UBJECT: Report on Bids and Award of Contract for the 10626 – 2026 Local Streets Remove and Replace Pavement Project
RE

COMMENDATION
(a
) Report on bids and award of contract for the 10626 – 2026 Local Streets Remove and Replace Pavement Project, to the lowest responsive, responsible bidder, G. Bortolotto & Company, Inc., in the amount of $2,601,480; and (b) Approve a 10% contingency in the amount of $260,148.

S

UMMARY AND OUTCOME
A
ward of the contract to G. Bortolotto & Company, Inc. enables the construction of the 10626 – 2026 Local Streets Remove and Replace Pavement Project (Project), which will provide needed asphalt concrete pavement repairs along 50 miles of the Local and Neighborhood Streets Network to be sealed in the 2026 construction season. Approval of the 10% contingency provides funding for any unanticipated work necessary for the proper completion or construction of the Project.

BACKG
ROUND
T
he Department of Transportation (DOT) will maintain approximately 201 miles of roadway during the 2026 construction season. As part of this effort, staff plans to seal 50 miles along the Local and Neighborhood Streets Network to extend pavement life and improve overall roadway conditions.

P
avement maintenance is typically performed in two separate phases: preparation and a final surface application. The preparation phase consists of the installation or upgrade of Americans with Disabilities Act-compliant (ADA) curb ramps and the removal and replacement of failed asphalt pavement. The ADA work is conducted in advance using COUNCIL AGENDA: 4/7/26
FILE: 26-346
ITEM: 2.9

minor contracts to provide more job opportunities for local and small businesses.

Streets to be sealed will also require the removal and replacement of any structurally failed areas of pavement prior to the final surface application phase. The final sealing application provides a thin layer of asphalt emulsion blended with rock approximately 3/8 of an inch in thickness to the pavement.

T
he City’s Local and Neighborhood Streets Network is organized into 135 geographically contiguous Pavement Maintenance Zones. The Pavement Maintenance Zones were established several decades ago to support efficient planning and delivery of paving projects, maximize the amount of paving work completed at one time within a neighborhood area, and provide geographic spread of pavement maintenance across San José.

D
OT utilizes a pavement management system to collect and store roadway condition data. This data is then used to generate a candidate list of streets to be considered for the annual pavement maintenance program. The candidate list is thoroughly analyzed by staff using the following criteria to create the final list of streets:
• F
unding availability and funding use restrictions;
• Streets on the Local Street Network;
• Streets not affected by current or future street-related projects; • Maintenance history and prescribed treatment schedules; • Streets associated with planned safety, bikeway, or other “complete streets” projects;
• Community and City Council Office feedback regarding roadway conditions and priority street segments;
• Relative location of street segments to create multiple, continuous segments, consistency within neighborhoods, and project efficiency; and • Multi-year geographic spread across the San José and street network.

D
OT staff cross-referenced the selected zones with census tracts designated by the Metropolitan Transportation Commission as “Equity Priority Communities” (EPCs), formerly known as “Communities of Concern,” to better track equity in service delivery.

Results confirmed that 256 out of 266 miles (roughly 96%) of local and neighborhood streets designated in EPC areas will be maintained by the end of the current three-year plan (2028). DOT anticipates completing pavement maintenance for nearly 91% of the local street network in this same timeframe.

D
OT has maintained a total of 228 EPC miles since 2019 and will be maintaining an additional 8.17 EPC miles in 2026, which is about 9% of the 94 miles of local and neighborhood streets selected for maintenance in 2026. This project includes 2.46 EPC miles, which is about 5% of the anticipated 50 sealing miles.

The attachment to this memorandum contains the list of streets to be sealed as part of this Project. The list may change if unforeseen circumstances arise or new information regarding other projects becomes available. Construction is scheduled to begin in May 2026 with a substantial completion in August 2026.

T
he bids from Rapid Grading Services and Wattis Construction Co., Inc. were deemed non-responsive for failing to meet the City’s experience requirements.

T
he lowest bid, submitted by G. Bortolotto & Company, Inc., is 24% below the Engineer’s Estimate. The estimate is based on bids received from similar past projects and most current estimated construction prices. The bid is considered acceptable for the work involved in the Project. One potential reason bids came in lower than the Engineer’s Estimate is due to the timing of when the Project was advertised. This Project was advertised earlier in the year compared to the 2025 contract, which was advertised later in the calendar year, closer to when contractors were into their construction season. This earlier advertisement led to a higher number of bid submissions and more competitive pricing, as many contractors had not yet committed to other projects and still had available capacity.

G. Bortolotto & Company, Inc. has prior experience in successfully delivering multiple pavement projects for the City of San José. Most recently, G. Bortolotto & Company, Inc. performed removal of failed pavement areas on approximately 36 miles of arterial streets during the 2025 construction season on the 10507 – 2025 Major Streets Remove and Replace Project. Previously, the contractor completed similar work on approximately 48 miles of arterial streets during the 2023 construction season on the 10246 – 2023 Major Streets Remove and Replace Project.

C
ontingency
S
an José Municipal Code Section 27.04.050 provides for a standard contingency of 10% on all public works contracts except those involving the renovation of building or buildings. The standard 10% contingency is appropriate for this Project.

W
age Theft Prevention Policy Check
T
he Office of Equality Assurance reviewed bidders for compliance with the City’s Wage Theft Prevention Policy on February 19, 2026, and again on March 4, 2026. No wage theft issues were identified.

P
roject Labor Agreement Applicability
T
he City’s Project Labor Agreement is applicable to this project because the Engineer’s Estimate is over $730,000.

Loc
al and Small Business Analysis
T
he recommended contractor is not a Local Business Enterprise nor a Small Business Enterprise. No local companies were listed as subcontractors.

E

VALUATION AND FOLLOW-UP
D
OT provides an ongoing evaluation of the City’s pavement conditions and provides periodic reports on this topic to the Transportation and Environment Committee. In addition to the Project discussed in this memorandum, four additional major streets and three additional local and neighborhood streets pavement maintenance projects are scheduled for City Council action this spring.

F

ISCAL IMPACTS
T
hese projects support the Transportation and Aviation Services City Service Area’s goal to Preserve and Improve Transportation Assets and Facilities. By performing pavement maintenance, the extension of the useful life of the Project streets will delay the need for more costly reconstruction. The source of funding for these Projects is
