SUBJECT: CARDROOM REGULATION FEE DATE: August 15, 2025

Approved

RECOMMENDATIONS

1. Accept staff recommendation.

BACKGROUND
The state has oversight of cardrooms through the California Gambling Control Commission and State Attorney General. The City of San José’s municipal code in some ways is duplicative of this oversight. Acknowledging this, the council gave direction to remove duplicative regulations in the City’s municipal code while also reducing associated costs of implementing them.

The Chief of Police and administration believe, as we do, that their recommendations to eliminate those two targeted positions will not negatively impact public safety. They also believe, as we do, that the City’s other oversight measures are reasonable, cost-effective and necessary.

We consider this council action to fulfill prior council direction. We further expect that the administration will review this fee and make any recommended adjustments on an annual basis as part of the annual review of all the fees and charges through the regular budget process.

The signers of this memorandum have not had, and will not have, any private conversation with any other member of the City Council, or that member’s staff, concerning any action discussed in the memorandum, and that each signer’s staff members have not had, and have been instructed not to have, any such conversation with any other member of the City Council or that member's staff.
