 D3 Representation [External Email. Do not open links or attachments from untrusted sources. Learn morel Dear Mayor, Vice-Mayor, and Councilmembers:

I have been a constituent in District 3 since 2016 and I strongly support a well-vetted appointment process with public input.

Because our district covers several very disadvantaged neighborhoods with complex issues, including many of the City's affordable housing complexes, it is imperative that we have strong, continuous representation--not a revolving door with an interim appointment filling in until after a special election.

My experience in local political activism has shown me that the most critical time for representation is during the budget process, starting early in the New Year. We have only a few working weeks left in 2024 with the holidays around the corner, so we won't complete the special election process by the end of 2024. At best, we would have an interim appointment whom everyone knows would be replaced by the time we vote on the final budget in June 2025. How effectively could that person represent my District when they and their colleagues don't know who will take over their position? Instead, we could appoint a District 3 Councilmember for the rest of the vacant term who could see the budget through to completion and be held accountable during FY 2025-26 and the next D3 regular election.

The appointment process has been satisfactory in the last set of vacancies. Domingo Candelas won re-election for his strong support of his district. Although Arjun Batra came in second in his district, he did reasonably well with voters.

Special elections tend to favor the opinions of older, higher income demographics that are not a majority in this district.

People who are working 2-3 jobs to cover the rent, those who can't find housing to rent, are disabled, are students on the fast-paced quarter system, or for whom English is not their primary language, are less likely to turn out in special elections. And they're the ones who most need a Councilmember who sees them as people they represent, not just the unwashed masses.

The Mayor knows his fanbase will turn out instead, and that's who he's hoping to mobilize in a special election. Frankly, I trust the rest of the Council more to choose a new Councilmember fairly than I do the "common sense means scapegoating the unhoused and disabled" and "service workers should commute from Fresno" crowd. (Not that I have the highest trust in our Council right now, but at least the process should be transparent enough under the Brown Act that it will be fair and include public input.)
In conclusion, I strongly recommend appointing a replacement Councilmember and strongly object to a special election.

Sincerely,
Kathryn Hedges

Mayor Mahan and San Jose City Council,
I would like to make a formal request to appoint Irene Smith, the candidate who won the most votes along with Omar Torres in the primary. The people spoke in June 2022, choosing Irene Smith as the runner up. The circumstances surrounding Omar Torrres are embarrassing enough, and should not create a financial burden on the City.

San Jose must focus our resources on combating homelessness, reducing crime, and building safe places in San Jose. There is no need to transfer those resources to fund a special election.

I respectfully request that the residents of District 3 be given the opportunity to select their next representative through a special election at the earliest possible date.

I would support an interim appointment only if the appointee commits to not running for the office in the special election, as I believe this would create an unfair advantage over other candidates. If such a commitment is not feasible, I believe the Mayor should continue serving as the interim representative until the election.

Thank you for your consideration.

My preference is for a special election to replace former councilperson Omar Torres. I also supported a special election for Matt Mahan's councilperson replacement when Mahan was elected mayor. At that time in our city's history, I did attend the evening council meeting that decided upon replacement by council appointment.

I would also like to suggest that background checks be required for candidates seeking public offices beginning with school board candidates.

I am a San Jose resident deeply concerned about the recent vacancy held by former Counsilman Omar Torres in District 3.

I urge you to please please vote for this spot to be filled by Special Election. Its the only fair way to do it, as intended by US Democracy.

If this is not possible, then will you please finalize any new Appointment, only after the 3 new incoming Counsil members have taken their positions.

A new appointment should be finalized by the incoming counsel. Not the current counsil which has 3 members leaving office.

Thank you for your time & service.

To Whom It May Concern,
San Jose City is already in a deficit, so why spend our money on a special election for District 3 replacement? The city needs to abide by their own policies and follow their due process for a replacement to avoid controversy, and do as they did for District 8 and appoint a qualified candidate.

May San Jose City government continue serving their residents through transparency.

Sincerely,
Paul & Norma Zuniga

Special elections are expensive, favor older, wealthier demographics and not the majority of the district. Whereas an appointment gives us immediate consistent representation for the next two years, and more if they're re-elected. An interim appointment would have someone at the start of the budget cycle that wouldn't be in place at the end of the budget cycle. D3 needs consistent representation for this reason. Filling the District 3 Vacancy
As the Council District 3 staff, we want to ensure you're aware of tomorrow's (Tuesday, November 19th, 2024) City Council meeting. At this meeting, a decision will be made on how to fill the upcoming vacancy in our office. The City Council and Mayor will determine whether District 3 will select its next representative through a special election, an appointment, or a combination of both—with an interim appointment followed by a special election.
• Special Election: Residents of District 3 would vote to choose their next representative.
• Appointment: The City Council would appoint a new representative to serve the remainder of the term.
• Interim Appointment + Special Election: The Council would appoint a temporary representative to serve until a special election is held.

This item, 3.7 District 3 Upcoming Vacancy, is on the Council agenda for Tuesday, November 19th, 2024. The meeting begins at 1:30 PM, and we encourage you to come and share your preference on how the vacancy should be filled.

If you cannot attend, you can submit your comments via email to the City Clerk at [email protected] by 8:00 AM on the meeting day.

Sincerely,

Learn morel You don't often get email from Learn why this is important Please record my comments below for the City Council Meeting on Tuesday, November 19, 2024.

As a 22 year resident and homeowner in Council District 3, I support the decision for the City Council to appoint a new representative to serve the remainder of the term. The position will have a regularly scheduled election in less than 2 years (November 2026). Thus, in a relatively short time, the appointed representative may run for election on their merits from the interim period or the representative may be replaced by election of a new representative.

Appointment of a new representative, since there are less than 2 years remaining of the position, is the best use of City funds. The $5 million dollar price tag for a special election is not a wise use of our City money at this time. Omar Torres was an adequate representative and his staff functioned well and worked to meet our needs in District 3. However, I believe his staff did most of the work, and thus, representation by another qualified person at this time can best be filled by appointment.

In addition, I would like the City Council to consider the appointment of Carl Salas as our new representative for the remainder of the time. Carl is a long time resident, business owner, and investor in downtown San Jose events and activities. There are few District 3 residents who meet all three of these characteristics. In addition, Carl is a good listener, active feet-on-the-ground volunteer, and advocate of downtown San Jose. Our current situation is an excellent opportunity to engage Carl as a District Representative in an official capacity.

Please consider appointing a new representative to serve the remainder of the term, and please consider Carl Salas for this position.

Kind regards,
Sally Billstrom Schroeder

To Whom It May Concern;
I am writing to you regarding the District 3 current vacancy as l am unable to attend the meeting. It is my preference that a special election be held to ensure that the residents of the district's voices and concerns are heard and given a fair chance to have a representative with our interests in mind. I prefer that the mayor who I believe to be a more neutral party be the one to select the interim councilmember until the special election is held, but I do not know if there is something in the city's rules that places it in the hands of the city council. I don't believe that each district has the same needs and therefore it is imperative that a person be chosen who is dedicated to District 3 alone and does not have prior experience or connections with other council members.

Thank you for your understanding and I sincerely hope you will consider my position.

Dear City Council,
I am unable to attend tomorrow's meeting, but would like to share my thoughts.

As a 20+ year resident of District 3, I am aware of how important it is to have a competent and caring representative in City Council. With the vacancy left by Mr. Torres, it seems our best chance to have an advocate for our area during the remainder of his term is to appoint an interim Councilperson and schedule a special election so we are able to choose the best leader for the next 2 years in our district.

Thank you,
Suzanne McClure
