Restore Community Partnerships: Reinstate policies that allow volunteers and rescue partners to actively promote and pull at-risk animals.
Reinstate Public Forums: Hold regular public hearings where taxpayers, volunteers, and rescue partners can engage directly with shelter leadership.
Ensure Operational Oversight: Audit shelter management practices to ensure our $17.5M taxpayer investment produces measurable improvements in animal welfare.
Our tax dollars nearly doubled to save lives, not to build higher walls around a failing system. The animals at SJACS cannot advocate for themselves, and the community fighting for them is being silenced.
Thank you for your leadership and service to District 8. I look forward to hearing how your office plans to address this critical issue.
Sincerely,
Saniya Patel

Agenda item 7.1
I live in District 10, and am writing concerning San Jose Animal Care Services. There are several issues I would like to address:
A new volunteer agreement restricts volunteers from taking photos and videos of animals, thus limiting their ability to advocate for animals to get them adopted. Sharing photos and videos on various platforms helps animals get adopted, which is the entire goal of animal care services. Volunteers need to be given permission again to take and share photos of animals that are available for adoption.
Volunteers have been retaliated against for raising concerns about the animal shelter and how animals are treated. In the workplace, retaliation is not tolerated . It should also not be tolerated against volunteers, who are spending their time, with no pay, to care for animals and their welfare . This retaliation must stop.
I continue to read stories about animals that had been euthanized after experienced volunteers and rescues had worked with them. They were devastated when they found out this had happened. They were not consulted for their behavioral observations and were excluded from decision-making before euthanasia took place. There should be a clear process of communication to ensure accurate assessments have been made, and correct decisions are made in the best interest of the animals.
The shelter needs to communicate with more transparency and collaborate better with staff, volunteers and rescues.
And last but not least, longtime volunteers who spent .v.ears caring for the animals have been removed after they advocated for the animals and raised legitimate concerns. They must be reinstated .

Please address these issues. These animals are counting on us, and it's a matter of life or death for them.
Thank you,

To: Mayor Matt Mahan and members of the San Jose City Council Subject: August 18, 2026 City Council Meeting Agenda Item 7.1 Response to Santa Clara County Civil Grand Jury Report Entitled "San Jose Animal Care Center: The need to strengthen transparency, performance and trust." Dear Mayor and City Council,
I am writing this both as someone who cares about animals and as a resident of San Jose who has experienced issues in the past two years when attempting to interact with San Jose Animal Care Center related to dog rescues.
I appreciate the fact that the Santa Clara County Civil Grand Jury investigated the significant issues at the Animal Care Center. The way we handle animals is important to all of us as a moral duty. As the location of the largest civic animal care center in Northern California, San Jose should be a shining example of best practices for other cities in providing animal services to the community .
While the City's response addresses the formal requirements of the Grand Jury report, it does not yet address the issues in a manner that instills public confidence in how the City will go about reversing certain long-observed issues.
First, I would like to complement Director Wylie and the Center for some of the actions it has already taken in recent years:
• The Center deserves credit for having improved postings about animals up for adoption , as the postings are better than those of many other similar government facilities in other cities. It would be good idea, however, to include more informational notes from staff and volunteers, when possible, in order to increase information for potential adopters.
• The Center has posted a number of statistics related to Shelter outcomes and made them easily available to the public .
• The Director has held a number of public forums on various topics and these have been a good resource for citizen engagement and a source of information to the public . It is recommended that more of these public forums be held.
This message is from outside the City email system. Do not open links or attachments from untrusted sources.
What is missing includes:
1. Too many dogs and cats are being killed. In the last fiscal year 154 dogs, 715 cats and 496 kittens were killed. While a newly documented euthanasia process is acknowledged to exist, detailed criteria for its application have not yet been made available.
2. Serious actions are needed to stem the volume of incoming stray and abandoned animals—such as more widely available spay and neuter services. At the June Community forum, I found it inconceivable that after nine months in the position, the Director said there was no plan yet but it was “at the forefront”. The response to Audit Finding 3 is unconvincing since it does not provide concrete details of the changes in services nor their recent and projected impacts. The results of the new efforts should be monitored independently by the city council and others.
3. The response to Recommendation 4 is inadequate. There have been many examples documented on social media of the Center turning away acceptance of stray animals. Without understanding the shelter’s available capacity, the public cannot understand why this is happening or why the data on such cases is not recorded or reported by the Center. The Center has committed to post data by April 2027. There should not be such a long delay in reporting this data. The Center needs to be more transparent about the details of their responses to calls about stray animals starting immediately. By refusing to accept stray animals, they are not providing the required service to the community. The website for the Center has recently –and on frequent occasions-- been posting that they are “Currently operating at limited capacity”. The public is in no position to understand why this situation should exist. We continue to see a decline in care capacity; meanwhile the taxpayers are supporting the shelter with a record-high budget of $17.5M.
4. There are too many cases of retribution towards staff or volunteers who have been summarily dismissed.
The animals are the ones that suffer the most from the loss of dedicated and experienced volunteers and staff members. The response to Finding 5 is inadequate. Annual reports have not served to convince the public that the issues with trust for volunteers and animal advocates have been, or will be, resolved in a satisfactory fashion. The conclusion of the Grand Jury report said that the Center “must embrace community members, advocates, and rescue partners as collaborators rather than obstacles.” This has not been implemented.
I close with a plea that you pay heed to the community’s concerns. We count on your leadership to address our concerns. If you plan to move forward from the Grand Jury Report, I respectfully ask the city council to increase engagement as the Animal Care Center moves to a different administrative department. Please also consider directing staff to provide more detail and additional transparency as the main issues are addressed.
Regards,
Lynne Paulson

I am writing regarding Agenda Item 7.1 and the City's response to the Santa Clara County Civil Grand Jury report concerning the San Jose Animal Care Center.
After reviewing the Grand Jury report, the City's response, and public comments submitted regarding the shelter, I believe the Council should approach this matter with neither defensiveness nor an assumption that every conclusion in the Grand Jury report is necessarily beyond dispute.
A Civil Grand Jury performs an important independent oversight function, and its findings deserve serious consideration. At the same time, an investigative report can contain judgments and interpretations as well as documented facts. Where the City has evidence that qualifies or contradicts a conclusion, that evidence should also be considered.
In this case, there appears to be substantial common ground.
The Grand Jury itself acknowledges that SJACS has made progress, particularly in implementing the recommendations of the 2024 City Auditor's report. It notes improvements in managing animal populations, development of better tools for rescue partners, and the resumption of limited public spay and neuter services. It specifically commends shelter leadership and staff for their efforts.
Those accomplishments should be recognized. Shelter employees work in an extraordinarily difficult environment involving sick, injured, abandoned, frightened, and sometimes behaviorally challenging animals, as well as residents who may themselves be experiencing financial or housing difficulties. The City's response also identifies broader pressures including rising veterinary costs, shortages of veterinarians, and increasing difficulty for some residents to afford private veterinary care.
At the same time, progress should not obscure legitimate concerns.
The shelter's budget has increased from a little over $9 million to approximately $17.5 million, with staffing also increasing. Some of that additional funding was specifically intended to improve veterinary capacity and implement prior audit recommendations. With increased resources reasonably comes an expectation of measurable improvement and transparent reporting of results.
Some outcomes are encouraging. According to the figures cited by the Grand Jury, adoptions increased substantially, from 1,468 in FY 2020 21 to 4,505 in FY 2024 25. At the same time, transfers to rescue organizations fell from 4,776 to 1,159 during that period.
That decline deserves investigation, but it also illustrates why caution is necessary when interpreting the report. The Grand Jury states that it did not determine the precise cause of the decline and acknowledges that reduced rescue capacity, coordination issues, strained relationships, and broader difficulties faced by municipal shelters could all be contributing factors.
The City's response also provides important context, noting that cat transfers declined while dog transfers more than doubled. The City nevertheless agrees that rescue relationships require continued attention.
That seems to me the appropriate way for Council to approach this issue: not by choosing between the proposition that "the shelter is failing" and the proposition that "everything has been fixed," but by determining which outcomes have improved, which have not, and why.
Transparency is particularly important.
The City agrees that historical inconsistencies in data management made year-to-year comparisons difficult and says it has standardized categories, developed dashboards, and begun daily uploads to the City's open-data system. Those are meaningful improvements.
However, the City's response declines to implement the Grand Jury recommendation to publicly report whether the shelter is operating at, above, or below its capacity for care, stating that doing so would require considerable manual effort. Instead, the City publishes daily animal inventory by species.
I understand that shelter capacity is more complicated than simply counting available kennels.
Staffing, veterinary resources, animal condition, species, and behavioral needs all affect actual capacity.
But precisely because capacity is complex and is frequently invoked when explaining intake restrictions, the public should be given a clear and understandable way to evaluate it.
The City should therefore continue looking for a practical method of communicating capacity for care rather than considering that question permanently closed.
The relationship with volunteers, rescue organizations, and animal advocates also deserves attention.
One constituent letter submitted with this item asks the City to restore community partnerships, provide opportunities for public engagement, and ensure that its substantial financial investment produces measurable improvements in animal welfare.
The language of public criticism can sometimes be strong, and individual allegations should not be treated as established facts merely because they have been submitted to Council. But residents, This message is from outside the City email system. Do not open links or attachments from untrusted sources. volunteers, foster providers, and rescue organizations possess experience and capacity that the City should not unnecessarily push away.
The Grand Jury reaches a similar conclusion, recommending that community members and rescue partners be treated as collaborators rather than obstacles and that communication about shelter policies, operational difficulties, and data improve.
For that reason, I strongly support moving forward with the proposed community advisory group. It should include a genuine range of perspectives rather than becoming either an echo chamber for shelter management or a forum dominated solely by its strongest critics. Its purpose should be practical: identify problems, improve communication, expand foster and rescue capacity, and ultimately improve outcomes for animals.
I also support continued expansion of affordable spay and neuter services. The Grand Jury and City appear largely in agreement that community demand exceeds current capacity, and the Council has already provided additional funding for increased surgery capacity and contracted services. Prevention is an important part of reducing future shelter intake rather than relying entirely on the shelter to manage the consequences afterward.
Finally, I believe compassion in this discussion needs to extend in several directions at once.
It should extend to the animals whose welfare is the reason the system exists. It should extend to residents who surrender or seek help for animals, often under difficult circumstances. It should extend to volunteers and rescue organizations that contribute substantial time and resources. And it should also extend to City employees performing emotionally difficult work under intense public scrutiny.
Compassion, however, should not substitute for accountability, just as accountability should not require assuming bad motives on the part of employees or members of the public.
I support approval of the City's response to the Civil Grand Jury with the expectation that the Council continue monitoring the substance behind it: measurable animal outcomes, reliable and understandable public data, rescue and foster partnerships, spay and neuter capacity, implementation of the community advisory group, and progress in rebuilding public trust.
The most constructive outcome would not be for either the City or its critics to "win" this dispute. It would be for fewer animals to remain unnecessarily in the shelter, more animals to reach safe homes or qualified rescue partners, residents to have greater access to preventive services, and the public to have enough reliable information to judge the shelter's performance for itself.
Respectfully,
Brian Darby

After years of animal advocates being dismissed by shelter and City leadership, two audits, multiple critical media reports, and now the Civil Grand Jury report, it is clear that you are still not listening to the constituents who have been raising these concerns. I urge you not to simply accept the City's response as written.
The Civil Grand Jury's findings validate many of the concerns that advocates, volunteers and rescue partners have been raising for years. Most importantly, Finding #5 acknowledges that there is a trust gap between SJACS and animal advocates. The Grand Jury states that rebuilding that trust requires transparency, responsiveness and sustained, meaningful engagement, and specifically says that the shelter must treat even its most vocal critics as essential partners.
That is precisely what many of us have been asking for.
We have repeatedly come to Neighborhood Services and Education Committee and City Council meetings in good faith, only to encounter dismissive or insulting responses, a lack of attention from some Councilmembers, and the absence of others. And even had our comment time cut short repeatedly. I personally reached out mult iple times to my District 2 Councilmember and never received a response.
So when the City agrees with the Civil Grand Jury that there is a trust gap, the obvious question is: What is the City actually going to do differently to address it?
The response to Recommendation #5a says the existing annual ACS report and the City Auditor's biannual status reports fulfill the recommendation to rebuild public trust. But simply publishing reports is not the same as meaningful community engagement or accountability.
The Civil Grand Jury specifically recommended a community advisory group composed of residents from every Council district and contract city. Recommendation #5b says this group should elevate community concerns, improve communication and foster meaningful engagement between shelter staff and the communities they serve.
The City says it will identify its first cohort by the end of 2026.
That is a step in the right direction, but after years of documented concerns, the community should not have to wait indefinitely for meaningful participation.
The City's response on transparency is particularly troubling.
Finding #4 states that SJACS has changed data categories, methodologies and historical data without consistently explaining those changes to the public. The City agrees with this finding.
Recommendation #4d specifically calls for the City to report the number of animals turned away because of capacity limitations on the public data portal, at NSE meetings and in the annual report.
Yet the City's response says that it will not post this information until April 1, 2027, and that it will not report the information quarterly to the NSE Committee.
There is no reason this should take this long.
Tracking and reporting animals turned away was already assigned to the SJACS Deputy Director at an NSE meeting in November 2022. It was discussed again as a follow-up at the February 2023 NSE Committee meeting.
During the eight-month animal advocate engagement process led by Deputy City Manager Angel Rios, this was the only action item assigned to SJACS.
Why was there no meaningful follow-up by the City Manager's Office or Council?
And why, after the Civil Grand Jury has now independently identified this as a transparency problem, is the City proposing to wait until 2027 to provide information that should have been tracked years ago?
The budget and veterinary services also demand greater accountability.
The Civil Grand Jury's Finding #3 agrees that the current provision of public spay/neuter services is insufficient to meet the volume of animals in the communities SJACS serves. Recommendation #3 calls for the City to expand those services through the shelter, community clinics or additional partnerships.
SJACS's budget was increased to approximately $17.5 million, after years of annual budgets of roughly $9 million or less. The City has said increased funding was intended in part to implement audit recommendations and expand veterinary services.
So why are animals still being sent to outside facilities for spay/neuter procedures, adding costs?
Why are there no veterinarians on site on weekends?
Why does the shelter continue to struggle to retain the veterinarians it hires?
And why is there not greater public scrutiny of turnover in the medical and operations departments?
These are not minor administrative questions. They directly affect the City's ability to provide timely and appropriate care to animals in its custody.
There are also concerns about implementation and training. For example, inadequate training and enforcement of basic sanitary precautions has resulted - again - in kittens contracting ringworm in adoption areas, requiring additional treatment for weeks if not months, increasing costs and length of stay and reducing the number of animals the shelter can help.
That is exactly why Recommendation #5a is important: it calls for the City to explain how it will monitor the consistent implementation of new processes and training and sustain those improvements.
Finally, there are serious concerns about the treatment of volunteers.
The removal of the Volunteer Rights section from the newly updated volunteer handbook, combined with reports of volunteers being dismissed or facing retaliation after raising concerns, is fundamentally at odds with the Civil Grand Jury's recommendation that the shelter meaningfully engage the community it serves.
This system is not working, not yet.
It is not working well enough for the animals.
It is not working well enough for the taxpayers and voters who fund this system.
It is not working well enough for rescue partners.
It is not working well enough for volunteers.
And it is not working well enough for the frontline staff who are expected to carry out the City's mission every day.
The Civil Grand Jury has given the City a roadmap. It identified problems with transparency, rescue partnerships, spay/neuter services and community trust. It specifically called for meaningful engagement with the community, even with the shelter's critics.
We are here because of the animals. We want SJACS to succeed.
We are not asking the City to agree with us on every issue. We are asking you to listen, investigate, follow through and hold leadership accountable.
The City cannot rebuild trust simply by publishing another report saying that progress has been made.
Trust has to be earned.
It is earned when commitments made to the public are actually followed through.
This message is from outside the City email system. Do not open links or attachments from untrusted sources.
It is earned when data is transparent and timely.
It is earned when concerns are investigated rather than dismissed.
It is earned when volunteers and rescue partners are treated as partners rather than adversaries.
And it is earned when Council provides meaningful oversight of the millions of taxpayer dollars being invested in this system.
I understand that these problems cannot be fixed overnight. But they will not be fixed at all without leadership willing to acknowledge what is not working, establish a clear plan, measure the results and be accountable to the public.
The Civil Grand Jury has made clear what is needed.
Now it is up to the City Council to make sure it actually happens.
Please do not simply accept this response.
Demand better—for the animals, for the community and for everyone who works and volunteers every day to support San José Animal Care and Services.
Thank you,
- Lyne Lamoureux

RE: The response to Santa Clara County Civil Grand Jury Report re : the San Jose Animal Care Center. I'd like to comment on a couple of the findings/recommendations .
Finding 3:
Spay and neuter is called out as expensive and IT IS, especially if you take into consideration that "expensive" is very subjective according to economic status . To some very low income families it is cost prohibitive. Keep in mind that a female kitten can begin having litters at four months . (Four!) She can then have up to about 50 litters in her lifetime. That is a lot of kittens which makes the urgency for less expensive options imperative. Also, people need to realize that a pregnant mama cat can be humanly spayed, and yes it would sacrifice the litter however yet another litter of cats leading horrific lives on the streets is unethical and heartbreaking. Please continue the expansion of the services/partnerships so that these services continue to be available.
Finding 5: I agree that there seems to be a lack of trust between many activists and the City/ Animal Care Center. My statement is based on observation after attending the recent Care Center initiated Community Forums . However, I am also a volunteer and donor at the Care Center. My personal experience is that the Center's volunteers are kind and patient, the front desk team are dedicated and friendly, Monica Wylie and her team are making a lot of effort and staying positive despite the ongoing (and sometimes unnecessarily harsh) criticism . The Center is kept clean and the animals that I see seem well cared for. The bottom line however is that trust takes time to build, especially with new-ish leadership . Processes (especially new ones) must be allowed to get up and running and smoothed out .
A few positives that I've observed :
This message is from outside the City email system. Do not open links or attachments from untrusted sources.
The shelter does a great job posting photos on social media (Facebook and emails) of adoptable animals so that we public can then network them.
The Center sponsored a famous Kitten Advocate Hannah Shaw "Kitten Lady" on March 7 2026 to do a public training, in addition to also training Center staff the day before. Smart move as Kitten Lady is an influencer and drew a large crowd where hopefully attendees learned something (I know that I did).
The Center has started to hold ongoing Community Forums which have been valuable to attend. For me it highlighted the need for the passionate community partners to understand how the City operates. (Example: one community member request was to "simply hire more staff." Not so simple.)
As always, I invite you, our electeds to pop into the Center as well as other places where you are reviewing performance and voting on funding
and do so informally and see what there is to see.
Back in the day, Bill (Hewlett) and Dave (Packard) called this "managing by wandering around" MBWA. A valuable and insightful thing to do.
Thank you for reading my thoughts on this important subject.

Hello,
Leam why this is imP.ortant
Thousands of San Jose city workers have authorized their bargaining representatives to call a strike. It the City and Union do not come to agreement, this will greatly impact public services including the timely proper care, cleaning, medical care and feeding of animals at SJACS.
Where is the Shelter's written emergency plan for coverage if a strike should happen? Volunteers and the public have documented numerous and continuing lapses in critical medical care, kennel cleaning and regular feeding of animals. This is especially common when staff coverage is light during holidays and callouts and has been documented over the last several years. Onsite Shelter management needs to step in, roll up their sleeves and provide basic animal care when this happens.
We are concerned that there is no organized detailed contingency plan for if this occurs.
Please ask SJACS management where all Emergency Protocols are and how and when these are communicated to staff, volunteers, and the public when visiting. This includes drills and contingency plans. The Shelter's lack of operational organization and communication is especially concerning with the recent (and continuing) fire panel issue.
Thank you,
Jeaneen Sullivan

Reinstate Fired Senior SJACS Volunteers. Protect Lifesaving Advocacy. – Petition by Animal Rescuers for Change
To: San Jose Animal Care and Services Leadership, the City Manager, Mayor Matt Mahan, and Members of the San Jose City Council
We, the undersigned, call on the City of San Jose and San Jose Animal Care and Services (SJACS) to reinstate terminated senior shelter volunteer leads Chris Chiappari and Amie Jan, and to revise the recently introduced April 2026 Volunteer Agreement and Volunteer Handbook.
Chris Chiappari and Amie Jan are experienced, long-serving shelter volunteer leaders whose work has directly supported animal care, volunteer training, dog handling safety, playgroups, enrichment, adoption visibility, rescue placement, and improved outcomes for shelter animals.
Their sudden removal raises serious concerns about fairness, transparency, volunteer morale, and the impact on animals who depend on experienced handling, advocacy, enrichment, and lifesaving support.
We recognize that shelters need clear rules, safety standards, confidentiality protections, and professional conduct expectations. But policies must not be used in a way that punishes experienced volunteers for good-faith animal advocacy, documentation of animal behavior, rescue coordination, or raising concerns.
The removal of senior volunteers with years of service damages public trust, weakens the volunteer program, disrupts lifesaving work, and harms the animals who rely on consistent support from trained and experienced people.
We are especially concerned that the NEW April 2026 Volunteer Agreement and Handbook grant Shelter Management broad discretion to terminate volunteers without cause or meaningful appeal, while also restricting photography, recording, communication with rescue partners, and communication with the media.
This is particularly troubling during a growing animal welfare crisis. As the animal shelter increasingly restricts intake due to overcrowding, volunteers often serve as a critical lifeline for shelter animals—providing enrichment, exercise, socialization, behavioral observations, and public visibility.
For many euthanasia-listed animals, volunteer photos, videos, and networking efforts are their only lifeline. These efforts have saved countless lives. 1 Unlike many shelters that routinely distribute euthanasia alerts to rescue organizations, San Jose Animal Care & Services does not broadly notify rescues or the public about many animals facing euthanasia. As a result, volunteers have often been the primary—and sometimes only—mechanism through which these animals are seen before it is too late.
Equally important, volunteers provide videos and real-world observations of dogs interacting with people, other dogs, and their environment. For foster-based rescues, this information is critical. Placement decisions depend on understanding a dog's temperament, social skills, handling needs, energy level, and compatibility with other animals. Without these observations and videos, rescues are effectively operating blindfolded when evaluating whether they can safely and successfully place a dog.
Removing this lifeline will not improve outcomes. It will simply make vulnerable animals less visible, reduce access to critical behavioral information, and make it more difficult for rescues to step forward and save lives.
At a time when more animals need help, reducing transparency and removing experienced volunteers risks limiting one of the few pathways many animals have to rescue and adoption.
Transparency and collaboration should be strengthened during a crisis—not reduced.
We therefore call on the City of San Jose and SJACS to take the following actions:
1. Reinstate Chris Chiappari and Amie Jan to their volunteer roles and leadership functions.
2. Review any recent volunteer dismissals, suspensions, or removals involving volunteers who raised good-faith animal welfare, safety, transparency, rescue, or policy concerns.
3. Revise the April 2026 Volunteer Agreement and Volunteer Handbook to include a clear, fair, and written process before volunteer dismissal, including notice of the concern, an opportunity to respond, and review by someone outside the immediate chain of conflict.
4. Add explicit anti-retaliation language protecting volunteers who raise good-faith concerns about animal welfare, safety, policy compliance, public records, data transparency, or possible violations of law or City policy.
5. Clarify that volunteers may speak publicly, contact elected officials, communicate with media, and participate in public advocacy in their personal capacity, as long as they do not claim to speak on behalf of SJACS or disclose legally confidential information.
6. Revise the photography and recording rules to allow responsible documentation of available, rescue-needed, and at-risk animals for adoption, foster, rescue placement, behavior observation, playgroup assessment, enrichment, and lifesaving advocacy, while still protecting confidential records, staff workspaces, adopters, private individuals, investigations, medical procedures, and legally protected information.
7. Create a transparent and standardized process for volunteers to submit behavioral observations, videos, photos, enrichment notes, safety concerns, and rescue-placement information so those materials are considered in animal pathway decisions. 2 8. Clarify when volunteers may communicate with rescue partners, especially when sharing animal behavior, enrichment, handling, or placement information that may help animals leave the shelter safely and alive.
9. Establish objective criteria for selecting, disciplining, suspending, or removing lead volunteers, mentors, playgroup leads, and other experienced volunteer roles.
This petition is not asking SJACS to ignore safety, privacy, confidentiality, or operational needs.
It is asking for balance, fairness, transparency, and respect for the volunteers whose unpaid labor supports the shelter every day.
Experienced volunteers are not disposable. They are part of the shelter’s lifesaving infrastructure.
We urge the City of San Jose and SJACS to reinstate Chris Chiappari and Amie Jan, revise the April 2026 Volunteer Agreement and Handbook, and work with volunteers instead of silencing them.

"As a current foster with SJACC—please
recognize the work that volunteers put into
improving animal welfare in your city. Let’s keep
everyone safe and help the animals and people
that we can. Thank you."

"The pets are vital members of our communities. I
have adopted several dogs from rescues and
shelters over the past 40+ years. They have
enriched my life, the lives of my neighbors, and
anyone who sees them. Please do the right thing
and reverse your decision and bring the two
esteemed volunteers back to make our society a
better one."

"Animals., including dogs and cats, have emotions
just like humans - they get excited, happy, sad,
depressed, and they need humans to care for
them - to provide love, shelter, humane care
because they cannot survive on their own. These
innocent animals, who have no one to care for
them, need these volunteers to keep them safe,
fed, clean, and treated with care and dignity until
they can be adopted into a safe and loving home.
Without the time, effort, care, and respect provided
by these volunteers, these poor animals are not
getting the care and dignity all animals deserve."

"I’m an animal lover. They say humans don’t
deserve animals & it’s true . We need to start
advocating for them because they can’t for
themselves. Animals are a huge part of our lives
and if they’re trained right they can make a huge
impact on us. They just need love and patience
they’re just like babies . I have 4 big dogs but one
4 is staying with me and I can say they keep me on
my 10 toes always keeping occupied . I hope
people can understand and adopt adopt and make

"No less than 10 days after a scathing Santa Clara
County Civil Grand Jury report highlighting the
repeated breakage of public trust by the City of
San Jose and the San Jose Animal Shelter, the
ACS Deputy Director Monica Wylie terminates two
highly respected dog volunteers. Miss Wylie
continues the same old same old approach and
heavy-handedness with volunteers who do a bulk
of the heavy lifting at the shelter. She is a public
servant being paid $247,000 a year to serve the
public, and yet is as tone-deaf as one can be.
Shameful."

"The photos taken by volunteers, and volunteers
reaching out to their networks, are sometimes the
only hope for animals on the euthanasia list. The
volunteers are also often the only opportunity for
the animals to have critical social interaction and
get out of their kennel. Taking this away from them
by removing volunteers only hurts the animals and
it’s the opposite of what we should be trying to do"

"Hi, a little over a year ago I saw a video on
Nextdoor made by one or more volunteers
featuring a beloved “favorite,” Lil Mama, who was
scheduled for euthanasia 48 hours after the video
post unless an immediate volunteer to foster
stepped up. I was that person & am now the proud
5 and over- the- moon happy owner of Mama! I
worked with a wonderful dedicated and passionate
rescue group, One Planet Rescue/Farah Ravon.
Lil Mama would have been euthanized had I not
seen the video posted by one of the awesome
shelter volunteers. She is a pit bull who was bred
over and over and then abandoned. She doesn’t
trust new people but as soon as she feels safe
and knows you’re not going to hurt her (it only took
me 10 minutes to earn her trust), she becomes a
love bug and thinks she a lap dog! She is super
affectionate, goofy, fun-loving and has enriched
my life in numerous ways. She also gets along
with my other 10 year old pit mix male dog, Chief.
She definitely endured a traumatic “childhood” and
had been abused and used, but now she’s safe
and loved all due to the fantastic video one or
more of the shelters took of her which high-lighted
how lovable and silly she is. Thank God I saw it
that day- it was a true “meant to be” experience
since I usually don’t watch videos that may make
me very sad - this one moved me to action, and I
can’t believe volunteers are being fired for
rescuing dogs that need a second chance. It’s
unacceptable and they need to be praised not
dismissed! By the way, Mama agrees 110%!
Several volunteers have helped me out several
times when I first started fostering her - with daily
walks when I was at work- and with transportation
to a vet visit. The volunteers give me hope in this
time we’re living in that has so many negative
events: the volunteers bring hope and positivity
and should be commended and celebrated, not
terminated! -Julie Wright (Lil Mama’s proud mom)"

To: Mayor and Members of the San Jose City Council
Cc: City Manager Jennifer Maguire; Jon Cicirelli, Director of the City of San Jose Department of Parks, Recreation and Neighborhood Services; Monica Wylie, Deputy Director, ACS Re: Agenda Item 7.1 - Petition Delivery and Request for Council Action on SJACS Volunteer Policy, Transparency, and Trust
Dear Mayor Mahan, Members of the City Council, City Manager Maguire, and San José Animal Care & Services Leadership:
On behalf of Animal Rescuers for Change, shelter volunteers, rescue organizations, animal advocates, adopters, and concerned members of the public, we formally submit the petition titled:
“Reinstate Fired Senior SJACS Volunteers. Protect Lifesaving Advocacy.” Animal Rescuers for Change respectfully submits the petition “Reinstate Fired Senior SJACS Volunteers. Protect Lifesaving Advocacy.” As of August 15, 2026, the petition has 2,197 verified signatures. We ask that this transmittal, the petition summary, and accompanying materials be included in the public record for Item 7.1 of the August 18, 2026 City Council meeting.
Item 7.1 asks the Council to approve the City’s response to the Santa Clara County Civil Grand Jury report on the San Jose Animal Care Center. That report identifies an erosion of public trust, a trust gap with animal advocates, declining rescue transfers, and the need for meaningful community engagement. The City’s own response agrees that a trust gap remains and states that a community advisory group will be created.
The April 2026 Volunteer Agreement and Handbook, and the removal of experienced volunteer leaders Chris Chiappari and Amie Jan, directly implicate the same issues of trust, transparency, rescue partnership, community engagement, and accountability. A City response that addresses “trust” while leaving these volunteer-policy concerns unexamined is incomplete.
We therefore ask the Council to take the specific actions summarized on the following pages, including a review of the April 2026 Volunteer Agreement and Handbook, a review of the process used in recent volunteer removals, meaningful due-process and anti-retaliation protections, and restoration of responsible animal documentation and rescue communication.
Respectfully submitted,
Animal Rescuers for Change (ARFC)

Council to Consider
The Following Requests
● Reinstate Chris Chiappari and Amie Jan, or provide an independent review of their terminations.
● Revise the April 2026 Volunteer Agreement and Handbook with meaningful stakeholder input.
● Create a fair, written volunteer discipline and dismissal process with neutral review. ● Add clear anti-retaliation protections for volunteers raising good-faith concerns. ● Revise photography, recording, and communication rules so volunteers can responsibly advocate for animals while protecting confidential information. ● Confirm volunteers’ rights to speak at public meetings, contact elected officials, communicate with the media, and advocate in their personal capacity. ● Create a standardized process for volunteer photos, videos, behavior notes, safety concerns, and rescue-placement information.
● Use objective, consistent criteria when selecting, disciplining, suspending, or removing experienced volunteer leaders.
Specific Council Direction Requested
● Accept this petition package into the public record for Item 7.1. ● Initiate timely PRNS, the City Manager’s Office and ACS cross-departmental review of the April 2026 Volunteer Agreement and Handbook and the process used in recent volunteer removals. ● Provide a public summary of review findings and recommended revisions ● Ensure meaningful public, rescue, volunteer representation in the community advisory group contemplated in the City’s response to the Civil Grand Jury.
ARFC | SJACS Petition | August 2026 2 Why the Petition Is Directly Relevant to the Civil Grand Jury Response
Grand Jury / City issue Connection to the petition Requested response Trust gap with animal advocates Experienced volunteer leaders were removed while new policies expanded
management discretion and restricted
advocacy-related activities.
Review the agreement and removal
process as part of the City’s
trust-rebuilding work.
Rescue relationships The petition challenges restrictions on volunteer communication and behavior
documentation that rescues use to
evaluate animals.
Create a clear rescue-communication
pathway and include rescue
representatives in the advisory group.
Meaningful community engagement The Grand Jury called for critics and community members to be treated as
partners; the City says it will create an
advisory group.
Include volunteers, rescuers,
advocates, residents from multiple
districts, and contract-city
representation.
Transparency and accountability The petition asks for objective discipline criteria, due process,
anti-retaliation language, and a review
mechanism.
Publish policy findings, revisions,
implementation dates.

Just one rescue , AFFR, saved dozens of dogs and 176 cats and kittens from the San Jose shelter, along with dozens of animals from the community. Shelter volunteers played a critical role by promoting dogs and cats, sharing information, and working directly with the rescue to help get animals to safety.
Stayed at Foster
Duchess Was tied to a fence in San Jose, taken to the
shelter. After staying over a year at foster, it became clear, she had an issue with back legs. We never
adopted Duchess, she had a very dod life, and passed
in her sleep earlier this year.
Stayed at Foster
Thor Thor developed issues with his spine, that affected hund legs, a few months after being rescued from the
shelter. We had funded his spine surgery, recovery ,
physical therapy. Thor was euthanized, after it became
clear, he still developed weakness , after a significant progress after the surgery, that lasted about a year.

In Director Icard's presentation, she referred to this commingling of data as "data cleanup" from an update - - - admitting that "A lot of them hit this fiscal year but that doesn't mean that's when it happened."
Interestingly enough, there didn't appear to be any recognition by Miss Wylie or Miss Icard that commingling data like this was wrong and corrupted the outcome data - - - making it nearly impossible to make year-over-year performance comparisons.
Given the questionable handling of the animal shelter's outcome data by highly paid animal welfare professionals, it raises concerns about whether other outcomes have experienced commingled data, and whether the City Audit recommendations involving data management have actually been implemented by Matt Loesch and SJACS Management.
For example, one wonders if the outcome data of Trap, Neuter, Return (TNR) and Return to Field (RTF) - - - in which the primary determining distinction is made based on whether or not spay/neuter was performed as a shelter service (TNR) or as a shelter function
(RTF) have also been commingled.
The latter (RTF) allows the shelter to receive credit for a live outcome, which is part of the Live Release Rate calculation. The former (TNR) does not. TNR is not considered a live outcome.
Municipal shelters have been known at times to outcome TNR cats as RTF - - - which in effect inflates their live release rate.
This distinction and the potential for commingling of TNR and RTF data was in fact noted by the City Audit on page #60 in which the auditor found that:
"It is not clear how consistently staff track TNR services to distinguish whether the shelter is providing it as a public service versus as a sheltering function."
Perhaps even more puzzling was the Medical Director's directive to shelter staff in late December of 2024 (after the Audit was released in November of 2024), in which Dr. Kather stated:
"When outcoming TNR cats and RTF cats the outcome type is always RTF"
(see attached and below)
At the end of the day, it should be obvious that any commingling of outcome data undermines the public's ability to measure the actual performance of the San Jose Animal Care Center.
Moreover, the Santa Clara Civil Grand Jury Report of May 27th, 2026 cited in Recommendation #4a that:
"The City must provide accurate, clear, and complete data so the public can assess performance. Formal protocols for data handling, security, and publication should be established to ensure data is accurate, standardized, and consistently reported."
Furthermore, the Santa Clara Civil Grand Jury Report cited in Recommendation #4c that:
"The City should require that when SJACS makes changes to its posted data or data categories, that SJACS should consistently provide the public with a rationale for the modification and note of the change."
Contrary to Public Works Director Matt Loesch's memorandum and response of August 6th, 2026 to the Civil Grand Jury Report and claim that Recommendation #4c has been implemented, it has not been implemented when it comes to the shelter's public dashboard.
There is nowhere on the SJACS Public Dashboard that indicates any changes or modifications to data.
There are no footnotes. There are no notifications.
As a result, the public has no idea that the data they are looking at in this particular outcome of Missing Animals for FY 2025 - 2026 has been commingled or modified.
Given the 39 recommendations made by the City Audit, how can the public have confidence in measuring any improvement at SJACS if they can't trust the data published by the City to be accurate, transparent, and reliable?
I was disappointed to see ACS Deputy Director Wylie and Division Manager Icard not have any issue with such data contamination.
It was shocking to witness, to say the least.
This is not the kind of job performance that the public expects from two highly paid animal shelter professionals. It is not just unacceptable; it is inexcusable.
Sincerely,
Mike Wagner
Former board member and interim president

Subject: Outcoming TNR and RTF cats
When outcoming TNR cats and RTF cats the outcome type is always RTF. Do NOT use SPAY as an outcome, that outcome type was used when the shelter was able to provide low cost spay/neuter services to owned animals which is not something we are able to provide at this time.

I hope your week is going well. I have gathered information as requested for you.
To your point, “Missing” is an outcome category used by shelters when an animal’s whereabouts are unknown. It could be someone stole an animal, an animal escaped, or something along those lines, such as the foster scenario you mention. With thousands of animals, unfortunately, it can happen.
As it turns out, there have been 3 FY 25-26, 6 FY 24-25, 12 FY 23-24, and 2 FY 22-23.
They all show up for the report you are referencing since we recently cleaned up our data back in July 2025.
For ACS, 10 were foster scenarios as you mentioned, 10 are entered as lost, and 3 escaped from 2022-to-date.
I hope you find this information helpful as we continue to improve our processes.
Best,
Monica

Subject: San Jose Shelter Public Dashboard Inquiry
[External Email. Do not open links or attachments from untrusted sources. Learn more]
You don't often get email from Learn why this is important
Good afternoon Monica,
I’m reaching out with a question about the shelter’s public dashboard. According to the data, 23 animals have been listed as “missing” since July. I wanted to ask whether this reflects a data or reporting issue or if these animals are truly in unknown locations?
During my time at the shelter, I recall one or two instances where animals were placed with a foster who later went unresponsive, but I was surprised by this number overall, as it averages to roughly one animal every eight days.
Would it be possible to get a bit more information on this such as whether there are associated animal IDs or a clearer explanation of what “missing” encompasses in this context?
Link to the public dashboard for reference:

I have little faith personally in other members of management, but really hope to see you succeed as it's clear you care.
Thank you for your time, and I truly appreciate the work you’re doing. I’m hopeful for positive change and want to see the shelter succeed.
Thank you,
Courtney Ferro

The San Jose Animal Care Center provides a Public Dashboard with a variety of intake and outcome data in real-time that is updated on a daily basis.
Unfortunately, this data does not match the Monthly ASPCA Kennel Report Data that is furnished by the City via a public information request. Moreover, there is no explanation offered as to where this data is sourced or why this data does not match.
For example, through the first 6-months of CY 2026, the Cat and Dog Outcome Data shows a discrepancy of 15% and 19.7% respectively between the ASPCA Monthly Kennel Report Data and that of the SJACS Public Dashboard.
ASPCA Kennel Report January - June 2026 Public Dashboard
Cats: 3,443 +15.0% Cats: 3,003 Dogs: 2,320 +19.7% Dogs: 1,938
Public Works Director Matt Loesch claims that the City has complied with the Civil Grand Jury’s recommendation #4a, noting that:
“The final version of shelter performance is produced annually” and that the “dashboards and open data portal give a glimpse into the moving target of performance, but should not be viewed as final.”
Given the material discrepancy between what the ASPCA Monthly Kennel Reports reflect compared to that of the SJACS Public Dashboard, it’s difficult to discern which dataset is more accurate or why there is such a massive disparity. No notations are provided by SJACS; nor are there any explanations on whether these two data sets are based on differing definitions of outcomes or purposes.
Quite frankly, Mr. Loesch’s remarks regarding the degree of accuracy of the Public Dashboard discounting it as some sort of a moving target is highly problematic
and should not absolve the City from its responsibility to provide accurate data. I would suggest that merely relying on the (after-the-fact) fiscal year Annual Report as he states, does not conform to the spirit of the Civil Grand Jury recommendation for accurate, clear, and complete data, especially given the community's reliance on real-time data.
The San Jose animal welfare community is grateful for a Public Dashboard that updates data on a daily basis. This platform has been a “work in progress” since the Summer of 2022. But when this data set doesn’t come close to matching the ASPCA Monthly Kennel Reports, it raises a whole new set of questions. We are This message is from outside the City email system. Do not open links or attachments from untrusted sources. talking about a disparity of 15% for cats and nearly 20% for dogs for basic outcome data for a 6-month period.
Again, no footnotes are offered as to what these two data platforms are specifically offering in the way of data points and where that data is sourced from - - - not to mention if there are different definitions or parameters involved for their respective data collection which could serve as the basis for these outcome discrepancies.
When looking at a specific outcome such as Cat Euthanasia, we also see a discrepancy between the two data sets of 7.1% during this same six-month period (579 vs 620), with the SJACS Public Dashboard showing a lesser data-point compared to the Monthly ASPCA Kennel Reports.
Given these material discrepancies, the data provided by SJACS does not appear to be accurate, clear, or complete and as a result, in my opinion Mr. Loesch has not complied with Recommendation #4a mandated by the Civil Grand Jury Report.
Sincerely,
Mike Wagner

On July 15th, 2026 at 4:36 PM Katherine Brown, an Assistant Director in Public Works received materials on how to implement a Fire Watch from San Jose Fire Captain Quentin Wilcox after Miss Brown had contacted San Jose Fire Deputy Chief Greg Tuyor about a faulty fire panel.
Apparently, a fire panel at the San Jose Animal Care Center was no longer functioning properly and the request on how to implement a Fire Watch was made by the San Jose Public Works Department.
Literally one hour from when this request was made by Katherine Brown, a monthly Community Forum Meeting was to be held in the classroom of the San Jose Animal Care Center at
2750 Monterey Road hosted by ACS Deputy Director
Monica Wylie and Division Manager Kiska Icard.
This meeting was due to be “contentious” given that animal welfare advocates were also protesting the termination of two widely respected dog volunteers before and during this scheduled meeting.
Just one hour before the Community Forum was to begin, the SJACS Management team cancelled the forum. A post went up on the SJACS Facebook page that indicated that the shelter was being closed to the public for “Essential Industrial Maintenance”.
To be clear, a Fire Watch does not require the closing of a building to the public. The San Jose Fire Department makes no such requirement.
SJFD merely requires that the building in question have a security guard or a staff member (reassigned) to patrolling the building for fire and maintaining a logbook on the premises which contains a directory of names, phone numbers, and other information to assist in making emergency calls and calls to key management personnel.
The logbook “shall be used to record a history of patrol rounds. The frequency of rounds shall be as approved by the San Jose Fire Marshall.”
In subsequent phone conversations that I had with Fire Captain Wilcox and Fire Inspector Lawrence Mitchell about this specific Fire Watch request at the San Jose Animal Care Center, I learned that it is not the policy or requirement by San Jose Fire to have the building in question closed to the public.
This message is from outside the City email system. Do not open links or attachments from untrusted sources.
As a result, the consensus of the San Jose Animal Welfare Community believes that the cancelling of this meeting for a fire panel (that had been found to have chronic issues earlier in the year) - - - was simply yet another sharp “stick” poked in the eye of animal advocates by the Public Works Department. The community is highly skeptical of the timing of this
fire panel “event” that closed the shelter to
the public.
The continued lack of good faith engagement by the City with respect to the animal welfare community continues to be a critical issue. This “event” and the termination of two dog volunteers just ten days after the publication of the Civil Grand Jury report flies in the face of the spirit of said report:
"For the shelter to succeed, it must not only focus on housing and treating the animals under its care, but also fully embrace the community it serves - - - including foster and rescue organizations, volunteers, and its critics - - - as essential partners in improving outcomes for animals. The Civil Grand Jury finds that for all parties to begin rebuilding trust,
SJACS must embrace community
members, advocates, and rescue partners as collaborators rather than obstacles."
Sincerely,
Mike Wagner

2019, my advocacy has apparently become “a distraction to staff from important work” according to Deputy City Manager Jennifer Schembri.
Sadly, my IP Address has been blocked by the City Manager’s Office this year and my First Amendment Constitutional Right
has been terminated. My ability to speak up for poor,
defenseless animals that have no “voice” has been suppressed by the City that has never held a single director or deputy accountable for the mismanagement and decline of SJACS.
Given the spirit of the Santa Clara County Civil Grand Jury Report of May 27th, 2026 - - - I would hope that the City would refrain from future retaliation against animal welfare advocates such as myself and embrace the report's findings in an effort to work with the Community and rebuild the significant erosion of public trust that has occurred over the years.
Sincerely,
Mike Wagner

Hi Aram,
Jennifer mentioned that emails from Mike Wagner regarding the Animal Shelter were being filtered and sent to you. I let her know that, for now, it’s not necessary to filter the ones addressed to me.
Most of his questions to me related to our 2024 audit.
Mike recently followed up about a few emails he had sent and was wondering why I hadn’t responded. I’m fine receiving his messages directly. I only respond to specific questions related to our audit and do not engage with other aspects of his concerns.
Thanks,
Joe Rois
