[Draft] Agenda Item 10.2: Support the Arts AND Protect Our Landmarks! From Josephine Hogin •

[External Email. Do not open links or attachments from untrusted sources. Learn morel Director Chris Burton,
Mayor Mahan and Council Members:
I urge the San José City Council to fix the proposed changes to the Historic Preservation Ordinance (PP25-005) so they support vital public projects—like the Levitt Pavilion— without opening the door to unnecessary demolition of our historic landmarks.
The City's draft ordinance creates a sweeping new override that would let Council waive landmark protections for any public or private project based on vague "overriding considerations." This goes far beyond what the recent Sainte Claire court decision requires and puts more than 200 designated City Landmarks and Landmark Districts at risk.
San Jose should support the arts, public space activation, and the Levitt Pavilion. But I do not support weakening the very Ordinance that has protected San Jose's historic places for decades.
I support PAC*SJ's call to:
1) Keep the useful clarifying definitions in the draft ordinance; and 2) Limit the new override to projects that demonstrate a compelling public interest, not speculative private development proposals that threaten to erase our architectural and cultural heritage.
This simple fix allows the Levitt Pavilion to move forward and keeps our landmark protections strong.

I urge the San José City Council to fix the proposed changes to the Historic Preservation Ordinance (PP25-005) so they support vital public projects.
The historical preservation ordinance has been used to bludgeon developers and owners to consider completely inappropriate remediations (Bank of America, Lawrence Hotel (San Fernando), Japantown businesses, and many others).
The historical preservation ordinance should be used sparingly. We don't need to preserve everything. Otherwise, San Jose will never progress. It's akin to conservatism where only the old stuff is good and new stuff is bad.
I do not support PAC SJ's many attempts to overreach in San Jose. There is obviously a need to protect some landmarks, but not every existing building deserves to be protected.
Please make changes so San Jose can develop progressively instead of leaving inappropriate legacy buildings where we need to build up for transit, culture, residences, and business.

This is about progress and the past merging comfortably and that can happen with a team of people who look at different perspectives, not just special interest. There is room enough for both when input is given from people with all different backgrounds, etc. California is a newer state in the union to begin with--let's preserve the unique history with well thought out plans to retrofit older buildings with the modern inventions of understanding how to retrofit buildings, use safe paint, etc. but not demolish them willy nilly. I have noticed more young generations appreciating the history too! How cool to see and enjoy the lovely buildings and not lose sight of this when "modernizing" areas and planning the city with a well managed blend

As a longtime resident of one of San Jose's older neighborhoods, I appreciate the preservation of the various historic structures that add to the character of an area. Willow Glen, for example, is richer thanks to the preservation of the Garden Theater, the Buffington House, and that quaint little store-front on Cherry Avenue, among others. But if the City's Historic Preservation Ordinance is relaxed too much, then practically any excuse could justify the demolition of a historic structure, and the efforts of the City's Historic Landmarks Commission would be meaningless. Accordingly, I join many others in urging you on the San José City Council to fix the proposed changes to the Historic Preservation Ordinance (PP25- 005) so they support vital public projects without opening the door to unnecessary demolition of our historic landmarks: I do not support weakening the very Ordinance that has protected San José's historic places for decades.
