Proposed “School‑ & Elder‑Safety Buffer” amendment to Item 2.31 Add Section 5 – Separation from Sensitive Land Uses
(a) The City shall not enter into, renew, or extend any master‑lease, service agreement, or other real‑property contract for interim‑shelter rooms authorized by this resolution if any portion of the shelter parcel lies within one‑hundred‑fifty (150) feet of the property line of:

1. A licensed preschool, elementary, middle, or high school; or

2. A licensed residential‑care facility for the elderly (RCFE), memory‑care, assisted‑living, or skilled‑nursing facility that principally serves persons 60 years of age or older.
(b) The Council may grant a site‑specific waiver only after a noticed public hearing and written findings that (i) health‑and‑safety protections for vulnerable residents will not be materially impaired and (ii) no feasible alternate site outside the 150‑foot radius exists that allows the City to meet its state‑mandated interim‑housing goals. (c) Nothing in this section shall limit reasonable accommodation required under state or federal disability law.
