Subject: Objection and Request for Clarification Regarding Proposed Open Space Rezoning of , San Jose, CA 95125 under SB 1133 Compliance
Dear Honorable Members of the City Council,
I am writing regarding the City of San José’s proposed rezoning of properties adjacent to Los Gatos Creek, including my property at , San Jose, CA 95125 as part of its compliance with Senate Bill 1133 (SB 1133).
As a longtime resident on this property, I am concerned that my property is proposed to be partially rezoned as Open Space, with the boundary line drawn midway into my parcel. This raises serious concerns regarding the potential impacts on my private property rights and future use of my land and redevelopment.
While I understand the City's need to comply with state law, I respectfully request clarification on:
• Whether the Open Space designation would allow public access to or through any part of my property and are there any future proposals for public access. • Whether there are plans to incorporate my land into a public trail, park, or open space network.
• How the City plans to protect existing homeowners' privacy, property rights, and security.
• What are the restrictions for future redevelopment of our property, for instance redevelopment of our existing singe family house and what kind of implications it will have for us with your planning and building department. • Open space zoning can potentially lead to a decrease in property market value, how you propose to compensate for the value of the property.
Given the history of attempts to extend the Los Gatos Creek Trail through this neighborhood, the Open Space designation without clear explanations creates great
uncertainty for residents like me.
I strongly object to any changes to our property rezoning that would allow public intrusion onto private property without full consent and due process. I urge the Council to reconsider or amend the proposed rezoning where it affects existing residences and to ensure full transparency and engagement with impacted property owners before any final decision.
Thank you for your consideration and for protecting the rights of San José’s longtime residents.
Sincerely,
Denis and Rajka Colic

Subject: Objection and Request for Clarification Regarding Proposed Open Space Rezoning Near under SB 1133 Compliance
Dear Honorable Members of the City Council,
I am writing as a resident of , located just a few houses away from a property that is proposed to be rezoned as Open Space under the City of San José’s effort to comply with Senate Bill 1133 (SB 1133).
While my property itself is proposed for R-1-8 residential zoning, I am concerned about the implications of the nearby Open Space reclassification for our neighborhood. The Open Space designation appears to begin midway into my neighbor's parcel, raising serious concerns about potential public access, trail development, and changes to the character of our residential community.
Given the history of attempts to extend the Los Gatos Creek Trail from Meridian Avenue to Lincoln Avenue through this area, I respectfully request clarification on:
• Whether the Open Space zoning will allow public access or future recreational development through or near our private properties;
• How the City intends to protect the privacy, security, and property rights of adjacent homeowners;
• Whether any plans exist, now or in the future, to connect trails or public pathways through the newly designated Open Space parcels.
I respectfully object to any rezoning under SB 1133 that would involuntarily impact nearby private properties or enable public access without thorough homeowner consultation and explicit consent. Our neighborhood's residential character, safety, and stability must be preserved.
Thank you for your time and attention to our community’s concerns.
Sincerely,
Uma Subramanian

Dear City Council,
I am writing regarding the City of San José’s proposed rezoning of properties adjacent to Los Gatos Creek, including my property at , San Jose, CA 95125 as part of its compliance with Senate Bill 1133 (SB 1133).
I have reviewed the map available online, the proposed open space zoning leaves practically none of my backyard out of its boundaries. This unfairly limits the rights I have in the property which I have lived at for years. My security and privacy will also be infringed upon, and my home value will be very substantially decreased. These new boundaries and this rezoning make no sense, and they are a blatant violation of my rights as a homeowner.
I object in the strongest of terms, and call on you to recognize to the clear inequity of this rezoning.
Sincerely,
Christopher Archer Cucuzza
