I am a longtime community member who has lived and supported local businesses around W San Carlos and Race St. for many years. I would like to share my concerns regarding the proposed quick-service restaurant at this location:
• The corridor already has multiple fast-food chains (McDonald's, Jack in the Box) within blocks.
Adding another chain will increase car traffic without improving walkability. • San José promotes local business and community events like Viva Calle, but projects like this displace existing small businesses (a taqueria, hair salon, nail salon) that have served the neighborhood for decades.
• New luxury apartments nearby continue to have empty retail spaces after years. Encouraging neighborhood-serving uses in these locations should be a higher priority. • Traffic and safety improvements (bus priority, safer crosswalks, pedestrian-friendly intersections, like those being built along Bascom and Leigh) should come before adding another drive- oriented business that may worsen congestion and pedestrian safety.
For these reasons, I believe this project in its current form does not best serve our community's long-term goals for livability, sustainability, and support of local businesses.
Thank you for considering this input.
Sincerely,
Jesse Morales

Please do not let Goliath bully David! Eduardo's is a thriving business that has been part of our community for years. Keep the local flavor and money in our neighborhood. Chick-fil-A is fine but the giant corporation should not be allowed to kick our neighbor to the curb.

Hello,
I would like to voice my concerns about the potential plans for the Race Street building currently occupied by Eduardo's Taqueria.
I do not want to see a traffic-hectic Chik-Fil-A at that corner nor at any other location in our good city. But more importantly, I want to see Eduardo's Taqueria preserved at that location. Eduardo's business is well established and owned and operated by local community members. They support the local neighborhood and do so with integrity.
Please find some other use for the old Burger King corner without infringing on the building occupied by Eduardo's.
Thank you,
Mrs. Nicolle Ramos

I am writing to oppose the appeal by Chick-Fil-A to overturn the decision not to allow the destruction of the building currently housing Eduardo's Taqueria at the corner of Lincoln and San Carlos. Chick- Fil-A is a franchise from out of State, and Eduardo's Taqueria is a beloved local business. It is difficult to understand why Chick-Fil-A would need the space occupied by this building, as they are constructing their new franchise on the site of a former Burger King with ample parking and building space. As a neighbor to this property, I feel this wanton destruction of a local building and business is unwise and unwarranted.

As a neighbor and patron of Taqueria Eduardo on Race Street in San Jose, I'm concerned about the appeal by Chick Fil-A to be able to demolish the building housing Eduardo's to make more room for the new restaurant. Although I agree that the lot at 1301 West San Carlos Street on the corner of Race street, the former site of Burger King, has become an eyesore and is in need of further development.
This should be confined to the existing lot and should not encroach on the existing businesses on Race Street. I believe that this appeal should be denied.
Should you have any questions, or any updates on this matter, please email me at or contact me at the address below.
Best regards,

Hi Jason,
I saw this ND post regarding the Chick-Fil-A being built on the corner of San Carlos St. and Race St. and they want to to knock down the building where Eduardo's Taqueria exists. They should leave that building and that business alone. They have enough space to build the Chick-Fil-A. We need to support and keep the small neighborhood businesses and not have them get pushed out/bought out by big corporations.
Thanks,
Maribet

My name is Sharin Greenleaf and I have had the pleasure of living in the St. Leo's/ Midtown neighborhood for over 30 years now. I want to support any effort to keep Eduardo's on Race Street. Of all of the choices we have in the neighborhood (and we have had many over the years), Eduardo's is our favorite, and apparently the company's most lucrative one, This ought to mean something - mainly that the neighborhood enjoys their food and can sustain the business. This has not always been the case with other restaurants near us, Mexican or otherwise.
If Eduardo's closes, many of us will have to drive rather than walk to reach their nearest location (Bascom Avenue). In a city that is trying to be a pedestrian-friendly Urban Village, this is counter- intuitive. You have to KEEP the successful small businesses, not shove them out in favor of corporate giants that don't match the neighborhood.
Our neighborhood has historically had trouble keeping interesting, delicious and fun small businesses over the years. The Alameda's past is full of businesses that started there and then moved "up" to Lincoln Avenue in WG, only to die there. Please don't let us lose one of the area's successes in favor of a parking lot eating area. Race Street is not that type of attraction. Why would anyone want to eat outside on Race Street in the midst of traffic?
Just for the record, when the new Chick-fil-A comes to the neighborhood, we (a family of 4 adults) will not go there, because we do not support their politics or policies. We believe in voting with our money.
If we HAVE to have Chick-fil-A in the neighborhood, please save Eduardo's as well. For those of us who literally support the neighborhood with our property taxes, we should be able to at least keep what makes it worth it to live here and pay those taxes.
And as a side note, maybe bring back Togo's! That's a SJ legend.
Best wishes,
Sharin MacCullough Greenleaf

My name is Sharin Greenleaf and I have had the pleasure of living in the St. Leo's/ Midtown neighborhood for over 30 years now. I want to support any effort to keep Eduardo's on Race Street. Of all of the choices we have in the neighborhood (and we have lad many over the years), Eduardo's is our favorite, and apparently the company's mos ucrative one, This ought to mean something - mainly that the neighborhood enjoys their food and can sustain the business. This has not always been the case with other restaurants near us, Mexican or otherwise.
If Eduardo's closes, many of us will have to drive rather than walk to reach their nearest location (Bascom Avenue). In a city that is trying to be a pedestrian-friendly Urban Village, this is counter-intuitive.

Dear Mr. Lee
My original letter was inaccurate. The project is proceeding at the corner of Race and San Carlos, not Lincoln and San Carlos. My corrected letter is below.

Dear Mr. Lee
I am writing to oppose the appeal by Chick-Fil-A, (Project No. H24-046) overturn the decision not to allow the destruction of the building currently housing Eduardo's Taqueria at the corner of Race Street and San Carlos. Chick-Fil-A is a franchise from out of State, and Eduardo's Taqueria is a beloved local business. It is difficult to understand why Chick-Fil-A would need the space occupied by this building, as they are constructing their new franchise on the site of a former Burger King with ample parking and building space. As a neighbor to this property, I feel this wanton destruction of a local building and business is unwise and unwarranted.
Thank you

Please include the letter below into the record.
I am requesting that the city council stand up for District 6 in the matter of the proposed project H24-046 (1301 W San Carlos Chick-fil-A).
As a life long member of this neighborhood, many of our community members do not want this establishment to be built in our area. We also do not want surrounding established businesses to be removed for an extended parking lot.
The traffic from this project combined with the new residential developments, will greatly impact the narrow two lanes of Park Ave. and Race St. This project will greatly change the quality of life and area, in a negative way.
As our City Council and a constituent of yours, I am requesting you defend us to the fullest of your abilities by denying your vote of approval. And, to persuade your fellow councilmembers to vote the same way.
We see this to be an urgent matter and would greatly appreciate your undivided attention to this important issue.
Thank you for your understanding and help to ensure we keep our neighborhood intact.
Best Regards,
loshua Watson-Mitchell

Hello everyone,
Please be aware that File No. H24-046, the Site Development Permit for the Chick-fil-A project at 1301 W San Carlos and 249-263 Race Street, has been scheduled for consideration at City Council on Tuesday, September 16 for a decision on the appeal. Specifically, the owner of the project site has appealed the project, requesting the removal of Condition 6 (which prohibits the demolition of the existing building), and also filing an environmental appeal due to the changes imposed by the Hearing Officer at Director's Hearing.
You must be present in the City Council chambers to speak on the item. Please note that the notices for this hearing will be sent out with a 1:30 p.m. time on the notice. In practice, that means that the item will be heard no earlier than 1:30 p.m., the start of the afternoon session, but could be heard at any point in the afternoon, or potentially in the evening, depending on the number of items of Council's schedule for that day. If I receive any updates on the timing of the item prior to the day of hearing, I will send it to this Interested Parties list.
All materials for the project will be posted at https://sanjose.legistar.com/DepartmentDetail.aspx? ID=21676&GUID=ACCCCFF5-F14A-4E1A-8540-9065F45A8A90, under Section 10 (Land Use) of the agenda for September 16, not less than seven days (generally ten days) prior to the Council hearing.
At this time, I would request that any comments submitted include city [email protected] so that they are captured as public comment for an item before Council. Additionally, given that this project is now going to City Council, I will not be responding to comments generally, unless there are specific questions for me to respond to, or if we find there are gross inaccuracies in a comment.

Hi Jason,
I'm writing a comment after seeing the Nextdoor update that demo of the building Eduardo occupies is up for discussion.
My suggestion is that building should be demolished and replaced by the contractor building the fast food outlet with a retail below/living spaces above. Eduardo being offered space in the ground level retail spaces.
With the amount of high rise living spaces going in nearby, I'm sure other small retail businesses would be interested in that location.

Dear, Mr. Lee.
I write to you today as I have learned that the builder for the Chick-Fil-A on San Carlos and Race Street has appealed the ruling to keep Eduardo's Taqueria in its place. I'm am an opponent of the new build. This neighborhood, my neighborhood, appreciates the small businesses. We cannot allow big corporations overrule what the citizens want.
Please do all that you can to do as the the community desires. Save Eduardo's Taqueria.

Look at downtown. We are failing with local businesses left and right, and now we will destroy a successful one? I encourage you to think about downtown Redwood City and how the local merchants banded together to defeat the Crate and Barrel conquest not so long ago.
If you care about us, and you care about San Jose, then I entreat with you to join with us, and to turn this fight into a beacon for how San Jose will respect its local business people going forward.
Thank you!

I am writing to express my opposition to the proposed Chick-fil-A at 1301 W San Carlos Street. This project is at odds with San José's vision for West San Carlos and what I want to see in this neighborhood.
The West San Carlos Urban Village Plan describes the site of the proposed development as an area with "higher-density mixed-use and residential development drawing energy from nearby Downtown San José and the Diridon Station. Development is proposed to range between three and seven stories with residential uses above a mix of active ground-floor retail." A single-story, 5, 139-square-foot fast-food restaurant does not align with this description. It actively works against the atmosphere that an urban village is supposed to foster by encouraging customers to travel by car. This location is right along VTA's 523/23 bus line and just a few minutes away from light rail on foot.
Additionally, construction of the larger parking lot detailed in the proposal would require demolishing two existing local businesses. This new restaurant should not need a parking lot larger than the one that supported the previous fast-food establishment that occupied the corner of this site.
As is currently proposed, a standalone Chick-fil-A and a large parking lot are not acceptable uses of the extremely limited land where higher-density, mixed-use development is allowed and needed in San José.
Please stand by the principles and plans we have created to guide our city and region into a better, more sustainable future. Please tell Chick-fil-A to majorly re-work its San Carlos St proposal or locate elsewhere.

To the San José City Council,
I am writing to express my opposition to the proposed Chick-fil-A at 1301 W San Carlos Street. This project is at odds with San José's vision for West San Carlos and what I want to see in this neighborhood.
The West San Carlos Urban Village Plan describes the site of the proposed development as an area with "higher- density mixed-use and residential development drawing energy from nearby Downtown San José and the Diridon Station. Development is proposed to range between three and seven stories with residential uses above a mix of active ground-floor retail."
A single-story, 5,139-square-foot fast-food restaurant does not align with this description.

CATALYZE SV
To Mayor Mahan, Councilmember Mulcahy, & the other members of the City Council, I am writing to express both my personal opposition and my organization Catalyze SV's opposition to the proposed Chick-fil-A at 1301 W San Carlos Street.
On a personal level, this project is at odds with what I want to see in my neighborhood. From the perspective of Catalyze SV's members and staff, it violates what our members want and it violates San José's vision for West San Carlos.
Background:
• In response to our action alerts over the last year, the City has received around 90 letters from Catalyze SV stakeholders expressing opposition to Chick-fil-A at this location (not to mention the nearly 5,000 people who have signed a petition about it). That is a lot of constituent input.
And it should tell you something.
• Catalyze SV has scored over 70 projects in the last 7 years and almost never opposes a project.
But this one is really misguided and our members felt we had to weigh in against it.
Reasons you should vote against approving this proposal:
1. It's not what the City government wants for this area.
I'm guessing nearly all of us in San Jose agree that a single-story fast food restaurant that displaces two small businesses is not what the City wants on San Carlos Street.
The site on West San Carlos is part of the West San Carlos Urban Village Plan. The Plan describes the site of the proposed development as an area with "higher-density mixed-use and residential development drawing energy from nearby Downtown San José and the Diridon Station. Development is proposed to range between three and seven stories with A single-story, 5, 139-square-toot tast-food restaurant does not align with this description. It actively works against the atmosphere an urban village is supposed to foster by encouraging customers to travel by car. This location is right along VTA's 523/23 bus line and just a few minutes away from light rail by foot.
If you approve this proposal, you will violate the City's own Urban Village Plan.
2. It's not what the neighborhood wants or expects for this area.
In an unusual, powerful display of unity where division regularly exists, Catalyze SV members join with neighbors, neighborhood leaders, and District 6 leaders to say that we want a mixed-use, multi-story housing on this site. As is currently proposed, a standalone Chick-Til-A and a large parking lot are not acceptable uses of the extremely limited land where higher-density, mixed-use development is allowed and needed in San José.
3. This proposal foments community distrust in the City.
If the City of San Jose collaborates with the community to create urban village plans like on West San Carlos and then we don't follow them, it undermines not only the City, it also undermines all the community investment in that process you created.
The community has placed a lot of faith in the urban village process — if you violate it now, you break trust with your residents.
4. If you want (to allow) Chick-fil-A to be in San Jose, help them find a better site elsewhere, one that is currently empty_
Allow me to address a question that might be on some city officials' minds: "Well, something is better than nothing." This is not a binary question.
If you want to allow Chick-fil-A to operate locations in San Jose, then for God sake's, encourage Chick-fil-A to occupy one of the many existing yet empty commercial spaces in San Jose! Catalyze SV has specifically suggested one location at the corner of Julian St and The Alameda that used to be occupied by a Starbucks and is on a vibrant commercial street. Why can't Chick- fil-A locate somewhere like that? It could be a win-win-win for the company, the city, and the community to find a different location.
We're happy to brainstorm with the City and Chick-fil-A other locations. I'm sure you Michael know many as well. Have you suggested alternatives? If not, why not?
5. Displacing two existing small, local businesses for a national corporation (with a problematic past) sends the wrong message to small businesses San Jose needs.
Construction of the larger parking lot detailed in the proposal would require displacing two existing local businesses. This new restaurant should not need a parking lot larger than the one that supported the previous fast-food establishment that occupied the corner of this site. Why displace two small local, established businesses in favor of a large national corporation? Please stand by the principles and plans we have created to guide our city and region into a better, more sustainable future. Please tell Chick-fil-A to majorly re-work its San Carlos St proposal or locate elsewhere.
As always, Catalyze SV is happy to talk with city staff or other parties about this. Good luck in your decision-making process — Alex

I am writing as a concerned resident of San Jose and a member of this community to formally oppose the proposed Chick-fil-A project on W. San Carlos Street.
This proposal is in direct conflict with the city's established planning documents, most notably the W. San Carlos Urban Village Plan. This plan was created to guide thoughtful, responsible growth in our area by fostering a pedestrian-friendly and transit-oriented environment. The proposed project is a dangerous step in the wrong direction.
A fast-food restaurant with a car-centric design is an out-of-character use for this planned urban village and will have several negative impacts on our community:
Increased Traffic: The design of this project will inevitably generate significant vehicle trips, adding to congestion on W. San Carlos and surrounding streets.
Public Safety: By encouraging more vehicle traffic, this development will create hazardous conditions and compromise the safety of pedestrians and cyclists who use this corridor.
Incompatible Land Use: The proposal does not align with the Urban Village Plan's goal of creating a walkable, livable neighborhood with community-serving businesses.
We deserve redevelopment that adds value to our neighborhood, not one that prioritizes a national chain at the expense of our health, safety, and long-term vision. Please reject this proposal and demand a plan that truly serves the community and respects the goals of the W. San Carlos Urban Village Plan.

What a disappointment!!
San Jose city planners aren't following their own master plan, nor do they seem to be listening to concerns of residents.
This was a perfect spot for higher density housing.
It could have accommodated this establishment below.
I sure hope that the high density development on 826N Winchester will be approved! We have to make common sense decisions to increase housing stock!! Thanks

Hello everyone,
As you may have heard, a decision on the Chick-fil-A project at 1301 West San Carlos Street was reached at Director's Hearing last Wednesday. Construction of the project was approved, but demolition of the existing building on the site was denied. Therefore, staff had to rewrite much of the permit to include new conditions, and as a result, the permit was not finalized, signed, issued, and sent out until today.
At this time, please find attached the signed permit for File No. H24-046, including conditions for the project as approved at Director's Hearing last week. As the permit has been officially sent out today, the appeal period for the permit starts today, and will end at 5:00 pm on Monday, June 30, 2025, one week later than anticipated.
I am also notifying that a timely CEQA appeal was received regarding the approved CEQA exemption on Monday afternoon; if this appeal is not withdrawn, this means the project (project + CEQA or CEQA only) will eventually be heard at City Council at a date to be determined.
Thank you,
Jason

To the City of San Jose,
I am writing as a concerned resident of San Jose to formally oppose the proposed Chick-fil-A project on W. San Carlos Street. The current proposal is in direct conflict with the city's established planning documents and vision for our neighborhood.
The West San Carlos Urban Village Plan describes this exact site as an area for "higher-density mixed-use and residential development drawing energy from nearby Downtown San José and the Diridon Station.
Development is proposed to range between three and seven stories with residential uses above a mix of active ground-floor retail."
The current proposal for a single-story, 5,139-square-foot fast-food restaurant is fundamentally incompatible with this vision. A car-centric design is an out-of-character use for this planned urban village and will have several negative impacts on our community.
This development will:
Increase traffic congestion, creating more vehicle trips on an already busy corridor.
Compromise public safety for pedestrians and cyclists in a location that should be walkable and transit-friendly This location is perfectly situated along VTA's 523/23 bus line and is just a few minutes away from light rail and CalTrain on foot. There is are two bike shares situated mere blocks away in opposite directions.
Displace two existing local businesses for a larger parking lot, an unnecessary use of extremely limited land where higher-density, mixed-use development is both allowed and needed in San José.
We deserve redevelopment that truly adds value to our neighborhood, not a plan that prioritizes a national chain at the expense of our health, safety, and long-term vision.
I urge you to please stand by the principles and plans we have created to guide our city into a better, more sustainable future. Please tell Chick-fil-A to majorly re-work its San Carlos St proposal or locate elsewhere.

In addition, judging from traffic patterns at other Chick-fil-A locations, Park and San Carlos will be heavily impacted and it does not seem sustainable for real world impacts, despite what traffic studies may have found.
Please stand by the principles and plans we have created to guide our city and region into a better, more sustainable future. Please tell Chick-fil-A to majorly re-work its San Carlos St proposal or locate elsewhere.
Sincerely,
Alanna Dutra

I am opposed to the proposed Chick-fil-A at 1301 W San Carlos Street. This project is at odds with San José's vision for West San Carlos and what I want to see in this neighborhood.
Recent development in our neighborhood has focused on mixed use, multistory buildings. Given the location of the site next to one of our City's busiest bus corridors and walking distance proximity to Caltrain, VTA light rail, and Amtrak, we can and should do better than building a single story establishment with a parking lot.
I'd like to see our city investing in sustainable developments that emphasize safety and walkability, not bring more cars and pollution into a vibrant mixed socioeconomic neighborhood with many pedestrians, cyclists, and transit users.
The West San Carlos Urban Village Plan describes the site of the proposed development as an area with "higher-density mixed-use and residential development drawing energy from nearby Downtown San José and the Diridon Station. To the San José City Council,
I am writing to express my support to the proposed Chick-fil-A at 1301 W San Carlos Street.
That location has been an eyesore, and we need some economic viability and tax dollars from them.
Best Regards,
Terrence
