You don't often get email from Learn why this is important Hi Mayor Mahan and Pam Foley,
Please protect our city parks! I support the the staff report’s interpretation and the inclusion of 207 parks in the official Charter Park inventory. As a nature lover and active volunteer for Santa Clara Valley Bird Alliance, preserving our parks is very important to me. They provide important habitat for birds and green spaces for the residents of San Jose.

Dear San Jose City Council.
Thank you for your service.
On Tuesday, March 25, please support the proposal to protect the over 200 parks in San Jose.
During these current times it is more important than ever to have these green spaces remain as areas, not only for wildlife, but people to have to create peaceful balance in their stressful, demanding working lives.
We are so fortunate to have a year of abundance good weather for people to enjoy and maintain healthy frames of mind by being to visit these parks. They create a place for healthy, positive community get togethers as well.
Thank you for your consideration on this topic.
Best,
Diane McCoy
Bay Area Resident

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
Support chartered parks and include protection extended to land that has not been developed for lack of funding. There are planned park sites that are still awaiting funding.
Our public lands currently used as recreational golf spaces used by children and seniors must also be protected. Protect this public opportunity.
To this end, please ensure the following lands are protected:
1. The City owns the land (fee title) or has unrestricted access through an easement in perpetuity, and a. The land has been (or is planned to be) improved with recreational or park amenities, whether passive or active, AND/OR
b. The land is (or is planned to be) open to the public for public park purposes.
2. The land is currently used as a public golf course.
Please also direct staff to plan for any necessary Charter amendments necessary to fully accomplish this.

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
I want to reiterate what I wrote in my messages to the Mayor and my council member: it is very important you accept the staff's recommendations for defining chartered parklands. I, and the birds I watch and count across the city rely on the existence of maintained parklands.

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
I was born here in San Jose and have witnessed the disappearance of the valley of hearts delight. I urge you to save what little open space we have left. Save the parks, the community golf courses and keep the foothills green .

Support chartered parks and include protection for parks not yet developed due to lack of funding.

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
The habit of the city of San Jose to take money from developers in place of parks is a very. bad policy.
Then the city does not use the money for parks or to develop or keep up any open space for the citizens of this city. The city of San Jose keeps raping the citizens for money that they then do not spend to keep up the city, make it safer (including all that ridiculous and dangerous stuff all over town ostensibly to make cycling easier but ultimately making both cycling and driving more unsafe.
SUPPORT THE PARKS!

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
Please consider the impact to San Jose without having parks available to our community. Parks add value in many areas of people’s lives. Parks are mental sanctuaries for those who don’t have the space at home to enjoy the outdoors.

March 21, 2025 RE: File #25-292 3/25/25 Item 7.1 TO Mayor Mahan, Vice Mayor Foley, Councilmembers Kamei, Campos, Salas, Cohen, Ortiz, Mulcahy, Doan, Candelas, Casey: Parks are important to us all: they improve our physical and mental health, engage our youth, and build community and a sense of place – a reason to reside, work, and play in San José. Yes on SJ Parks is park-passionate and committed to raising social discourse about parks and their key role in our community fabric. We recommend accepting the staff report on the historical implementation of Section 1700 of the City Charter, the site inventory, how Section 1700 is applied. We also ask council to direct staff to develop a process to protect approved parks that have construction pending as well as clarification on issues related to long-term leases, property line adjustments, what protection exists for donors from transfer of park assets to other uses and commercialization leases. Background Residents erupted with outrage when city staff proposed placing Emergency Interim Housing (EIH) on the Noble Pond site, a minimally developed natural park located along Penitencia Creek.1 Describing prior conflicts over this park site, Councilmember Cohen cautioned Council about his constituents’ passion for this park: "People came with everything but their pitchforks."2 Despite the warning, Council voted 8-2 (Mahan, Cohen dissenting) in June 2022 to approve the site. The Rules Committee revisited the issue in August, 2022 as conflict over the plans for this much-loved park continued. "I think that it's important for us to maintain that park land and keep it accessible for the public use. The community in our district puts a high premium on open space and parks and we shouldn't be sacrificing that space.”3 1 Noble Pond Site at the Dr. Robert Grossmont Pond (APN 595-31-001) is different from Noble Park next to the library (APN 595-02-009) which has a decorative pond. 2 Councilmember David Cohen in Kendall, Marisa. “San Jose Approves New Tiny Home Sites—Neighborhood opposition likely to follow move to provide housing to some homeless residents.” Mercury. June 23, 2022. 3 Councilmember David Cohen in Hase, Grace. “City Leader wants pause on tiny homes. Councilman says proposed North San Jose site is dedicated park land.” Mercury. August 2, 2022
2 As conflict intensified over using parkland for housing, staff researched archived legal documents and agreements with the County and Valley Water, then announced4 in September 2022 that the park would be infeasible to convert to a housing site. Council met in November 29, 2022 and learned the Noble Pond park site qualified as a Charter Park receiving all of the protections from sale and lease itemized in the 1965 Charter. Council affirmed the decision to withdraw the Noble Pond park site from consideration for housing. They also asked staff to prepare a report that defined park charter status and a process to retroactively declare all PRNS property that qualify as Charter Parks.5 Subsequently, staff took a draft report to the Parks and Recreation Commission in January 2024 where commissioners raised a variety of questions. The report issued to Council 3/18/25 answers many of them. We highlight missing items in our discussion. Discussion The residents of San Jose have a long history of passionately supporting their public parks and plazas, memorializing their commitment as early as the 1888 City Charter6, reaffirmed in the 1896 Charter and further clarified in the 1965 City Charter. Residents do not want their parks sold or used for commercial enterprises and even the early charters reflected this position. The modern 1965 charter has some flexibility allowing for changes to Charter Parks such as long term leases through an election process. Raging Waters and History San Jose were authorized under an election process. The staff analysis demonstrates how the provisions of the charter provide a three-prong test for Charter Parks that allows a variety of park forms and recreation spaces that meet diverse population needs. Earlier analysis and presentations to council by staff have addressed concerns about fee charging amenities such as golf courses by demonstrating prior council’s intent in property acquisition through grants and city funds, as well as how the courses provide scholarships and neighborhood activities to diversify the user base. When a councilmember floated a proposal some years ago to close Rancho Del Pueblo golf course, characterizing it as an elitist money loser that was not a park, District 5 residents arose and spoke of the benefits of the open space, the economic lift, and the access to opportunity that the golf course provided to one of the lowest income neighborhoods in the City. The subsequent pandemic demonstrated the role golf courses can play in a diverse and robust park system. Concerns We have four concerns that the current analysis and charter provisions do not appear to cover: 1) Parkland waiting for development funds; 2) Parkland donated but diverted or not developed – assurances to donors; 3) Parkland leased to other agencies, and what happens when the agency no longer needs them; and 4) Parkland Leasing and Commercialization. We recommend clarification and, if needed, a charter revision to clarify and make future actions congruent with the community’s passion for parks. 4 Kendall, Marisa. “City Workers Urge Council to Scrap Tiny Home Site For Homeless.” September 20, 2022 5 Minutes. November 29, 2022. Item 8.3 page 12. https://sanjose.legistar.com/View.ashx?M=M&ID=999878&GUID=CDB0A6FB-AC1C-4101-BF06-DB5E8796244A 6 City of San Jose Charter, 1888. Article VIII, page 18. “nothing in this section or in this Charter shall be so construed as to give to the Council the power or right to sell transfer or dispose of any of the streets or public parks or squares of the city”
3 1. Parkland Waiting for Development Funds. We believe that it is a violation of public trust to not include them as among our inalienable public Charter parks. How will the City protect the public trust for these parks? A charter amendment may be necessary to protect these parklands. The City has multiple parcels that have been acquired for parks through a combination of construction and conveyance tax, Park trust funds (in lieu fees and parkland dedication), and grants. Many have master plans and names and are part of a specific or area plan but are awaiting the accumulation of additional funds to complete development. The current charter provisions do not appear to protect them from sale or diversion on any given Tuesday. Sometimes parks are planned so that one project will provide the land (PDO) and the next project provides the development fees (PIO). Will the City Park System lose the flexibility of creating joint projects out of the fear that anything not built immediately could be repurposed? Examples of parks in this category: a. Brickyard Park (Third and Keyes) in D3: master planned, named, awaiting funds to construct b. Agnews Park in D4 – 20 acres that needs demolition of a contaminated building and construction of the park. We have already heard housing officials discuss their desire to take this park land away from residents in the densest neighborhoods of the city with the worst park to resident ratio. c. Tillman Park in D6 – awaiting demolition of a building and construction funds d. Del Monte Park Phase III in D6 - awaiting demolition of a building and construction funds 2. Parkland Donated but Diverted or Not Developed – Assurances to Donors We believe that donated land that was accepted by Council as a park should be categorized as a Charter Park unless voted otherwise by residents. Land donated as part of a Park Trust Fund agreement should immediately be designated a Charter Park. Contracts with donors or a charter amendment may be needed to achieve this goal. We are concerned that some lands have been donated as parkland to the city but are not included as Charter Parks. What does that communicate to future donors? Examples: a. Parque de los Pobledores (D3). Formerly known as Gore Park and El Camino Real Park. A public subscription in 1912 purchased the parcel and was accepted as parkland by the Council. It has been redeveloped several times over the years to meet the needs of the community. Most recently, it was transformed into an event space that supported art events such as those by MACLA and the Quilt Museum. It has been categorized as owned by DOT. b. Elias Park (D3) donated land next to Alma Community Center. Has a master plan, name, but still has store and house that is rented. Waiting for development funds. 3. Parkland leased to other agencies, and what happens when the agency no longer needs them We believe that the Charter Park list should indicate which sites have been leased and the term of the leases. The City should develop a policy for returning the underlying parkland to park use.
4 The City has long-term parkland leases to school districts and SJFD. Only some were voted on. (Some may have pre-dated the 1965 Charter provisions for elections). How will the return of this parkland be handled? Examples: a. Ramblewood School (D7) sits on Ramblewood park land and is closing in June 2025. The lease was approved by a city vote. b. Sylvia Cassell School (D5) sits partially on city parkland while Sylvia Cassell park is partially sited on school property. Cassell school is closing in June 2025. We cannot find a vote authorizing this lease. d. City Fire Stations have been sited on parkland, authorized by voters. If the stations are closed, how will the land be returned to the city and the recreational value made whole? 4. Parkland Leasing and Commercialization We view parks and open space as an extremely limited resource and oppose permanent construction of commercial enterprises with the exception of those that provide unique specialized recreation. We believe that the leases, term lengths, election dates (if applicable) of these properties should be posted in the Charter Park inventory. The Charter clearly indicates the requirement to go to the voters for long-term leases. The City has entered into lease agreements of varying lengths with commercial and non-profit operators of specialty properties such as the Water Park, golf courses, and Veggielution. There have been proposals floated for high-end restaurants, other commercial businesses and other privately operated facilities in Charter Parks. We take our opposing view from what prior City Councils have learned from Alum Rock where all commercial enterprises were removed in favor of a celebration of the park land. Summary We thank council for asking PRNS to provide a comprehensive list of Charter Parks. We appreciate the thorough analysis and insight into the application of the Charter Park policy. We believe a charter amendment may be necessary to address deficiencies in the Charter Park policy for parks that are waiting for development or those that have been donated. We ask that staff include with the inventory key information about park land leases. We oppose permanent construction of commercial operations that do not provide unique recreational opportunities and the long-term lease of the underlying ground should be subject to election approval. Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
Urban parks and open spaces are vital for community health and climate resilience, offering clean air and water, cooler temperatures, and essential access to nature that supports physical and mental well- being. I urge City Council to adopt an official definition of parkland that provides maximum protection for all park spaces—existing, planned, under construction, and including public golf courses used by seniors and children—so these benefits are preserved for future generations.
Support chartered parks and include protection for parks not yet developed due to lack of funding.

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
I have resided in San Jose since 1983 and in Saratoga before that since 1962. Parks are a very important part of growing up. My "parks" were the orchards and unfenced creeks. Yes, summers were spent scratching poison oak boils, but the fun and exploration were well worth it. Kids NEED nature, even in parks. Please fully fund the parks and open spaces. These are more important now than ever because of the increased San Jose Density.
Support chartered parks and include protection for parks not yet developed due to lack of funding.

San José City Council
200 E. Santa Clara St.
San José, CA 95113
Dear Mayor and Councilmembers,
I’m writing to express deep concern about two critical issues affecting the future of San Jose’s parks: the past and continued reduction of developer fees and the proposed update to the list of charter parks.
While I understand the challenges of building in a high-cost environment, the reduction of fees that fund our parks system with no plan for alternative means to fund them has put our city’s livability and long-term economic health at risk. Ideas for alternative funding could include commercial fees, tourism/hotel tax, parcel tax, or tying previous developer fee discounts to interest rates. It is crucial to remember that parks are essential infrastructure. They help attract families, support public health, and make San Jose a place people want to live and work.
Strong parks also support economic development. Employers know that quality of life matters when attracting and retaining talent. Families considering a move to San Jose are looking not just for housing but for vibrant communities with safe, accessible parks where their children can play and their families can thrive. Parks also benefit commercial and retail developments, increasing surrounding property values and foot traffic.
At the same time, I’m very concerned about the proposed revision of the city’s list of charter parks. Under the City Charter, charter parks are protected from being sold or repurposed. If parks are not added to this list, they could lose their protection and be vulnerable to future sale or development—often in neighborhoods that can least afford to lose them, like in park-deprived council districts 1 or 5.
It’s also important to note that the polling data used to inform these policy directions may not provide a complete picture. Public polling opinions are only as reliable as the questions asked, and many residents are not fully aware of the scale of the $500 million park maintenance backlog resulting from previous developer fee reductions or that non-charter parks may be at risk of being sold off. These are critical facts that should be front and center in this discussion, not left in the background.
San Jose’s parks are a public good and a community asset. Cutting funding and removing protections will erode the very things that make this city livable, equitable, and economically resilient. I strongly urge you to preserve developer fees that fund parks or find alternative funding for our parks. The goal should be to protect all parks—not just those currently listed as charter—and take a more transparent, inclusive approach to planning our city’s future.
Thank you for your leadership and service.
Sincerely,
Rudy Flores

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
This town can't afford to lose any more parks or open space. There was no planning done to protect open spaces when San Jose expanded in the 50's. There is no planning being done to provide more public schools to meet the needs of the apartment building/affordable housing boom going on right now. People need parks and public golf courses. Not everyone can afford to join a country club. The parks that provide soccer pitches, baseball diamonds and cricket pitches are very important for all citizens.
Support chartered parks and include protection for parks not yet developed due to lack of funding.
There are planned park sites that are still awaiting funding.

Dear VTA Board of Directors,
It is long past time to stop the denial of service to Santa Clara County students, families, and workers.
The impact of the denial of service is often a denial of opportunity and the ability to thrive. I ask that you take steps to resume service asap. I ask that you post a daily update regarding steps you have taken to facilitate this. Your leadership is the key to resolving this situation for all.
Dear VTA
Stop being selfish and pay the drivers and frontline staff what they deserve. Stop dehumanizing and saying that we the people affected and the drivers are not worth anything! I have been affected by this strike. How will you redeem yourselves to the public and riders that uses the VTA for the amount of money spent on expensive Ubers and Lyfts? The Drivers and frontline staff deserve to be safe, healthy and paid well for the amount of shit they go through daily.
Sincerely,
Simone Ovalle

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
Support chartered parks and include protection for parks not yet developed due to lack of funding.
There are planned park sites that are still awaiting funding.

Tuesday, 3/25/2025, Council Meeting: Item 7.1, Report of the City Charter Regarding Parks.
From Dave Poeschel <

To The Office of Mayor Matt Mahan <[email protected]>; District1 <[email protected]>; District2 <[email protected]>; District3 <[email protected]>; District4 <[email protected]>; District5 <[email protected]>; District 6 <[email protected]>; District7 <[email protected]>; District8 <[email protected]>; District9 <[email protected]>; District 10 <[email protected]>; City Clerk <[email protected]>; Agendadesk <[email protected]>
Dear San Jose Mayor Mahan and City Council Members,
I urge you to include creek trails and the City owned properties that they traverse with the full status as Charter Parks. Environmental advocates and residents have worked for many decades to educate public officials and staff about the extraordinary value of our streams through protecting property from flooding and erosion, the restorative potential for mental health with passive recreation, opportunities to reduce dependence on automobiles, reduction of the heat island effect, production of clean air, and providing habitat and habitat corridors for myriad of species from anadromous fish to mountain lions. Yet, City decision makers have failed time and time again to adequately protect these resources, leaving San Jose with heavily impaired waterways. While advocates have helped to create riparian corridor protection policies, the policies have been routinely dismissed by elected representatives.
And now, the idea put forward by staff that a creek trail is solely a 24 feet wide strip which does not include the essential environment of the often undeveloped natural habitat land as parkland is simply astounding. Do you understand how removing the protection afforded by public vote enhances the protection of open space and natural habitat as stated in the staff memo? I do not. I suspect that by accepting this premise, you will continue the legacy that has left us with such irresponsibly degraded waterways.
Sincerely,
David Poeschel

To this end, please ensure the following lands are protected:
1. The City owns the land (fee title) or has unrestricted access through an easement in perpetuity, and a. The land has been (or is planned to be) improved with recreational or park amenities, whether passive or active, AND/OR
b. The land is (or is planned to be) open to the public for public park purposes.
2. The land is currently used as a public golf course.

Dear San Jose City Council,
Save and protect our parks, both current and planned, plus public golf courses used by seniors and children.
First Tee – Silicon Valley supports designating City of San Jose golf courses as chartered parks. FTSV has been developing youth through the game of golf at Rancho del Pueblo Golf Course since it opened in 2000 when the program began as the Eagles at Rancho. FTSV's programs are accessible to youth of different backgrounds and perspectives and affordable to families experiencing financial hardship. Over 57% of FTSV's 2024 course participants and school students were from low-income families.

Dear Mayor and City Council Members,
Save Our Trails: Connecting Santa Clara County Communities is a California Not-for-Profit Corporation whose mission is “To promote trails in Santa Clara County for the benefit and enjoyment of all.”
We, the board of Save Our Trails, advocate for policies that promote and protect the
enhancement of San Jose’s trails, ensuring they remain accessible and well-maintained for the public. We appreciate the efforts to clarify the definition of Charter Parks and recognize the importance of providing a consistent approach to designating protected parkland.
We support PRNS’ work in defining and interpreting Charter Parks, particularly in including city- 3/24/25, 6:29 PM Mail - Agendadesk - Outlook

However, we believe that the proposed limitation of Charter Park status to only a 24 ft wide trail segment is overly restrictive. Many trails traverse areas that should be fully protected, such as the Three Creeks Trail and portions of the Five Wounds Trail. These areas, owned by the City, should be designated as chartered parkland in their entirety, from fence line to fence line, to ensure their long-term preservation.
Furthermore, we urge the City Council to recognize that habitat and open space are integral components of our trail systems. A more comprehensive approach to defining Charter Parks would enhance the environmental and recreational value of these spaces, ensuring that San Jose’s residents continue to benefit from well-maintained and protected trails.
We appreciate your commitment to preserving our city’s parks and trails and thank you for your consideration of this important issue.
