MINUTES OF THE
JOINT MEETING OF THE RULES AND OPEN GOVERNMENT COMMITTEE AND
COMMITTEE OF THE WHOLE
SAN JOSÉ, CALIFORNIA WEDNESDAY, AUGUST 26, 2026
The Committee meeting was held in the Council Chambers and convened at 2:00 p.m.
Present: Councilmembers - Cohen, Kamei, Foley, Doan, Candelas.
Absent: Councilmembers - None.

A. City Council (City Clerk)
1. Review September 1, 2026 Final Agenda
a) Add New Items to Final Agenda
b) Assign "Time Certain" to Agenda Items (if needed)
c) Review of Notice of Waiver Requirements for Agenda Items or Documents (if needed) Public Comment: Brian Darby offered public comment.
Action: Upon motion by Vice Mayor Pam Foley, seconded by Councilmember Rosemary Kamei, and carried unanimously, the Committee approved the final agenda for the City Council meeting on September 1, 2026. (5-0-0)
2. Review September 8, 2026 Draft Agenda – Cancelled.
B. Consent Calendar
Public Comment: (In Person) Brian Darby and (Virtual) Jordan Moldow offered public comment.
Jeffrey Provenzano, Director, Environmental Services Department, responded to questions from the Committee regarding Item B.3.
Action: Upon motion by Councilmember Bien Doan,seconded by Councilmember Rosemary Kamei, and carried unanimously, the Consent Calendar was approved as a whole, with the following actions taken as indicated. (5-0-0)

1. The Public Record for August 13, 2026 - August 20, 2026. (City Clerk) Receive and file the Public Record for August 13, 2026 - August 20, 2026.
Action: The Public Record for August 13, 2026 - August 20, 2026 was received and filed. (5-0-0)
2. VEBA Advisory Committee Appointment. (City Manager)
(a) Approve the appointment of Edward Carboni, nominated by the Police Officers’ Association (POA), as the POA’s active employee member to the Voluntary Employees Beneficiary Association (VEBA) Advisory Committee (VAC) for a partial term ending May 31, 2028. (b) Place the item on the September 1, 2026 City Council Agenda for action.
Action: The appointment of Edward Carboni to the Voluntary Employees Beneficiary Association (VEBA) Advisory Committee (VAC), was approved for placement on the September 1, 2026 City Council Agenda for action. (5-0-0)
3. Joint Special Meeting of the City Council of San José and San José/Santa Clara Treatment Plant Advisory Committee. (Environmental Services)
Set a Joint Special Meeting of the City Council of San José and San José/Santa Clara Treatment Plant Advisory Committee on Thursday, November 5, 2026, from 10:00 a.m. – 1:00 p.m. at the San José - Santa Clara Regional Wastewater Facility located at 700 Los Esteros Road, San José, CA, and approve the Special Meeting agenda.
Action: A Joint Special Meeting of the City Council of San José and San José/Santa Clara Treatment Plant Advisory Committee was set for November 5, 2026, and the special meeting agenda was approved. (5-0-0)

D. Open Forum
1. Brian Darby emphasized the need to productively address different beliefs held by members of the community.
