BACKGROUND

In 1998, the United States Department of Justice’s Office of Juvenile Justice Delinquency and Prevention created the ICAC program. This program was created in response to the increasing number of children and teenagers using the internet, the rapid increase in numbers of child sexual abuse images available electronically, and intensified online activities by predators seeking unsupervised contact with children.

The San José Police Department recognizes the need to protect the children in the community in a fast-growing trend of internet uses and various social media platforms.

In February 2003, the department applied for and was awarded its first ICAC grant from the Office of Juvenile Justice Delinquency and Prevention. Since then, the department has applied for and received several ICAC continuation grants. ICAC grant funding has provided overtime, equipment, and vehicles for investigations; training of investigators; and opportunities for officers to attend two national ICAC trainings each year. Funding has also provided equipment and training for investigators from 11 Bay Area counties who participate in the Silicon Valley ICAC Task Force. The San José Police Department serves as the fiscal agent for this ICAC regional award.

In September 2024, the Office of Juvenile Justice Delinquency and Prevention invited the department to apply for the Fiscal Year 2024-2025 grant. The application was accepted and approved in the amount of $642,113. This supplemental award of $642,113 is additional to the grant funding of $664,004 received in 2023-2024, bringing the total grant award to $1,306,117. This is a reimbursable grant and the department will ensure expenditures are allowable as set forth in the Department of Justice Grants Financial Guide and City policy and procedures.

ANALYSIS

Forensic tools may have minor maintenance, repair, or monthly service charges in the future. These expenses beyond the grant term will be absorbed in the department’s existing non-personal/equipment budget.

This program is being funded by the Office of Juvenile Justice and Delinquency Prevention. There is no cash or in-kind match requirement with this grant. If grant funding is discontinued, alternate funding for this program would need to be considered.

Any request to the General Fund will be subject to the appropriation of funds taking into consideration the City’s overall fiscal condition, City Council priorities, and other departmental program needs.
