Thank you for your consideration.

This message is from outside the City email system. Do not open links or attachments from untrusted sources. sharing this living space I try to be a good neighbor by thinking about how my actions impact others.

I am concerned about the audible volume that the San Pedro Social would be allowed to emit.

Will the venue have adequate sound proofing? Will I be able to sleep without interruption when it's dark out? I am alarmed that the city would consider allowing a late night club in an area so close to residential zoning.

Potential solutions:

1. San Pedro Social is not granted the late-night operation permit at their current address close to several high-density housing units.

2. San Pedro Social can continue to serve food and drinks after 10PM Sunday - Thursday (or 12AM Friday - Saturday), but they lower amplified music such that it cannot be heard outside the establishment.

3. The city strictly enforces a sound curfew/ quiet hours for the establishment: Perhaps for 10pm - 2am, the sounds heard from immediately outside the club has to stay under 70dB at risk of monetary fine.

Thank you for allowing me to share my concerns in the public forum.

Re: Subject Property: 163 W. Santa Clara St., San Jose, CA Subject Business: San Pedro Social
Property Owners, Lessors, and Lessees:

The San José Police Department (“SJPD”) has brought to the attention of the San José City Attorney’s Office (“CAO”) information showing that your property, located at 163 West Santa Clara Street, San Jose, California (“Subject Property”) and the business located there, “San Pedro Social” (“Subject Business”), has been used for nuisance activity, including, among other things, operating a business after 10pm without the required Conditional Use Permit (CUP), operating as a nightclub without the required Entertainment Permit, operating in violation of Alcoholic Beverage Control rules and regulations, and allowing the Subject Property to be used in a manner that creates or fosters the creation of a public nuisance.

Records show that you own, manage, and/or control the Subject Property as owner, lessor, and/or lessee. Therefore, this correspondence is directed to you as the ultimate responsible parties for this nuisance.

The Subject Property has been the site of multiple reported nuisance activities including, but not limited to, unpermitted late-night operations until 2am; unpermitted public entertainment, including amplified music and dancing; over-serving alcohol; and

multiple fights requiring police response. The nuisance activities have led to multiple disturbances, including:

 A July 28, 2025 fight that began inside the Subject Business and continued outside. A victim required emergency medical treatment.  A stabbing that occurred shortly after 2am on March 23, 2025, when patrons exiting the Subject Business crowded onto the street. The victim was violently assaulted and suffered life-threatening injuries.
 A fight inside the Subject Business at approximately 1am on September 1, 2024. A victim was transported to the hospital.
 A hate crime on August 17, 2024, as patrons were exiting the Subject Business at 2am. The suspects used homophobic slurs before assaulting the victim.
 An assault at 1am on August 3, 2024 inside the Subject Business.  An assault of a security guard at the Subject Business at 1:40am on May 6, 2024.
 A fight among patrons of the Subject Business shortly after midnight on March 9, 2024.

SJPD has investigated the Subject Business and Subject Property and found that you have continued to violate multiple state and local laws. Those violations have continued despite prior admonitions from SJPD that you cannot operate without appropriate permits. In addition, San Jose Code Enforcement issued a Compliance Order on February 27, 2025 requiring you to cease all unpermitted uses and obtain required permits. The Subject Business continued to operate as an unpermitted nightclub. The matter was then addressed by the Appeals Hearing Board, which issued a resolution on April 10, 2025 requiring cessation of all post-midnight business activities by May 27, 2025. The Subject Business has nonetheless continued to operate after midnight.

The City of San José (“City”) is permitted to bring an action to abate and enjoin this public nuisance both under state law (Civ. Code §§ 3479, 3480, 3490 et seq.) and its own authority (SJMC §§ 1.08.010, 1.08.015). This is in addition to the City’s authority to bring an action for unfair competition pursuant to Business and Professions Code sections 17200 et seq. Besides abatement and an injunction, the City is permitted to recover in such an action a variety of remedies, including civil penalties up to $2,500 per violation per day and costs, including the cost of investigation and discovery.

To date, the City has expended valuable enforcement and investigative resources associated with the ongoing nuisance and violations at the Subject Business and Subject Property. You are being notified because as the owner, lessor, and/or lessee of the Subject Property, you are responsible for preventing all illegal activity and nuisance activity from occurring at your business or your property.

SUBJECT: SP25-003 DATE: May 2, 2025 San Pedro Social Club

Approved Date

I have received your request for input regarding the existing San Pedro Social Club (SP Social Club), located at 163 West Santa Clara in San Jose. SP Social Club is seeking a Special Use Permit to allow late-night use. SP Social Club currently has Type-47 – On Sale General – Eating Place ABC license. A Type-47 is issued to restaurants.

This business is requesting to stay open from:

5:00pm – 10pm Tuesday-Wednesday
5:00pm – 2:00 am Thursday
3:00pm – 2:00am Friday-Saturday
1:00pm – 8pm Sunday
Kitchen: 6:00am-4:00am
Front of House: 10:00am-4:00am
(Refer to business’ operation plan for further details)

Per Business and Professions (B&P) Code Section 23958, the State of California Department of Alcohol Beverage Control shall deny an ABC Application for an ABC License if the issuance of that license would tend to create a law enforcement problem or if it would result in or add to an undue concentration of ABC Licenses, as described in B&P Sections 23958.4 (a)(1) and 23958.4(a)(3). A location can be unduly concentrated because of its criminal statistics and/or it’s proximity to other ABC Licenses. ABC can issue the license per B&P Sections 23958.4 (b)(1), and 23958.4 (b)(2) if the local governing body determines that the public convenience or necessity would be served. The City of San Jose Planning Department and the Planning Commission are the delegated authorities to grant these exceptions.

163 West Santa Clara is in San Jose Police Beat E2. The reported crime statistics as defined by B&P Section 23958.4(c) are over the 20% crime index thus the location is considered unduly concentrated per B&P Section 23958.4 (a)(1) for on sale establishments.

Pursuant to B&P Section 23958.4 (a)(3), the ratio of on-sale retail licenses population in census tract 5008.00 does exceed the ratio of on-sale retail licenses to population in the county in which the applicant premises are located if approved.

A record check of SP Social Club revealed the San Jose Police Department has investigated and found that this business has continued to maintain or use the property or allow the property to be maintained or used, in a manner that creates or fosters the creation of a public nuisance. This is a violation of the San Jose Muni Code (SJMC) Section 1.13.040, California Civil Code Section 3479, and California Penal Code Sections 372 and 415. Below are violations that occurred within just over approximately one-year span from today’s date:

• On 3/27/25, at approximately 1854 hours, a battery occurred on the premise. The suspect entered the business and shoved the victim. The suspect then retrieved a table from the patio and threw it over the counter at a pizza oven. (SJPD case #: 25-086-0756) • On 3/23/25, at approximately 0208 hours, an assault with a deadly weapon occurred on the premise. The suspect assaulted the victim. The victim sustained a brain bleed, skull fracture, and multiple abrasions to his face. Per doctor’s, the victim’s injuries were life- threatening injuries. (SJPD case #: 25-082-0089)
• On 2/16/25, at approximately 0005 hours, a reporting party called in stating that the suspect punched the victim, and he was bleeding from the head. She reported that there were approximately 20-30 subjects in a physical. (SJPD case #: 25-047-0009)

• On 9/1/24, at approximately 0059 hours, a battery occurred on the premise. The two victims were punched, kicked, and their hair was pulled by unknown suspects. One victim was transported to the hospital for their injuries. (SJPD case #: 24-245-0057) • On 8/17/25, at approximately 0200 hours, a hate motivated assault occurred at the business. The suspects used verbal slur referring to both victims. One unknown suspect punched the victim in the chin, the other suspect punched the other victim approximately five times in the head, three times in the face, and five times in the leg. The victims refused medical at the scene. (SJPD case #: 24-230-0094) • On 8/3/24, at approximately 0130 hours, a battery occurred on the premise. The suspect punched the victim once in the jaw causing the victim’s jaw to become swollen and bruised. The suspect was outstanding at the time of the report. (SJPD case #: 24-217- 9706)
• On 6/12/24, at approximately 0014 hours, a reporting party who lived near the rear of the business, called to report that the business has been playing loud music. (SJPD case #:
24-164-0010)
• On 5/6/24, at approximately 0140 hours, a battery and vandalism occurred at the business. The suspect punched the victim multiple times in the face. The suspect then punched the window to 163 W. Santa Clara Street. (24-127-0070) • On 3/9/24, at approximately 0010 hours, an assault with a deadly weapon and battery occurred inside of the premise. The suspect pushed the victim. Shortly after, a female suspect confronted her and choked her constricting her airway. The victim sustained a complaint of pain and bruising to her neck. (24-069-0017)

Many of these incidents occurred after midnight. These violations negatively affect the health and safety of the citizens of San Jose.

ABC and Vice received complaints about this business not following local and state laws from patrol officers, concerned citizens, and surrounding businesses. There were on-going safety concerns regarding how this business was conducting themselves along with violence amongst patrons. On 1/22/25, Vice conducted an IMPACT inspection and spoke with Ja’Vonn Williams, who identified himself as one of the managers. Detectives reminded him of the responsibilities and accountability associated with the sale of alcohol. Furthermore, a checklist was used to note any violations observed and it is given to the licensee. On 1/23/25, Vice advised Mr. Williams that the business was in violation of 6.60.012 SJMC, and they needed an Entertainment Permit (EP) due to them meeting criteria in section 6.60.028 and 6.60.030 SJMC) (occupancy load over 100 patrons per the Fire Marshal and live entertainment). Mr. Williams informed me the person to speak with regarding completing an EP would be Jess Morales ([email protected]). I forwarded this information to SJPD Permits Unit.

SJPD Permits Unit tried contacting the business approximately four times to advise them that they were out of compliance and needed an EP but there was no response. A reasonable amount of time passed for this business to complete an EP, but they have failed to do so.

This business has a Type-47 ABC license which is issued to restaurants. Based on the flyers and promotions on their social media and business website, it appears that it operates more so like a nightclub i.e. charging cover, bottle service, VIP tickets, etc. with games.

A record check revealed that SP Social Club does not have a valid late-night permit. As mentioned above, multiple calls have been generated after midnight including violent incidents and disturbances. Although Condition #1 on their ABC license says, “Sales, service, and

consumption of alcoholic beverages is permitted until 2:00 AM” they are still required to obtain proper late-night permit(s) to be in compliance with local laws. This business has been operating late-night well before them applying for a special use permit. The SJPD is concerned that similar activity will occur if this business is allowed to operate late-night.

The San Jose Police Department recognizes that there is a demand to compete with neighboring businesses without limiting patron’s experience along with bringing vibrancy to the downtown area. The type of entertainment is permitted given a business in the City of San Jose is operating with the correct licenses and within policy. However, based on the totality of circumstances including violent calls for service, majority of the above occurring after hours, surveillance videos of patrons getting into physical altercations on and around the premise, the business conducting themselves like a nightclub and not a restaurant (charging cover, bottle service, VIP tickets etc.), being in violation of not having a valid entertainment permit, operating late-night before applying for a special use permit, and multiple attempts to contact the business regarding an entertainment permit with no response, SJPD does not recommend this business get a special use permit.

The City of San Jose’s Code Enforcement has an open investigation against this business, as well. Contact Code Enforcement for further information.

Vice emailed surveillance footage to Alexandre Hughes from San Jose Planning Department which show various physical disturbances between patrons in and around the business. Refer to photos below for further information regarding SP Social Club promoting their occupancy load, promotion of live entertainment, bottle service promotion, and after-hours information.

With the public’s safety and welfare in mind, The San Jose Police Department is opposed to endorsing San Pedro Social Club’s Special Use Permit to allow for late-night use.

The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand. • Full and complete meals must be offered, and made available, at all times the premises is exercising the privileges of its alcoholic beverage license, with the exception of the last ½ hour of operation each day.

Re: Information Letter CP25-025 – San Pedro Social

As the Land Use Consultant for San Pedro Social (SPS) after seeing the staff report that was available August 14th, I thought to give some background to help you with your decision regarding the Conditional Use Permit for San Pedro Social (SPS). Unfortunately, there are many discrepancies in the report regarding current code issues that are non-existent and can be proven.

As the consultant I worked closely with the assigned city planner Alexandre Hughes to address his 11-page letter (3
rd version) with his comments and required revisions. I/we thought the collaboration put everyone on the same page as to how San Pedro Social would operate to comply with a Conditional Use Permit to have a nightclub & bar with late night hours until 2:00 AM as an addition to their existing restaurant & bar. To our surprise, Alexandre came up with a 4 th 11-page response document.

The owners of San Pedro Social, SPSocial LLC were not experienced night club operators and not familiar with the City of San Jose’s permit requirements. They started operating as a restaurant in March 2022 during Covid, added DJ entertainment and after midnight until 2:00AM and no one told them to cease that operation until 2025. There was an assumption that the right to operate as a nightclub/bar until 2:00 AM was on-going since the previous tenants had the same operation. During discovery by accessing permits.sanjoseca.gov for this project, I found that AP Stumps, a previous tenant, had gone (6) years without a CUP presumably because they had the same assumption. They got a CUP with a compliance condition in 2010 that expired in 2015 during the next tenant’s occupancy (2014), AFK Gamer Lounge that also operated after midnight without a CUP until 2018.

Change is what has made the difference to the current and future operation of San Pedro Social. Yes, there were code and police issues but change in management on July 01, 2025, to Margin Link, a professional restaurant and entertainment management company, made a considerable difference. The new management staff took 1-2 months to get familiar with the operation and the City’s requirements and then it became apparent that San Pedro Social was on the right track.

At present, there are no outstanding City Planning nor Police Department code violations. Those issues were addressed by stopping after midnight until 2:00 AM on April 19, 2025, and by stopping the operation of entertainment as of September 18, 2025. The staff report only calls out the negative history of Social and does not mention the change that has occurred which does make it compliant with the General Plan and the Zoning Ordinance. With all the change and cooperation, we expected a neutral position from police staff that had been discussed with San Pedro Social staff and Mike Messenger, that didn’t happen.

Police Department. Incident reports were obtained by San Pedro Social staff dating back to 2023. There are numerous negative reports in the final Police memo to planning staff and city council that are not supported by the actual incident reports on file. For example, incidents noted on Monday nights when Social was closed. Police staff stated they would do an addendum to address those incidents which they did, but the additional information did not match the actual incident reports so did not remove the fault from San Pedro Social.
2 Building Department violations were addressed in Spring 2026 by securing a permit from the Building Dept for unpermitted electrical work in the back patio for games, and in the Slice of Homage area for unpermitted electrical for a warming oven, an oven, and installation of a sink. The total remodel of the SPS space prior to opening was done with permits.

Historic Preservation issues in the patio have also been resolved as it has been emptied of benches, containers, large games and more. Tables and chairs remain.

Change, Coleman Security & Investigations (CSI), a highly rated security company, replaced Redwood Security on July 1, 2024. Their original contract has been revised to accommodate the anticipated CUP conditions related to when there is entertainment, minors need to be vacated and for private events.

Sound levels when a DJ or other entertainment is present have been measured and adjusted by a sound professional, Sal Cerrillo to accommodate anticipated CUP conditions and an Entertainment Permit. Sal provided a letter with his education background and experience that show he can keep San Pedro Social in compliance with the CUP noise requirements.

As a previous Urban Planner in Downtown San Jose working for the Redevelopment Agency (RDA), City of San Jose since 1986 - 2006 I have a considerable amount of experience working with and for entertainment/nightclub operators to obtain their Conditional Use Permits and maintain their businesses.

I have also been a consultant doing the same work for 25 years.

In 1991 as RDA staff, I processed the first CUP for DB Coopers restaurant with entertainment and operating until 2:00 AM at the same location as San Pedro Social. Former Mayor Tom McEnery as the landlord/property owner signed the CUP application and the rest of the CUP permits for the other tenants that followed as he was adamant about having entertainment uses in San Pedro Square area. The former mayor also has a 15% interest in ownership of San Pedro Social.

The RDA the same as the City of San Jose, wanted entertainment and events to make downtown vibrant and attractive so people would rediscover the area after the considerable investment that had been made that included the addition of the light rail. The RDA was very supportive of businesses that wanted to open downtown but also strong on compliance so that downtown would not be set back to how it was prior to redevelopment.

Entertainment, i.e., nightclubs, bars, theaters, come with noise, police calls, and drinking. The key to downtown success at that time was to stay alert to renegade uses and to tailor the land use permits like CUPs to control the new entertainment businesses and keep downtown safe.

Six years, three years nightclubs operating without Conditional Use Permits, should the blame be placed just on business owners or also on city staff that is not looking and process that is not working? Perhaps it is time for change in those areas as well.

3 The business owners, particularly Mike Messinger, Managing Member are vested in the success of San Pedro Social for personal and financial reasons. They want to move forward to that goal by being compliant with all the requirements and conditions that come with a Conditional Use Permit and Entertainment Permit. They have their new managers, consultants and staff that can do it, now they need their Conditional Use Permit.

Thank you for your consideration of our request for your support of a Conditional Use Permit for San Pedro Social.

Sincerely,

Sandra Escobar

Vice Unit
The incidents below were included in a memorandum from the San Jose Police Department Vice Unit to the Planning Department (CP25-025) dated March 31, 2026. These incidents were police calls for service that occurred from January 2025 to March 2026. The bullet points provide additional information and clarification to those incidents.

Sgt. Pham,
After our review of the police memorandum incidents using the official incident reports as comparisons it appears that possibly nine (9) out of ten (10) incidents may not apply as a reason for taking a denial position against a Conditional Use Permit for San Pedro Social.

The phrase “vicious events” is used numerous times in planning’s staff report regarding incidents. There are no vicious events listed that remotely apply to San Pedro Social’s operation.

1. On 03/06/26, at approximately 2137 (9:37pm) hours, a premise check was conducted at the business. Staff informed SJPD they were having a private event that was scheduled to end at 2200 hrs (10:00PM). There was a DJ playing loud music, flashing lights, and a crowd. The crowd was standing in an open area, between the bar and DJ. From the entryway and position of the SJPD officer, there were no visible patrons eating meals. The business did not have a Public Entertainment Permit. (SJPD case #26-065-0905)

Comment: Contracted event, Buy Out of San Pedro Social. Event was not open to the public. Management staff had a conversation with Sgt. Galea regarding the rules for private events, and particularly the Astera Labs event (see attached contract) so felt comfortable proceeding.

Food Service. The event contract (attached) clearly states that food was purchased for the event and served to the attendees.

Police Citation. Request that this incident be clarified for Council and removed from the police memorandum as a negative illegal incident being used as one of the reasons for not supporting the Conditional Use Permit.

• (Per Sgt Pham) Private events are allowed to have music since business is not open to the public.

2. On 02/26/26, Thursday at approximately 2055 hours (8:55PM), a disturbance was reported inside of the business. The RP was an employee who stated their manager, Ja’V onn Williams,

201 W . Mission St. San José, CA 95110 (408) 277-4041
was attempting to kick out a patron who was yelling and refusing to leave. The patron left before police arrival. (SJPD case #26-057-0870).

Comment: San Pedro Social was operating only as a restaurant that Thursday night. Management has the right to remove a nuisance customer. No security was present, Social was not operating as a nightclub nor late night use.

Police Citation. Request that this incident be clarified for the Council and be removed from the police memorandum.

3. On 10/9/25, Thursday at approximately 2230 hours (10:30PM), violations of an entertainment permit occurred at the business. The business was witnessed to be operating as a nightclub. The business did not have an entertainment permit, which is required if the business wants to operate as a nightclub. (SJPD case #25-279-0397)

Comment: San Pedro Social was operating as a restaurant. According to management 2 women were dancing by their dining table to the background music (no DJ) that was being played. There was no nightclub activity. No security was present that evening.

No late-night activity.

• (SJPD case #25-279-0397) Incident occurred on 9/22/25, Monday at approx. 2230 (10:30PM) hours, a violation of an Entertainment Permit occurred at SP Social located at 163 West Santa Clara Street.

Comment: San Pedro Social does not open on Mondays. This incident must be an error and should be removed from the police memorandum.

4. On 8/27/25, Wednesday, at approximately 2216 (10:16PM) hours, a former employee caused a disturbance inside the business. The former employee was harassing current employees and pushed the business manager after being asked to leave multiple times. The former employee left the scene before police arrival. Restraining order information was provided as an option for the business and employees. (SJPD case # 25-239-1017)

Comment: Only the restaurant was open. The incident had nothing to do with the business operation, only the staff.

Police Citation. Should the incident be counted against San Pedro Social or removed from the police memorandum?

5. On 08/23/25, at approximately 2342 (11:42PM) hours, a battery occurred on the premise.

While inside the business, the victim attempted to stop an unknown male from sexually assaulting a female friend by getting in between them. The suspect came from behind the unknown male and punched the victim in the face once. Security officers pushed the victim outside of the business. The victim contacted police. The suspect was not located. The victim sustained complaint of pain to his nose. (SJPD case # 25-235-1000)

• Incident occurred at 83 S. 2nd Street, not 163 W. Santa Clara St.

Comment: Incident should be removed from report. Please show deleted.

6. On 7/28/25, Monday at approximately 0200 hours (2:00AM), a battery occurred on the premise. The suspects physically assaulted the victim inside the business and outside of the business. The victim sustained facial abrasions, a small cut on his face, and had complaint of pain on his neck and leg. The victim sought medical attention and was treated. (SJPD case #25-209-0443)

Comment: San Pedro Social is not open on Mondays. Incident report states: TRAC- TRAC, NUMBER FOR DOCUMENTATION ONLY. Please remove from police memorandum.

• (Not included in previous memo) On 06/29/25 at approximately 2000 hrs (8:00PM), a sexual battery incident occurred at the San Pedro Social Restaurant in downtown San Jose. While on the dance floor the suspect stuck her hand down the back of the victim's pants and proceeded to grab his underwear and pull it up hard causing him discomfort and embarrassment. The victim left the dance floor and left the club shortly thereafter.

The victim identified the suspect. (SJPD case #25-182-9701) Comment: This incident does not appear on either of the official incident reports and should not be part of police memorandum.

7. On 3/27/25, at approximately 1854 hours (6:54PM), a battery occurred on the premise.

The suspect entered the business and shoved the victim. The suspect then retrieved a table from the patio and threw it over the counter at a pizza oven. (SJPD case #: 25-086-0756)

Comment: The suspect was a homeless man, not a client of the restaurant. Incident had nothing to do with San Pedro Social’s operation. Incident was called out as “Malicious Mischief” in the incident reports.

8. On 3/23/25, at approximately 0208 hours (2:08AM), an assault with a deadly weapon occurred on the premise. The suspect assaulted the victim. The victim sustained a brain bleed, skull fracture, and multiple abrasions to his face. Per doctor’s, the victim’s injuries were life-threatening injuries. (SJPD case #: 25-082-0089)

• Patrol officers reviewed video surveillance footage that showed the incident. In the video the suspects can be seen loitering on the crowded sidewalk of West Santa Clara Street with several other groups nearby. The victims can be seen walking down the sidewalk and it is apparent that a word or look is exchanged which causes the victims and suspects to confront each other.

201 W . Mission St. San José, CA 95110 (408) 277-4041
Comment: The sidewalk is not on the premise. Incident needs to be removed. San Pedro Social’s address must have been used because it was the closest building.

9. On 2/16/25, at approximately 0005 hours (5 minutes) ?, a reporting party called in stating that the suspect punched the victim, and he was bleeding from the head. She reported that there were approximately 20-30 subjects in a physical. (SJPD case #: 25-047-0005)

• Large physical fight occurred on the sidewalk in front of several businesses including Five Points Bar, located at 169 W Santa Clara St (next door to SP Social).

Eight suspects were taken into custody for the fight, many were intoxicated.

Comment: The above event had nothing to do with San Pedro Social, was not initated by the restaurant’s patrons.

Incident needs to be removed from Police report.

San Pedro Social Security staff provided a report (attached) from the three guards at the front door that calls out what they did when some of the people fighting outside wanted to enter the premises.

10. On 1/11/25, at approximately 2300 hours (11:00PM), a possible purse snatch occurred inside of the business. The victim stated they were inside the club dancing, when their wallet was taken. (SJPD case #25-0123-3215)

Comment: Before midnight but “dancing”. This was January 2025, 1.5 years ago before the operation “Change” happened with the addition of the management company that made Social compliant with planning and police conditions.

Incident Reports
Client: San Pedro Social
Location: San Jose, CA
Date of Incident: February 16, 2025

Reporting Officer: Sam Aragon
Report:

I was alerted by Machi when I was by the dj booth that there was a fight happening in the front of the building. I went around to the front doors and saw Donavan, Georgina and Adaya watching a fight the was happening outside. I saw some people jumping one individual who kicked his head kicked and face slammed against a truck. He was laying on the floor and his friends came around and picked him up and walked him off. As soon as that fight stopped another fight was happening in front of five points between two groups. As the fight was escalating several cop cars arrived to help the situation. The fight continued and it slowly moved in front of the social. As it was happening outside the front doors they ran into the line and the fight grew bigger and kept moving towards SOH. I went next door to check on them and saw the cops were trying to break it up in the doorway so I went back to get Donavan for backup and we made sure the people and workers in SOH were ok. The cops pulled out their tasers and tased several people and had about 2 or 3 individuals on the ground in the process of being handcuffed.

The cops were able to crowd control and get people away from the doorway and they were able to close the doors that were already locked. I escorted the group that was in there just to eat pizza through the social and out through the back because they were just trying to leave. We shut down the front doors and allowed everyone to leave out through the back.

Reporting Officer: Donavan Johnson
Report:

Donavan was doing pat downs at the front, then suddenly a fight erupted in front of the Social so then Donavan quickly went to the door and started pushing one of the guys that was fighting from the back to get him away from the front, then he gradually started closing the door because they was kind of in the way still. Donavan was able to close the right door, then Georgina started closing the left door and he helped her close the left door. Then they just kept fighting and it slowly started going next door to the pizza place. Donavan and Sam went over to next door through the Social and seen that the police was already trying to stop the fight. Then the cops eventually was able to close the doors at the pizza place.

Reporting Officer: Machi Robinson
Report:

Around 11:45 I seen two groups of parties get into a verbal confrontation that turned physical within the first 5 minutes of the argument. Then a male who looked to be about 6’2 or 6’3 threw a punch at a Polynesian male with braids and once the first punch landed it was a full on Brawl after that and the fight started to extend into the line of the social and the pizzeria next to it as well and from what I seen there were males fighting and hitting females and another guy got his head smashed into a vehicle i believe and from that point on I went to go notify everyone about the situation as well. Once I was finished I went to go check on the guards that were in the pizzeria and once I arrived the police already tased and arrested 2 people who were fighting in front of the pizzeria. Then once I got instructions on how do we want things to go moving forward in the social I went to report it to the rest of my team and informed them on the situation and what’s going on.

Reporting Officer: Georgina McCutcheon
Report:

The fight started at 12:15-12:20 based on the last ID I scanned. I was about to start scanning more IDs (we were close to capacity) and Donavan was doing pat downs. I looked up and saw about 4-5 guys all pushing each other and grabbing each others clothes. A few punches were thrown and the group fell into our barriers. Donavan and I pushed both the group fighting and the line back. We shut the doors as the fight moved onto the sidewalk. I saw one man being beat by at least three different men. He was thrown off the curb and kicked in the face and one man slammed his head into the hitch of a parked truck/trailer. They left him there and someone came by to pick him up and took him in the direction of SoH. The fight was still going on and they started pushing into the line waiting to get into the social. At this point a few police cruisers started to pull in. Donavan and I were holding the doors shut. Sam came to get Donavan to move to SoH. Adaya and I held the doors shut and I had my pepper spray ready in case the doors were unlocked. I could see a few people trying to fight the police but there were too many people in front of the door for me to see much else.

CP25-025 Staff Report
E. Noise Mitigation and Complaint Mitigation Measures (005F-MSC) My name is Sal Cerrillo and I’d like to respond to Mr. Hughes questions as they pertain to the project at San Pedro Social.

Question : Clarify where external speakers are located on the plan set Answer : 2 external speakers are currently hung up outside in the 2 corner edges of the property about 18ft up in the air facing San Pedro Social. The 3rd one (in white ) is hung up above the exit doors facing the middle of the patio. The amount of sound they all deliver has
been adjusted to equal 35 watts each or the max sound of a small portable bluetooth speaker (ie. Jbl Charge 6,
Bose Soundlink, etc…) Future install of such outdoor speakers would be placed lower and closer to the venue and or on the ground.

Question :

Clarify if nightclub sound can be played outdoors
Answer : No, the outside speakers are solely connected to the in-house system. Not nightclub sound.

Question : Sal Cerrillo lists their qualifications as an install technician. Are they certified in anything
specific to take/represent what the dBA is going to be? Answer : My technical audio certifications were established through D.A.S. Audio of North America in Florida on Ease Focus specializing in sound system designing, speaker splay management, and at Allen & Heath University specializing in sound board production and audio level management. In regard to tools, I use DBX RTA-M microphones to measure the decibel levels of venues without guests to dial in a system and a decibel sound level meter to use while the event is happening. I personally like to be -10 db less than the law requires the venue to be since some songs are produced and made differently including the users (DJ’s/Bands). I’d like to invite you out to see for yourself what 95db’s souns like in a reasonably bustling environment.

Question : Provide additional background information regarding Sal’s qualifications to make the claims made in this document.

Answer : DJ for over 25 years and an A/V technician for over 12 years, serving many event
venues and houses of worship with consultations and installation throughout the Bay Area including many in San Jose, (5 Points, O’Flaherty’s, Dr. Funk, LVL 44, San Pedro Social, FUZE, SP2, etc…) to name a few.

Question : Sal indicates they made measurements on June 27th, 2025. Was this day one of the ‘nightclub’ operating days? What I would expect to see is a baseline measurement and industry standards for nightclub noise ranges or some other equivalency.

Answer : Yes. Nightclub baseline standards can vary depending on the building/venue & amount of people the venue sees throughout the
event. There's always 3 stages to an event,
start, peak, and end. We generally like to start chill/easy going hovering around 85db, then gradually grow to 98-103 dB during peak hours &
then at the end the last 30-45 minutes to bring
the energy down to 95-98 dB.

Question : Confirm whether the operations measures were during a nightclub set or not.

Provide specifics if they exist such as social media f
or the night in question.

Answer : Yes, they were done during nightclub
time from roughly 11pm-11:30pm that evening
before the venue started to get full. There are no social media pictures of me measuring Db readings throughout the room with my equipment.

Question : Provide details about industry standards and how the measurements taken compare with those and what, if any, additional mitigation measures there are.

Answer : Usually measurement is done with a Db meter and or RTA mics set up in a room with sound programs & no guests. I wanted to give a more accurate reading with guests so that way the baseline isn't skewed. People absorb a good amount of sound naturally, with that said I do have digital sound processors connected to the system to safely play at a certain levels and to protect the sound equipment. Additional sound dampening is also found throughout the main room on the ceilings.

4. Log issue in CONNECT TEAMS via the appropriate report type.

If the observed violation or safety issue rises to the level of endangering human life or the facility, IMM
EDIATELY work to address the issue while executing step (2). Be sure to always complete step (4).

Example: You observe a Fight in the middle of the dance floor. CSI guards in the vicinity will respond immediately

The CSI Guards involved will then have 24 hours to complete their incident report on Connect-Teams.

De-Escalation procedures:

Physical Altercations - CSI will assist accordingly in escorting both parties out of different exits so that no possible fight occurs in front or back by taking both parties out the same direction.

O
nce outside, 1 to 2 guards will stay at the doors while everyone goes back to work as normal.

Gentle escorting is mandatory when removing a patron from the property. If the patron is causing harm, making threats, or endangering life, then a minimum of 2 guards will assist in escorting that person out to ensure the safety of property and guests. 9 Verbal Altercations - CSI will have 1 guard and a lead go and investigate the situation and use as many verbal de-escalation tools as possible to keep both parties from getting physical. If the situation is handled, then the guard will go back to post while the supervisor/lead will pin that group as a possible group or person of interest for the rest of the night for our guards to keep an eye on them. If the situation arises and verbal turns physical, then please refer to physical altercation procedure

Office of the City Attorney
Attention: Maren J. Clouse, Esq.
200 East Santa Clara Street, 16th Floor Tower
San Jose, CA 95512-1905

Re: Subject Property: 163 W Santa Clara St., San Jose, CA.

Subject Business: San Pedro Social

Dear Ms. Clouse:

I am the Managing Member of SP Social, LLC (“SPS”), the operator of the above-referenced subject business and write to respond to your letter of October 6, 2025.

By way of background, SPS opened on March 3rd, 2022.

In February of 2025, as you stated in your letter, the City of San Jose (“City”) Code Enforcement department issued a Compliance Order. After receiving the Compliance Order, the SPS team met with City staff in March of 2025 to discuss how to address the Compliance Order and what form of application would be required.

At that meeting, City staff directed the SPS team to process a Special Use Permit (“SUP”) that would allow SPS to operate from 12 a.m. to 2 a.m. with the entertainment uses that were currently a part of the SPS operation. SPS filed an SUP application and was informed that the SUP application would be heard at a subsequent Director’s Hearing.

As stated in your letter, on April 10, at the Appeals Hearing Board hearing, conditions to comply with the order were approved as listed in that hearing’s staff report. SPS was allowed to operate until April 19th with entertainment uses and until 2 am because of previous bookings.

After April 19, 2025, SPS closed at midnight and continued its entertainment uses up to said midnight closing. SPS, in good faith, misunderstood what the City staff wanted and intended in the Appeals Board conditions as (arguably) the condition as written seemed to suggest that we had to generally cease operations after midnight not that the specific entertainment uses were to cease completely and immediately.

2 As soon as SPS was informed that we were required to cease completely the entertainment uses, SPS complied with the City’s September 16-17th 2025 notice. Unequivocally, since September 18, 2025, SPS is and has been operating in compliance with the April 10th conditions.

Specifically, SPS operations do not include any entertainment use and we ceased operating after midnight after April 19, 2025.

SPS is currently operated only as Public Eating Establishment which is the same as the Farmer’s Union and other nearby Public Eating Establishments. Our research indicates no CUP or SUP are required for a Public Eating Establishment at this location and operations per the definition allow operating hours between 6 am and 12 am. Critically, we serve food at a minimum until a minimum of 30 minutes prior to closing, which is a requirement of the ABC 47 license. To the extent you have been given any other facts to the contrary, I want to emphatically and unequivocally state that SPS serves food with a kitchen and staff.

Importantly, SPS has responded to all ABC requests and has supplied the required information that confirms compliance with the ABC 47 license.

To address the additional concerns raised in your letter, I provide you with the following information:

On June 30th 2025, SPS management was transferred to MarginLink, a professional restaurant and entertainment management company (https://www.marginlink.com/);
Mike Messinger is a Managing Member of SP Social LLC;
Nuisance disturbances information:
▪ Bullet point 1. July 28th incident. SPS was closed that day, so no occurrence happened at SPS. In an attachment to this response are SPS notes on the dates the below incidents occurred.
▪ Bullet point 2. March 23rd, 2025. Before MarginLink. ▪ Bullet point 3. August 17th, 2024. See attached notes. ▪ Bullet point 4. August 3rd,2024. See attached notes. ▪ Bullet point 5. March 9th, 2024. See attached notes. ▪ Also please see Exhibit A in attachment 3 Updated Security Plan which is proactively addressing any current and future security issues; and SPS acknowledges your authority to bring action.

As outlined herein, SPS’s willingness to cooperate with all City agencies and process the proper permits is unquestioned. There has been some confusion, but SPS management has done its best to respond and comply with all City requests and ordinances. SPS remains and is always available to discuss and to respond to any City concern.

MARGINLINK NOTES ON INCIDENTS 10/13/25

Below is a detailed, chronological summary of San Pedro Social’s compliance efforts following the Appeals Hearing Board’s decision.

May 27, 2025 — Appeals Hearing Board Decision
The Appeals Hearing Board directed San Pedro Social to cease operations past midnight. Since that date, we have consistently closed and cleared the premises by midnight. Coleman Security patrols the property each night to ensure all guests have departed by that time. Point-of-sale reports confirm no transactions in the main bar or dining areas after midnight. Across all operations, including the pizza counter, total post-midnight sales since May 27 have amounted to only $150—limited to pizza slices and beverages sold within one to two minutes after midnight.

June 30, 2025 — Transition to Professional Management Company On June 30, 2025, San Pedro Social engaged MarginLink as its new management company to oversee all day-to-day operations in a professional and compliant manner. MarginLink immediately implemented structured operating procedures, compliance oversight, and communication protocols to ensure the venue’s continued adherence to all applicable regulations and permit conditions.

July 28, 2025 — Alleged Altercation Incident
On July 28, 2025, an accusation was made that a fight began inside San Pedro Social and continued outside the premises, allegedly resulting in a victim requiring emergency medical treatment.

It should be noted that July 28, 2025, fell on a Monday, a day when San Pedro Social’s bar and main venue were closed. Only the Slice of Homage pizza counter was open for limited service. Based on this, we assume the alleged incident occurred in the early morning hours following Sunday, July 27, and have therefore included the manager’s log from that evening and the previous evening for context.

According to our End-of-Day Manager Logs and security reports, there was no record of any physical altercation, disturbance, or request for emergency medical assistance on or around that date.

The following shift recap was entered into the manager log for Saturday, July 26, 2025, which reflects a normal and well-managed evening at SPS, and mentioning a fight at a neighboring bar.

5 SHIFT RECAP:
“An active Saturday. Reports from the morning that it was slow; to save labor, Javi sent some staff home. Afternoon was slow for a while till the night time. Club night was busy with the event.

Host was happy on the event that it finished right as we closed. Rosie and Michael did a great job on the event. We did have them play their own music in the patio but had to turn it down around 10:30 p.m. Host had left some stuff in the office; she’ll come tomorrow for it. DJ did a great job. No issues with security. Two fights happened at the next bar to us, which occurred after our doors were closed. A smooth close that we hit $22k for the day.” The following shift recap was entered into the manager log for Sunday, July 27, 2025, the night preceding the date of the alleged incident:

SHIFT RECAP:
“A busy Sunday. Reports from the opening that it was a slow start but was good timing for cleaning up the restaurant for today's event. Javi had sent some staff home to save labor. The afternoon was busy with the home slice event. A bit of miscommunication with the entry but it was solved. I had sent out some promotional samples of our special pizza for the event. Louie did a great job through the shift, he was able to sell 4 of them. Had Dakota push for more sale. Patio was alive and had a good number of guests. Since we had a good number of guests, we kept the inside open for more drink sales. We had kept 4 guards to control the crowd. We kept open till 11:15 p.m. since we had a small group. At the end of the day I had to do some comps due to some tables walking out and SOH having some guests change their order. A smooth Sunday.” These contemporaneous records from management and our security reports confirm a typical weekend of business operations with no disturbances, altercations, or incidents matching the description of the alleged report.

May–September 2025 — Ongoing Compliance Initiatives
During this period, we worked closely with the ABC, Planning Department, Health Department, and SJPD to address and correct any noncompliant issues. Our actions included:
• Ensuring all equipment and fixtures met current Health Department standards.

• Verifying that all structural elements and modifications adhered to applicable building codes.

• Submitting entertainment permit applications with the SJPD.

6 • Maintaining full compliance with all ABC licensing conditions.

• Employing a third-party security team that exceeded staffing levels typically required for a venue of our capacity.

• Meeting between our City Council representative and Mike Messinger, to discuss community engagement and compliance objectives.

August 11, 2025 — Community Meeting
We participated in a public community meeting as part of the SUP application process. At that meeting, Alexandre from the Planning Department advised that we apply for a CUP rather than an SUP. There was no mention of restrictions related to DJs, dancing, or earlier closing times.

August 28, 2025 — ABC Inspection
At approximately 11:30 p.m., an ABC officer inquired about food availability. Due to a misunderstanding, the bartender failed to inform him that food was available from our pizza counter, leading to a mistaken impression. To correct this, we:
• Installed a self-order kiosk for guests to order food directly.

• Retrained all staff on proper communication regarding food service.

• Ensured a full menu remains available until at least 30 minutes before closing.

We also made efforts to clarify to the ABC that “Slice of Homage” is operated by San Pedro Social (shared POS system, staff, bank account, and food purchasing).

September 11, 2025 — Meeting with Office of Economic Development and Cultural Affairs Attendees included myself, Mike Messinger, Michael Lomio, Chris Arkley, and Blage Zelalich.

We met for approximately one hour to review our compliance efforts and discuss a collaborative path forward with the City.

September 16–17, 2025 — Notice of Violation
We received an SJPD Notice of Violation and administrative fines (attached) for not having an Owner/Manager License and Entertainment Permit—despite those applications being pending.

7 Prior to receipt, I had left multiple voicemails for Valerie in SJPD Permitting without response.

Upon finally reaching her, I was informed that the Entertainment Permit could not be processed until our CUP was approved. I had already completed the Livescan and updated most of the application, but processing was halted due to the CUP requirement.

September 18, 2025 — Meeting with SJPD
I met with Sgt. Rick Galea (SJPD), along with GM Ja’V onn Williams, CSI VP Brian Janes, CSI Supervisor Lead John Keller, and CSI Supervisor Sam [last name unknown]. The two-hour discussion covered entertainment permit regulations, local venue history, and best practices in security. We expressed our full commitment to compliance.

Following that meeting, we implemented immediate corrective actions:
• Cancellation of all upcoming DJ performances (at significant cost).

• Cancellation of Thursday Karaoke and Tuesday Trivia.

• Disconnection of patio speakers.

• Conversion of the dance floor into a seating area.

• Communication of new restrictions to all supervisors and security staff.

• Public notification of entertainment cancellations via social media.

Since that date, we have hosted no live music, karaoke, dancing, or audience participation of any kind.

October 4, 2025 — SJPD Observation
Sgt. Galea observed dancing through the window but did not enter the premises. Upon reviewing the security footage (attached), I confirmed a small group of guests briefly danced for approximately 10 minutes without authorization. I have since instructed management and security to immediately intervene if any dancing occurs.

8 Attachments
For your reference, I am including the following materials in support of this summary:
• Video footage from October 4, 2025
o (dancing begins around 22:32 and ends around 22:44)

• Copies of the SJPD fine notices

• POS transaction reports verifying midnight closures

• Security team’s written responses to alleged incidents on the property

• The 3 previous CUPs attached to the property at 163 West Santa Clara St.

Alexandre,
Per your request, attached as floor plans for San Pedro Social (SPS). Plans included are the ground floor, basement (both in first attachment), patio (second attachment). Also attached is a Management Plan (third attachment) that describes how San Pedro Social operates.

Please note that all food is prepared in the SPS kitchen including anything being sold to go. Note that the “to go” area where pizza can be ordered is part of SPS and not a separate space.

SPS has one Point of Sale program for food and beverages. The Management Plan description provided is consistent with the approved use under SPS’s current ABC 47 license and is the same as several operations in the area that are operating until 2 am under ABC 47 licenses.

We hope this provides the information that you requested, but please call or email if you need anything more or have questions.

I still believe it is essential that we have you and any of the city staff that would like to meet at SPS for a tour. This tour will help clear up any conflicts and/or clarify how SPS operates. I also suspect that at the CUP hearing staff may be asked if they physically toured SPS and confirmation that you did tour SPS may help with your presentation to the City Council.

Thank you again for all your efforts and I am available for questions at your convenience.

Kelly,

The plans have been sent back to you.

I spoke with ABC and they seem to indicate that you could still operate with the type 47 so long as all conditions are maintained. For your plan set resubmittal, show us how you will be meeting those conditions. I need full interior floor plan details for all levels. I need an updated operations plan to clear up inconsistencies.

Subject: Drinking Establishment

Alexandre,
Now that you are discussing classifying SPS as a "drinking establishment," will you please refer me to the ordinance section that defines it. I know we had issues with a Night Club definition and want to avoid any discrepancies and make sure we all have the right definition.

Thanks,
Kelly
