A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
JOSE AUTHORIZING CERTIFICATION AND SUBMITTAL
OF THE FISCAL YEAR 2024-2025 STORMWATER PERMIT
ANNUAL REPORT TO THE SAN FRANCISCO BAY
REGIONAL WATER QUALITY CONTROL BOARD BY
SEPTEMBER 30, 2025, IN CONFORMANCE WITH THE
MUNICIPAL REGIONAL STORMWATER NATIONAL
POLLUTANT DISCHARGE ELIMINATION SYSTEM
PERMIT REQUIREMENTS, PURSUANT TO THE FEDERAL
CLEAN WATER ACT
WHEREAS, the Federal Clean Water Act requires the City of San José (“City”) to operate its municipal separate storm sewer system under a National Pollutant Discharge Elimination System (“NPDES”) permit for the discharge of stormwater to surface waters; and
WHEREAS, the NPDES permit requires the City to submit an Annual Report by September 30 of each year, documenting performance of permit required actions and certifying permit compliance; and
WHEREAS, the Annual Report follows a standardized reporting template developed by the Bay Area Stormwater Management Agencies Association, approved by Regional Water Quality Control Board staff, and used by all 76 agencies regulated by this regional permit; and
WHEREAS, the City’s activities supporting compliance with the NPDES permit are detailed in the memorandum to the City Council dated September 2, 2025, from Jeff Provenzano, Director of Environmental Services; and

WHEREAS, the City desires to submit the Fiscal Year 2024-2025 Stormwater Permit Annual Report to fulfill the requirement for reporting on activities undertaken from July 1, 2024, through June 30, 2025;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:
The City hereby certifies and authorizes the submission of the Fiscal Year 2024-2025 Stormwater Permit Annual Report to the San Francisco Bay Regional Water Quality Control Board in conformance with the Municipal Regional Stormwater National Pollutant Discharge Elimination System Permit requirements and under the Federal Clean Water Act.
